49	49	RELATING TO CRIMINAL OFFENSES; PROVIDING THAT KNOWINGLY MAKING
50	50	A FALSE STATEMENT ON A MATTER FOR WHICH TESTIMONY IS REQUESTED
51	51	IN A LEGISLATIVE PROCEEDING CONSTITUTES PERJURY REGARDLESS OF
52	52	WHETHER THE STATEMENT IS MADE UNDER OATH, AFFIRMATION OR
53	53	PENALTY OF PERJURY.
54	54	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
55	55	SECTION 1. Section 30-25-1 NMSA 1978 (being Laws 1963,
56	56	Chapter 303, Section 25-1, as amended) is amended to read:
57	57	"30-25-1. PERJURY.--
58	58	A. Perjury consists of making a false statement:
59	59	(1) under oath, affirmation or penalty of
60	60	perjury, material to the issue or matter involved in the course
61	61	of any judicial or administrative [legislative ] proceeding or
62	62	other official proceeding or matter not before the legislature ,

91	91	(2) material to the issue or matter of which
92	92	the person making the statement has been requested to testify
93	93	in any proceeding before the legislature, including any hearing
94	94	of a standing or interim committee of the legislature, knowing
95	95	that statement to be untrue and regardless of whether the
96	96	statement is made under oath, affirmation or penalty of
97	97	perjury; provided that the provisions of this paragraph do not
98	98	apply to a statement made by a member of the public during a
99	99	designated period for public comment at a hearing of a standing
100	100	or interim committee of the legislature .
101	101	B. Whoever commits perjury is guilty of a fourth
102	102	degree felony."
