50	50	STANDARDS FOR PRODUCTS AND LIGHTING FIXTURES ACT; PROVIDING

52	52	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
53	53	SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be
54	54	cited as the "Efficiency and Mercury Standards for Products and
55	55	Lighting Fixtures Act".
56	56	SECTION 2. [NEW MATERIAL] EFFICIENCY STANDARDS FOR
57	57	PRODUCTS.--By July 1, 2026, the energy, minerals and natural
58	58	resources department shall adopt rules to prohibit in New
59	59	Mexico the sale, offering for sale, lease or rent of products
60	60	listed in Subsection A of Section 3 of the Efficiency and
61	61	Mercury Standards for Products and Lighting Fixtures Act unless
62	62	the products meet energy or water efficiency standards as

91	91	with an effort to be in alignment with similar standards
92	92	adopted in other states. Any rulemaking pursuant to this
93	93	section shall be conducted in accordance with the State Rules
94	94	Act.
95	95	SECTION 3. [NEW MATERIAL] SCOPE.--
96	96	A. The provisions of the Efficiency and Mercury
97	97	Standards for Products and Lighting Fixtures Act apply to the
98	98	following covered products:
99	99	(1) commercial dishwashers;
100	100	(2) commercial fryers;
101	101	(3) commercial hot-food holding cabinets;
102	102	(4) commercial ovens;
103	103	(5) commercial steam cookers;
104	104	(6) computers and computer monitors;
105	105	(7) computer server power supply units;
106	106	(8) faucets;
107	107	(9) gas fireplaces;
108	108	(10) portable electric spas;
109	109	(11) residential ventilating fans;
110	110	(12) residential water softeners;
111	111	(13) showerheads;
112	112	(14) spray sprinkler bodies;
113	113	(15) state-regulated battery charger systems;
114	114	(16) urinals;

144	144	(18) water coolers.
145	145	B. The provisions of the Efficiency and Mercury
146	146	Standards for Products and Lighting Fixtures Act do not apply
147	147	to:
148	148	(1) new products manufactured in New Mexico
149	149	and sold outside New Mexico;
150	150	(2) new products manufactured outside New
151	151	Mexico and sold at wholesale inside New Mexico for final retail
152	152	sale and installation outside New Mexico;
153	153	(3) products installed in mobile manufactured
154	154	homes at the time of construction; and
155	155	(4) products designed expressly for
156	156	installation and use in recreational vehicles.
157	157	SECTION 4. [NEW MATERIAL] IMPLEMENTATION.--
158	158	A. On and after January 1, 2027, no new covered
159	159	product listed in Subsection A of Section 3 of the Efficiency
160	160	and Mercury Standards for Products and Lighting Fixtures Act
161	161	may be sold or offered for sale, lease or rent in New Mexico
162	162	unless the new covered product meets or exceeds the
163	163	requirements of the standards adopted pursuant to Section 2 of
164	164	that act.
165	165	B. On and after January 1, 2028, no new covered
166	166	product listed in Subsection A of Section 3 of the Efficiency
167	167	and Mercury Standards for Products and Lighting Fixtures Act

196	196	may be installed for compensation in New Mexico unless the new
197	197	covered product meets or exceeds the requirements of the
198	198	standards adopted pursuant to Section 2 of that act.
199	199	SECTION 5. [NEW MATERIAL] NEW AND REVISED STANDARDS.--The
200	200	energy, minerals and natural resources department may adopt
201	201	rules in accordance with the State Rules Act to establish
202	202	increased efficiency standards or updated testing procedures
203	203	for the products listed in Subsection A of Section 3 of the
204	204	Efficiency and Mercury Standards for Products and Lighting
205	205	Fixtures Act. The department may also establish standards for
206	206	products not specifically listed in Subsection A of Section 3
207	207	of that act. In considering such new or amended standards, the
208	208	department shall set efficiency standards upon a determination
209	209	that increased efficiency standards would serve to promote
210	210	energy or water conservation in New Mexico and would be cost
211	211	effective for consumers who purchase and use such new products;
212	212	provided that no new or increased efficiency standards shall
213	213	become effective within one year following the adoption of any
214	214	amended rules establishing such increased efficiency standards.
215	215	SECTION 6. [NEW MATERIAL] TESTING, CERTIFICATION,
216	216	LABELING AND ENFORCEMENT.--As part of rules adopted pursuant to
217	217	Section 2 of the Efficiency and Mercury Standards for Products
218	218	and Lighting Fixtures Act, the energy, minerals and natural
219	219	resources department shall adopt provisions for the testing,
220	220	certification and labeling of products listed in Subsection A

250	250	align with similar requirements in other states.
251	251	SECTION 7. [NEW MATERIAL] POLLUTION STANDARDS--LIGHTING
252	252	FIXTURES.--
253	253	A. By July 1, 2026, the energy, minerals and
254	254	natural resources department shall adopt rules to prohibit the
255	255	sale or offering for sale in New Mexico of general-purpose
256	256	compact fluorescent lamps and general-purpose linear
257	257	fluorescent lamps. Such rules shall be adopted to be in
258	258	alignment with similar prohibitions adopted in other states.
259	259	Any rulemakings conducted pursuant to this section shall be
260	260	held in accordance with the State Rules Act.
261	261	B. On and after January 1, 2027, it shall be a
262	262	violation of the Efficiency and Mercury Standards for Products
263	263	and Lighting Fixtures Act to offer for final sale, sell at
264	264	final sale or distribute in New Mexico as a new manufactured
265	265	product a general-purpose compact fluorescent lamp or
266	266	general-purpose linear fluorescent lamp.
267	267	SECTION 8. [NEW MATERIAL] UTILITY-SPONSORED ENERGY
268	268	EFFICIENCY PROGRAMS.--For a period of up to one year after the
269	269	effective date of any applicable standard, utilities may
270	270	continue to offer rebates and incentives to accelerate a market
271	271	transition away from any covered products prohibited in the
272	272	Efficiency and Mercury Standards for Products and Lighting
273	273	Fixtures Act.

302	302	SECTION 9. [NEW MATERIAL] ENFORCEMENT--PENALTIES.--If the
303	303	energy, minerals and natural resources department finds any
304	304	person has committed a violation of any provision of the
305	305	Efficiency and Mercury Standards for Products and Lighting
306	306	Fixtures Act, the department shall issue a warning to such
307	307	person. Any person who commits the same violation after the
308	308	issuance of such warning may be subject to a civil penalty,
309	309	issued by the department, of up to one hundred dollars ($100)
310	310	for each offense. Any further violations committed by such
311	311	person after this second violation for the same offense may be
312	312	subject to a civil penalty of not more than two hundred fifty
313	313	dollars ($250) for each additional violation. Each covered
314	314	product offered, sold or distributed in violation of the
315	315	Efficiency and Mercury Standards for Products and Lighting
316	316	Fixtures Act may constitute a separate violation, each
317	317	violation may constitute a separate offense and each day that
318	318	such violation occurs may constitute a separate offense.
