4949 RELATING TO ACCESSIBILITY; ENACTING THE TRAVELING WITH DIGNITY
5050 ACT; REQUIRING ALL FACILITIES THAT RECEIVE STATE FUNDING TO
5151 INSTALL UNIVERSAL ADULT CHANGING STATIONS.
5252 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5353 SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be
5454 cited as the "Traveling with Dignity Act".
5555 SECTION 2. [NEW MATERIAL] UNIVERSAL ADULT CHANGING
5656 STATIONS REQUIRED IN STATE-FUNDED FACILITIES.--
5757 A. As used in this section:
5858 (1) "commercial place of public amusement"
5959 means an auditorium, a convention center, a cultural complex,
6060 an exhibition hall, a permanent amusement park, a sports arena,
6161 a theater or a movie house for which the maximum occupancy is
6262 determined to be two thousand five hundred or more people;

9090 (2) "covered facility" means a public building
9191 or commercial place of public amusement that:
9292 (a) houses an entity or program that
9393 receives state funding to cover any portion of the entity or
9494 program's operating costs; and
9595 (b) receives at least two thousand five
9696 hundred visitors per year, as measured by the tourism
9797 department;
9898 (3) "public building" means a building owned
9999 by the state that is open to the public, including a state park
100100 that has permanent sanitary facilities;
101101 (4) "sanitary facility" means a restroom
102102 equipped with a flush toilet and proper drainage for all
103103 toilets, sinks, basins, bathtubs and showers; and
104104 (5) "universal adult changing station" means a
105105 powered, height-adjustable and adult-sized changing table that
106106 is installed in a single-occupancy restroom that is universal
107107 to gender and available to the public.
108108 B. By July 1, 2032, each covered facility shall
109109 install and maintain at least one universal adult changing
110110 station that is universally accessible to all genders when the
111111 facility is open to the public.
112112 C. After July 1, 2025:
113113 (1) each covered facility that undergoes a
114114 renovation that is estimated to cost more than fifty thousand

143143 dollars ($50,000) shall install and maintain at least one
144144 universal adult changing station that is universally accessible
145145 to all genders when the facility is open to the public; and
146146 (2) any newly constructed facility that
147147 receives state funding for construction or operating costs
148148 shall be built with at least one universal adult changing
149149 station that is universally accessible to all genders when the
150150 facility is open to the public.
