4949 RELATING TO CHILDREN; REQUIRING THE CHILDREN, YOUTH AND
5050 FAMILIES DEPARTMENT TO CONDUCT A STUDY EVERY FIVE YEARS TO
5151 STUDY THE COSTS AND REIMBURSEMENT RATES FOR PROVIDING
5252 COMMUNITY-BASED FOSTER CARE PLACEMENTS AND TREATMENTS; MAKING
5353 AN APPROPRIATION.
5454 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5555 SECTION 1. A new section of the Children's Code is
5656 enacted to read:
5757 "[NEW MATERIAL] RATE STUDY--COSTS--REIMBURSEMENT RATES--
5858 COMMUNITY-BASED FOSTER CARE PLACEMENTS--TREATMENTS--REPORT.--
5959 A. Beginning in fiscal year 2026, the department
6060 shall conduct a study every five fiscal years to study the
6161 costs and reimbursement rates for providing community-based
6262 foster care placements and foster care treatment for children

9090 in foster care, including the costs of:
9191 (1) resources to address the safety and
9292 physical and emotional well-being of a child, parent, guardian
9393 or foster parent;
9494 (2) payments to reimburse resource families
9595 for the cost of food, clothing, shelter, daily supervision,
9696 school supplies, personal incidentals and reasonable travel
9797 expenses to meet the needs of a child in that resource family's
9898 care; and
9999 (3) any other applicable costs or
100100 reimbursements as identified by the department.
101101 B. The studies required in Subsection A of this
102102 section shall be provided to the legislative finance committee,
103103 with the initial study provided no later than December 1, 2025.
104104 Each additional study shall be provided no later than December
105105 1 of the calendar year in which the study is conducted.
106106 C. For the purposes of this section, "resource
107107 family" means a person or entity licensed by the department or
108108 licensed by another state's child welfare agency or a licensed
109109 child placement agency that provides foster care services,
110110 including respite, non-relative, relative or treatment foster
111111 care. "Resource family" includes foster parents as defined by
112112 Subsection K of Section 32A-1-4 NMSA 1978 and preadoptive
113113 parents as defined by Subsection Z of Section 32A-1-4 NMSA

143143 SECTION 2. APPROPRIATION.--One hundred thousand dollars
144144 ($100,000) is appropriated from the general fund to the
145145 children, youth and families department for expenditure in
146146 fiscal year 2026 to conduct a rate study as provided in Section
147147 1 of this act. Any unexpended or unencumbered balance
148148 remaining at the end of fiscal year 2026 shall revert to the
149149 general fund.
150150 SECTION 3. EFFECTIVE DATE.--The effective date of the
151151 provisions of this act is July 1, 2025.
