49	49	RELATING TO MEDICAID; REQUIRING THE HEALTH CARE AUTHORITY TO
50	50	CONDUCT COST STUDIES FOR EACH TYPE OF HEALTH CARE PROVIDER THAT
51	51	IS REIMBURSED BY MEDICAID.
52	52	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
53	53	SECTION 1. A new section of the Public Assistance Act is
54	54	enacted to read:
55	55	"[NEW MATERIAL] COST STUDIES REQUIRED.--
56	56	A. At least every three years, the authority shall
57	57	conduct cost studies for the purposes of determining the cost
58	58	of providing health care services for each type of health care
59	59	provider that is reimbursed by medicaid for providing services
60	60	to recipients. The cost studies shall include recommendations
61	61	for adequate reimbursement rates for each type of health care
62	62	provider reimbursed by medicaid based on:

90	90	(1) the cost to provide competitive
91	91	compensation to health care providers; and
92	92	(2) recent and projected changes in costs due
93	93	to factors that include inflation and rising wages.
94	94	B. When the authority submits a budget request to
95	95	the legislature, the authority shall include the most recent
96	96	cost study performed for each type of health care provider that
97	97	is reimbursed by medicaid.
98	98	C. The authority shall not be required to perform
99	99	cost studies for every type of health care provider that is
100	100	reimbursed by medicaid in the same year, so long as a cost
101	101	study is conducted for each type of health care provider at
102	102	least every three years.
103	103	D. For the purposes of this section, "medicaid"
104	104	means the federal-state program administered by the authority
105	105	pursuant to Title 19 or Title 21 of the federal Social Security
106	106	Act."
