49	49	RELATING TO EMPLOYMENT; INCLUDING VETERINARIANS IN THE
50	50	DEFINITION OF "HEALTH CARE PRACTITIONER" FOR THE PURPOSE OF
51	51	MAKING CERTAIN PROVISIONS IN HEALTH CARE PRACTITIONER
52	52	AGREEMENTS VOID, UNENFORCEABLE AND AGAINST PUBLIC POLICY.
53	53	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
54	54	SECTION 1. Section 24A-4-1 NMSA 1978 (being Laws 2015,
55	55	Chapter 96, Section 1, as amended) is amended to read:
56	56	"24A-4-1. DEFINITIONS.--As used in [Chapter 24, Article
57	57	1I] Chapter 24A, Article 4 NMSA 1978:
58	58	A. "agreement" means a written contract to which a
59	59	health care practitioner is a party; and
60	60	B. "health care practitioner" means:
61	61	(1) a dentist;
62	62	(2) an osteopathic physician;

91	91	(4) a [podiatrist] podiatric physician ;
92	92	(5) a certified registered nurse anesthetist;
93	93	(6) a certified nurse practitioner;
94	94	(7) a certified nurse-midwife;
95	95	(8) a psychologist;
96	96	(9) a physician assistant; [and ]
97	97	(10) a pharmacist; and
98	98	(11) a veterinarian."
99	99	SECTION 2. Section 24A-4-5 NMSA 1978 (being Laws 2015,
100	100	Chapter 96, Section 5, as amended) is amended to read:
101	101	"24A-4-5. APPLICABILITY.--
102	102	A. Chapter [24] 24A, Article [1I] 4 NMSA 1978 does
103	103	not apply to agreements between health care practitioners who
104	104	are shareholders, owners, partners or directors of a health
105	105	care practice.
106	106	B. Except as provided by Subsections C [and D ]
107	107	through E of this section, the provisions of Chapter [24 ] 24A,
108	108	Article [1I] 4 NMSA 1978 apply to agreements, or renewals or
109	109	extensions of agreements, executed on or after July 1, 2015.
110	110	C. The provisions of Subsection B of Section
111	111	[24-1I-2] 24A-4-2 NMSA 1978 apply to agreements, or renewals or
112	112	extensions of agreements, executed on or after April 6, 2017.
113	113	D. For psychologists, physician assistants and
114	114	pharmacists, the provisions of Chapter [24 ] 24A, Article [1I] 4
