4848 AN ACT
4949 MAKING APPROPRIATIONS TO THE OFFICE OF THE STATE ENGINEER FOR
5050 WATER SECURITY PLANNING ACT, WATER DATA ACT AND RIO GRANDE
5151 COMPACT COMPLIANCE MEASURES.
5252 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5353 SECTION 1. APPROPRIATION--WATER PLANNING.--Thirty million
5454 dollars ($30,000,000) is appropriated from the general fund to
5555 the office of the state engineer for expenditure in fiscal
5656 years 2026 through 2028 for the interstate stream commission
5757 pursuant to the Water Security Planning Act to provide grants
5858 to political subdivisions of the state as fiscal agents for
5959 regional water planning entities. Any unexpended or
6060 unencumbered balance remaining at the end of fiscal year 2028
6161 shall revert to the general fund.
6262 SECTION 2. APPROPRIATION--WATER DATA ACT COMPLIANCE.--

9393 the state engineer and the interstate stream commission to
9494 improve business processes and information technology systems
9595 for internal and public access to water data and to fully
9696 comply with the agencies' Water Data Act responsibilities as
9797 directing agencies and the agencies' Water Security Planning
9898 Act responsibilities as water data providers. Any unexpended
9999 or unencumbered balance remaining at the end of fiscal year
100100 2028 shall revert to the general fund.
101101 SECTION 3. APPROPRIATION--WATER RIGHTS.--Two million
102102 dollars ($2,000,000) is appropriated from the general fund to
103103 the office of the state engineer for expenditure in fiscal
104104 years 2026 and 2027 to promulgate rules pursuant to Section
105105 72-2-9.1 NMSA 1978 and take actions required to enforce Rio
106106 Grande water rights along the Rio Grande from the Los Alamos
107107 highway bridge to Elephant Butte reservoir to ensure compliance
108108 with New Mexico's water delivery obligations to Elephant Butte
109109 reservoir pursuant to the Rio Grande Compact. Any unexpended
110110 or unencumbered balance remaining at the end of fiscal year
111111 2027 shall revert to the general fund.
