5656 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5757 SECTION 1. Section 28-1-2 NMSA 1978 (being Laws 1969,
5858 Chapter 196, Section 2, as amended) is amended to read:
5959 "28-1-2. DEFINITIONS.--As used in the Human Rights Act:
6060 A. "person" means one or more individuals, a

9191 B. "employer" means any person employing four or
9292 more persons and any person acting for an employer;
9393 C. "commission" means the human rights commission;
9494 D. "director" or "bureau" means the human rights
9595 bureau of the labor relations division of the workforce
9696 solutions department;
9797 E. "employee" means any person in the employ of an
9898 employer or an applicant for employment;
9999 F. "labor organization" means any organization that
100100 exists for the purpose in whole or in part of collective
101101 bargaining or of dealing with employers concerning grievances,
102102 terms or conditions of employment or of other mutual aid or
103103 protection in connection with employment;
104104 G. "employment agency" means any person regularly
105105 undertaking with or without compensation to procure
106106 opportunities to work or to procure, recruit or refer
107107 employees;
108108 H. "public accommodation" means any governmental
109109 entity or any establishment that provides or offers its
110110 services, facilities, accommodations or goods to the public,
111111 but does not include a bona fide private club or other place or
112112 establishment that is by its nature and use distinctly private;
113113 I. "public contractor" means a person who receives
114114 public funds as a result of contracting with a governmental

144144 J. "political subdivision" means any:
145145 (1) county;
146146 (2) incorporated city, town or village;
147147 (3) drainage, conservancy, irrigation, water
148148 and sanitation or other district;
149149 (4) mutual domestic association;
150150 (5) public water cooperative association; or
151151 (6) community ditch association;
152152 K. "housing accommodation" means any building or
153153 portion of a building that is constructed or to be constructed,
154154 which is used or intended for use as the residence or sleeping
155155 place of any individual;
156156 L. "real property" means lands, leaseholds or
157157 commercial or industrial buildings, whether constructed or to
158158 be constructed, offered for sale or rent, and any land rented
159159 or leased for the use, parking or storage of house trailers;
160160 M. "secretary" means the secretary of workforce
161161 solutions;
162162 N. "unlawful discriminatory practices" means those
163163 unlawful practices and acts specified in Section 28-1-7 NMSA
164164 1978;
165165 O. "physical or mental disability" means a physical
166166 or mental impairment that substantially limits one or more of a
167167 person's major life activities. A person is also considered to

197197 of a physical or mental disability or is regarded as having a
198198 physical or mental disability;
199199 P. "major life activities" means functions such as
200200 caring for one's self, performing manual tasks, walking,
201201 seeing, hearing, speaking, breathing, learning and working;
202202 Q. "applicant for employment" means a person
203203 applying for a position as an employee;
204204 R. "sex" means a person's categorization as male,
205205 female or intersex based on biology, physiology and physical
206206 characteristics;
207207 S. "sexual orientation" means a person's physical,
208208 romantic or emotional attraction to persons of the same or a
209209 different gender or the absence of any such attraction;
210210 T. "gender identity" means a person's self-
211211 perception, based on the person's appearance, behavior or
212212 physical characteristics, that the person exhibits more
213213 masculinity or femininity or the absence of masculinity or
214214 femininity whether or not it matches the person's gender or sex
215215 assigned at birth;
216216 U. "gender" means an individual or societal
217217 expectation or perception of a person as masculine or feminine
218218 based on appearance, behavior or physical characteristics;
219219 V. "reasonable accommodation" means modification or
220220 adaptation of the work environment, work schedule, work rules

250250 to explore less restrictive or less expensive alternatives to
251251 enable an employee to perform the essential functions of the
252252 job and that does not impose an undue hardship on the employer;
253253 W. "undue hardship" means an accommodation
254254 requiring significant difficulty or expense when considered in
255255 light of the following factors:
256256 (1) the nature and cost of the accommodation;
257257 (2) the financial resources of the employer
258258 involved in the provision of the reasonable accommodation;
259259 (3) the number of persons the employer
260260 employs;
261261 (4) the effect of the accommodation on
262262 expenses and resources;
263263 (5) the impact of the accommodation otherwise
264264 upon the employer's business;
265265 (6) the overall financial resources of the
266266 employer;
267267 (7) the overall size of the business of an
268268 employer with respect to the number, type and location of its
269269 facilities;
270270 (8) the type of operation of the employer,
271271 including the composition, structure and functions of the
272272 workforce of the employer; or
273273 (9) the geographic separateness or

303303 employer's facilities;
304304 X. "cultural or religious headdresses" includes
305305 hijabs, head wraps or other headdresses used as part of an
306306 individual's personal cultural or religious beliefs;
307307 Y. "protective hairstyles" includes such hairstyles
308308 as braids, locs, twists, tight coils or curls, cornrows, bantu
309309 knots, afros, weaves, wigs or head wraps;
310310 Z. "race" includes traits historically associated
311311 with race, including hair texture, length of hair, protective
312312 hairstyles or cultural or religious headdresses;
313313 AA. "state" means the state of New Mexico or any of
314314 its agencies, departments, boards, instrumentalities or
315315 institutions;
316316 BB. "governmental entity" means the state or any
317317 public body;
318318 CC. "public body" means a state or local
319319 government, an advisory board, a commission, an agency or an
320320 entity created by the constitution of New Mexico or any branch
321321 of government that receives public funding, including political
322322 subdivisions, special tax districts, school districts and
323323 institutions of higher education;
324324 DD. "services" means any function, program,
325325 activity or benefit; [and ]
326326 EE. "military status" means a person's active

356356 a veteran of the armed forces or state defense force and
357357 includes a spouse or child of an active member or veteran of
358358 the armed forces or state defense force;
359359 FF. "source of income" means any lawful and
360360 verifiable source of money, funds, payments or other monetary
361361 consideration, including:
362362 (1) income from a lawful profession,
363363 occupation or job;
364364 (2) social security benefits;
365365 (3) pension, annuity, alimony or child support
366366 income; or
367367 (4) any form of federal, state or local
368368 government or nonprofit organization assistance or housing
369369 assistance, including vouchers paid directly to a housing
370370 provider even if the assistance includes requirements for
371371 inspections, administrative processes or contracting
372372 agreements;
373373 GG. "invalid screening process" means a screening
374374 process used to determine the sufficiency of income or assets
375375 of an individual or a housing applicant that:
376376 (1) fails to include all of the individual's
377377 or the housing applicant's sources of income; or
378378 (2) fails to limit the calculation of an
379379 applicant's income requirement to the remaining ratio of income

411411 HH. "housing applicant" means an individual
412412 applying to rent or own a housing accommodation ."
413413 SECTION 2. Section 28-1-4 NMSA 1978 (being Laws 1987,
414414 Chapter 342, Section 18) is amended to read:
415415 "28-1-4. POWERS AND DUTIES.--
416416 A. Except as provided in Section 28-1-7.3 NMSA
417417 1978, the commission may:
418418 (1) hear complaints and issue orders,
419419 including cease and desist orders concerning alleged unlawful
420420 discriminatory practice; and
421421 (2) hold hearings, subpoena witnesses and
422422 compel their attendance, administer oaths, take the testimony
423423 of any person under oath, order depositions and require the
424424 production for examination of any books, records,
425425 correspondence, documents and other evidence relating to any
426426 matter under investigation or in question before the
427427 commission. Contumacy or refusal to obey a subpoena issued
428428 pursuant to this section constitutes contempt punishable by the
429429 district court of the judicial district in which the witness
430430 may be found. No individual shall be excused from attending
431431 and testifying or from producing evidence in obedience to a
432432 subpoena issued pursuant to this section on the grounds that

461461 the testimony or evidence required of [him ] the individual may
462462 tend to incriminate [him ] or subject [him] that individual to a
463463 penalty or a forfeiture. However, no individual shall be
464464 prosecuted or subjected to any penalty or forfeiture concerning
465465 any matter for which [he ] the individual is compelled to
466466 testify or give evidence after having claimed [his ] the right
467467 against self-incrimination. Nevertheless, the individual so
468468 testifying shall not be exempt from prosecution and punishment
469469 for perjury committed while testifying.
470470 B. Except as provided in Section 28-1-7.3 NMSA
471471 1978, the human rights bureau of the labor relations division
472472 of the workforce solutions department may:
473473 (1) receive and investigate complaints of
474474 alleged unlawful discriminatory practice;
475475 (2) seek to eliminate discrimination through
476476 conciliation and persuasion by voluntary conferences with
477477 interested parties;
478478 (3) recommend application by the director to a
479479 district court in the county where the violating party resides
480480 for specific performance of any conciliation agreement or for
481481 enforcement of any order issued by the commission;
482482 (4) endeavor to eliminate prejudice and to
483483 further good will. The [division ] bureau, in cooperation with
484484 the [state department of ] public education department and local
485485 boards of education, shall encourage an educational program for

520520 state and to make recommendations to the secretary for the
521521 development of policies and procedures [which ] that the
522522 secretary may recommend to appropriate state agencies;
523523 (6) seek and enlist the cooperation and
524524 contributions and grants of individuals and foundations,
525525 private, charitable, religious, labor, civic and benevolent
526526 organizations and the federal government for the purposes of
527527 this section;
528528 (7) issue publications and release the results
529529 of investigation and research [which ] that in the secretary's
530530 judgment will tend to promote good will and prevent or
531531 eliminate discrimination; and
532532 (8) submit annually a written report of all
533533 its activities and recommendations to the secretary, the
534534 governor and the legislature."
535535 SECTION 3. Section 28-1-7 NMSA 1978 (being Laws 1969,
536536 Chapter 196, Section 7, as amended) is amended to read:

572572 privileges of employment against any person otherwise qualified

582582 expel or otherwise discriminate against any of its members or
583583 against any employer or employee because of race, religion,
584584 color, national origin, ancestry, sex, sexual orientation,
585585 gender, gender identity, pregnancy, childbirth or condition

589589 C. any employer, labor organization or joint
590590 apprenticeship committee to refuse to admit or employ any

787787 limitation or discrimination as to race, religion, color,
788788 national origin, ancestry, sex, sexual orientation, gender,
789789 gender identity, pregnancy, childbirth or condition related to
790790 pregnancy or childbirth, spousal affiliation, physical or
791791 mental disability or military status; provided that the
792792 physical or mental disability is unrelated to a person's
793793 ability to acquire or rent and maintain particular real
794794 property or housing accommodation;
795795 H. any person to whom application is made either
796796 for financial assistance for the acquisition, construction,
797797 rehabilitation, repair or maintenance of any housing

12581258 The complaint shall be written and shall state the name and

12611261 attorney general shall review the complaint to ensure the
12621262 alleged discriminatory practice falls within the scope of this
12631263 section, and if so, the attorney general shall conduct an
12641264 investigation and determine any further action as provided in
12651265 this section; or
12661266 (2) may be instituted by the attorney general
12671267 in a civil action on behalf of the state alleging an unlawful
12681268 discriminatory practice in violation of this section if the
12691269 attorney general has reasonable belief that a person has
12701270 violated this section and that instituting a proceeding against
12711271 that person would be in the public interest. The action may be
12721272 brought in the district court of the county in which the person
12731273 alleged to have violated that act resides or in which the
12741274 person's principal place of business is located. The attorney
12751275 general shall not be required to post bond when seeking a
12761276 temporary or permanent injunction in the civil action.
12771277 G. The attorney general shall have the authority to
12781278 investigate a complaint pursuant to this section and may:

13181318 including injunctive relief, civil penalties or other equitable
13191319 relief as deemed necessary; and
13201320 (5) refer matters for criminal prosecution if
13211321 evidence of willful or egregious violations is discovered.
13221322 H. In a civil action brought under this section, if
13231323 a court finds that a person willfully committed an act in
13241324 violation of this section, the attorney general may seek to
13251325 recover a civil penalty not to exceed five thousand dollars
13261326 ($5,000) per violation, in addition to any equitable relief
13271327 imposed by the court.
13281328 I. The attorney general may, in addition to or as
13291329 an alternative to pursuing a civil action as provided in this
13301330 section, pursue criminal charges against a person for an
13311331 alleged violation of this section under the applicable
13321332 provisions of the Criminal Code. Venue for any criminal action
13331333 shall be in the judicial district where the violation
