4949 RELATING TO ENERGY; ENACTING THE EFFICIENCY AND MERCURY
5050 STANDARDS FOR PRODUCTS AND LIGHTING FIXTURES ACT; PROVIDING

5252 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5353 SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be
5454 cited as the "Efficiency and Mercury Standards for Products and
5555 Lighting Fixtures Act".
5656 SECTION 2. [NEW MATERIAL] EFFICIENCY STANDARDS FOR
5757 PRODUCTS.--By July 1, 2026, the energy, minerals and natural
5858 resources department shall adopt rules to prohibit in New
5959 Mexico the sale, offering for sale, lease or rent of products
6060 listed in Subsection A of Section 3 of the Efficiency and
6161 Mercury Standards for Products and Lighting Fixtures Act unless
6262 the products meet energy or water efficiency standards as

9191 with an effort to be in alignment with similar standards
9292 adopted in other states. Any rulemaking pursuant to this
9393 section shall be conducted in accordance with the State Rules
9494 Act.
9595 SECTION 3. [NEW MATERIAL] SCOPE.--
9696 A. The provisions of the Efficiency and Mercury
9797 Standards for Products and Lighting Fixtures Act apply to the
9898 following covered products:
9999 (1) commercial dishwashers;
100100 (2) commercial fryers;
101101 (3) commercial hot-food holding cabinets;
102102 (4) commercial ovens;
103103 (5) commercial steam cookers;
104104 (6) computers and computer monitors;
105105 (7) computer server power supply units;
106106 (8) faucets;
107107 (9) gas fireplaces;
108108 (10) portable electric spas;
109109 (11) residential ventilating fans;
110110 (12) residential water softeners;
111111 (13) showerheads;
112112 (14) spray sprinkler bodies;
113113 (15) state-regulated battery charger systems;
114114 (16) urinals;

144144 (18) water coolers.
145145 B. The provisions of the Efficiency and Mercury
146146 Standards for Products and Lighting Fixtures Act do not apply
147147 to:
148148 (1) new products manufactured in New Mexico
149149 and sold outside New Mexico;
150150 (2) new products manufactured outside New
151151 Mexico and sold at wholesale inside New Mexico for final retail
152152 sale and installation outside New Mexico;
153153 (3) products installed in mobile manufactured
154154 homes at the time of construction; and
155155 (4) products designed expressly for
156156 installation and use in recreational vehicles.
157157 SECTION 4. [NEW MATERIAL] IMPLEMENTATION.--
158158 A. On and after January 1, 2027, no new covered
159159 product listed in Subsection A of Section 3 of the Efficiency
160160 and Mercury Standards for Products and Lighting Fixtures Act
161161 may be sold or offered for sale, lease or rent in New Mexico
162162 unless the new covered product meets or exceeds the
163163 requirements of the standards adopted pursuant to Section 2 of
164164 that act.
165165 B. On and after January 1, 2028, no new covered
166166 product listed in Subsection A of Section 3 of the Efficiency
167167 and Mercury Standards for Products and Lighting Fixtures Act

196196 may be installed for compensation in New Mexico unless the new
197197 covered product meets or exceeds the requirements of the
198198 standards adopted pursuant to Section 2 of that act.
199199 SECTION 5. [NEW MATERIAL] NEW AND REVISED STANDARDS.--The
200200 energy, minerals and natural resources department may adopt
201201 rules in accordance with the State Rules Act to establish
202202 increased efficiency standards or updated testing procedures
203203 for the products listed in Subsection A of Section 3 of the
204204 Efficiency and Mercury Standards for Products and Lighting
205205 Fixtures Act. The department may also establish standards for
206206 products not specifically listed in Subsection A of Section 3
207207 of that act. In considering such new or amended standards, the
208208 department shall set efficiency standards upon a determination
209209 that increased efficiency standards would serve to promote
210210 energy or water conservation in New Mexico and would be cost
211211 effective for consumers who purchase and use such new products;
212212 provided that no new or increased efficiency standards shall
213213 become effective within one year following the adoption of any
214214 amended rules establishing such increased efficiency standards.
215215 SECTION 6. [NEW MATERIAL] TESTING, CERTIFICATION,
216216 LABELING AND ENFORCEMENT.--As part of rules adopted pursuant to
217217 Section 2 of the Efficiency and Mercury Standards for Products
218218 and Lighting Fixtures Act, the energy, minerals and natural
219219 resources department shall adopt provisions for the testing,
220220 certification and labeling of products listed in Subsection A

250250 align with similar requirements in other states.
251251 SECTION 7. [NEW MATERIAL] POLLUTION STANDARDS--LIGHTING
252252 FIXTURES.--
253253 A. By July 1, 2026, the energy, minerals and
254254 natural resources department shall adopt rules to prohibit the
255255 sale or offering for sale in New Mexico of general-purpose
256256 compact fluorescent lamps and general-purpose linear
257257 fluorescent lamps. Such rules shall be adopted to be in
258258 alignment with similar prohibitions adopted in other states.
259259 Any rulemakings conducted pursuant to this section shall be
260260 held in accordance with the State Rules Act.
261261 B. On and after January 1, 2027, it shall be a
262262 violation of the Efficiency and Mercury Standards for Products
263263 and Lighting Fixtures Act to offer for final sale, sell at
264264 final sale or distribute in New Mexico as a new manufactured
265265 product a general-purpose compact fluorescent lamp or
266266 general-purpose linear fluorescent lamp.
267267 SECTION 8. [NEW MATERIAL] UTILITY-SPONSORED ENERGY
268268 EFFICIENCY PROGRAMS.--For a period of up to one year after the
269269 effective date of any applicable standard, utilities may
270270 continue to offer rebates and incentives to accelerate a market
271271 transition away from any covered products prohibited in the
272272 Efficiency and Mercury Standards for Products and Lighting
273273 Fixtures Act.

302302 SECTION 9. [NEW MATERIAL] ENFORCEMENT--PENALTIES.--If the
303303 energy, minerals and natural resources department finds any
304304 person has committed a violation of any provision of the
305305 Efficiency and Mercury Standards for Products and Lighting
306306 Fixtures Act, the department shall issue a warning to such
307307 person. Any person who commits the same violation after the
308308 issuance of such warning may be subject to a civil penalty,
309309 issued by the department, of up to one hundred dollars ($100)
310310 for each offense. Any further violations committed by such
311311 person after this second violation for the same offense may be
312312 subject to a civil penalty of not more than two hundred fifty
313313 dollars ($250) for each additional violation. Each covered
314314 product offered, sold or distributed in violation of the
315315 Efficiency and Mercury Standards for Products and Lighting
316316 Fixtures Act may constitute a separate violation, each
317317 violation may constitute a separate offense and each day that
318318 such violation occurs may constitute a separate offense.
