49	49	RELATING TO CHILDREN; REQUIRING THE CHILDREN, YOUTH AND
50	50	FAMILIES DEPARTMENT TO CONDUCT A STUDY EVERY FIVE YEARS TO
51	51	STUDY THE COSTS AND REIMBURSEMENT RATES FOR PROVIDING
52	52	COMMUNITY-BASED FOSTER CARE PLACEMENTS AND TREATMENTS; MAKING
53	53	AN APPROPRIATION.
54	54	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
55	55	SECTION 1. A new section of the Children's Code is
56	56	enacted to read:
57	57	"[NEW MATERIAL] RATE STUDY--COSTS--REIMBURSEMENT RATES--
58	58	COMMUNITY-BASED FOSTER CARE PLACEMENTS--TREATMENTS--REPORT.--
59	59	A. Beginning in fiscal year 2026, the department
60	60	shall conduct a study every five fiscal years to study the
61	61	costs and reimbursement rates for providing community-based
62	62	foster care placements and foster care treatment for children

90	90	in foster care, including the costs of:
91	91	(1) resources to address the safety and
92	92	physical and emotional well-being of a child, parent, guardian
93	93	or foster parent;
94	94	(2) payments to reimburse resource families
95	95	for the cost of food, clothing, shelter, daily supervision,
96	96	school supplies, personal incidentals and reasonable travel
97	97	expenses to meet the needs of a child in that resource family's
98	98	care; and
99	99	(3) any other applicable costs or
100	100	reimbursements as identified by the department.
101	101	B. The studies required in Subsection A of this
102	102	section shall be provided to the legislative finance committee,
103	103	with the initial study provided no later than December 1, 2025.
104	104	Each additional study shall be provided no later than December
105	105	1 of the calendar year in which the study is conducted.
106	106	C. For the purposes of this section, "resource
107	107	family" means a person or entity licensed by the department or
108	108	licensed by another state's child welfare agency or a licensed
109	109	child placement agency that provides foster care services,
110	110	including respite, non-relative, relative or treatment foster
111	111	care. "Resource family" includes foster parents as defined by
112	112	Subsection K of Section 32A-1-4 NMSA 1978 and preadoptive
113	113	parents as defined by Subsection Z of Section 32A-1-4 NMSA

143	143	SECTION 2. APPROPRIATION.--One hundred thousand dollars
144	144	($100,000) is appropriated from the general fund to the
145	145	children, youth and families department for expenditure in
146	146	fiscal year 2026 to conduct a rate study as provided in Section
147	147	1 of this act. Any unexpended or unencumbered balance
148	148	remaining at the end of fiscal year 2026 shall revert to the
149	149	general fund.
150	150	SECTION 3. EFFECTIVE DATE.--The effective date of the
151	151	provisions of this act is July 1, 2025.
