5757 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5858 SECTION 1. Section 12-8-2 NMSA 1978 (being Laws 1969,
5959 Chapter 252, Section 2) is amended to read:
6060 "12-8-2. DEFINITIONS.--As used in the Administrative

9090 department or officer that is authorized by law to make rules,
9191 conduct adjudicatory proceedings, make determinations, grant
9292 licenses, impose sanctions, grant or withhold relief or perform
9393 other actions or duties delegated by law and [which ] that is
9494 specifically placed by law under the Administrative Procedures
9595 Act;
9696 B. "adjudicatory proceeding" means a proceeding
9797 before an agency, including but not limited to ratemaking and
9898 licensing, in which legal rights, duties or privileges of a
9999 party are required by law to be determined by an agency after
100100 an opportunity for a trial-type hearing; but does not include a
101101 mere rulemaking proceeding as provided in Section [3 of the
102102 Administrative Procedures Act ] 12-8-3 NMSA 1978. It also
103103 includes the formation and issuance of any order, the
104104 imposition or withholding of any sanction and the granting or
105105 withholding of any relief, as well as any of the foregoing
106106 types of determinations or actions wherein no procedure or
107107 hearing provision has been otherwise provided for or required
108108 by law;
109109 C. "license" includes the whole or part of any
110110 agency permit, certificate, approval, registration, charter,
111111 membership, statutory exemption or other form of permission
112112 required by law;
113113 D. "licensing" includes the agency process
114114 respecting the grant, denial, renewal, revocation, suspension,

143143 annulment, withdrawal, amendment, limiting, modifying or
144144 conditioning of a license;
145145 E. "party" means each person or agency named or
146146 admitted as a party or properly seeking and entitled as of
147147 right to be admitted as a party, whether for general or limited
148148 purposes;
149149 F. "person" means any individual, partnership,
150150 corporation, association, governmental subdivision or public or
151151 private organization of any character other than an agency;
152152 G. "rule" includes the whole or any part of every
153153 regulation, standard, statement or other requirement of general
154154 or particular application adopted by an agency to implement,
155155 interpret or prescribe law or policy enforced or administered
156156 by an agency, if the adoption or issuance of such rules is
157157 specifically authorized by the law giving the agency
158158 jurisdiction over such matters. It also includes any statement
159159 of procedure or practice requirements specifically authorized
160160 by the Administrative Procedures Act or other law, but it does
161161 not include:
162162 (1) advisory rulings issued under Section [9
163163 of the Administrative Procedures Act ] 12-8-9 NMSA 1978;
164164 (2) regulations concerning only the internal
165165 management or discipline of the adopting agency or any other
166166 agency and not affecting the rights of, or the procedures
167167 available to, the public or any person except an agency's

196196 members, officers or employees in their capacity as such
197197 member, officer or employee;
198198 (3) regulations concerning only the
199199 management, confinement, discipline or release of inmates of
200200 state [penal, correctional ] public health or mental
201201 institutions;
202202 (4) regulations relating to the use of
203203 highways or streets when the substance of the regulations is
204204 indicated to the public by means of signs or signals; or
205205 (5) decisions issued or actions taken or
206206 denied in adjudicatory proceedings;
207207 H. "rulemaking" means any agency process for the
208208 formation, amendment or repeal of a rule;
209209 I. "order" means the whole or any part of the final
210210 or interim disposition, whether affirmative, negative,
211211 injunctive or declaratory in form, by an agency in any matter
212212 other than rulemaking but including licensing;
213213 J. "sanction" includes the whole or part of any
214214 agency:
215215 (1) prohibition, requirement, limitation or
216216 other condition affecting the freedom of any person or [his ]
217217 the person's property;
218218 (2) withholding of relief;
219219 (3) imposition of any form of penalty;
220220 (4) destruction, taking, seizure or

250250 (5) assessment of damages, reimbursement,
251251 restitution, compensation, taxation, costs, charges or fees;
252252 (6) requirement, revocation, amendment,
253253 limitation or suspension of a license; or
254254 (7) taking or withholding of other compulsory,
255255 restrictive or discretionary action;
256256 K. "relief" includes the whole or part of any
257257 agency:
258258 (1) grant of money, assistance, license,
259259 authority, exemption, exception, privilege or remedy;
260260 (2) recognition of any claim, right, interest,
261261 immunity, privilege, exemption or exception; or
262262 (3) taking of any other action upon the
263263 application or petition of, and beneficial to, any person;
264264 L. "agency proceedings" means any agency process in
265265 connection with rulemaking, orders, adjudication, licensing,
266266 imposition or withholding of sanctions or the granting or
267267 withholding of relief; and
268268 M. "agency action" includes the whole or part of
269269 every agency rule, order, license, sanction or relief, or the
270270 equivalent or denial thereof, or failure to act."
271271 SECTION 2. Section 14-4-2 NMSA 1978 (being Laws 1967,
272272 Chapter 275, Section 2, as amended) is amended to read:

302302 A. "agency" means any agency, board, commission,
303303 department, institution or officer of the state government
304304 except the judicial and legislative branches of the state
305305 government;
306306 B. "person" includes individuals, associations,
307307 partnerships, companies, business trusts, political
308308 subdivisions and corporations;
309309 C. "proceeding" means a formal agency process or
310310 procedure that is commenced or conducted pursuant to the State
311311 Rules Act;
312312 D. "proposed rule" means a rule that is provided to
313313 the public by an agency for review and public comment prior to
314314 its adoption, amendment or repeal and for which there is
315315 specific legal authority authorizing the proposed rule;
316316 E. "provide to the public" means for an agency to
317317 distribute rulemaking information by:
318318 (1) posting it on the agency website, if any;
319319 (2) posting it on the sunshine portal;
320320 (3) making it available in the agency's
321321 district, field and regional offices, if any;
322322 (4) sending it by electronic mail to persons
323323 who have made a written request for notice from the agency of
324324 announcements addressing the subject of the rulemaking
325325 proceeding and who have provided an electronic mail address to
326326 the agency;

355355 (5) sending it by electronic mail to persons
356356 who have participated in the rulemaking and who have provided
357357 an electronic mail address to the agency;
358358 (6) sending written notice that includes, at a
359359 minimum, an internet and street address where the information
360360 may be found to persons who provide a postal address; and
361361 (7) providing it to the New Mexico legislative
362362 council for distribution to appropriate interim and standing
363363 legislative committees;
364364 F. "rule" means any rule, regulation or standard,
365365 including those that explicitly or implicitly implement or
366366 interpret a federal or state legal mandate or other applicable
367367 law and amendments thereto or repeals and renewals thereof,
368368 issued or promulgated by any agency and purporting to affect
369369 one or more agencies besides the agency issuing the rule or to
370370 affect persons not members or employees of the issuing agency,
371371 including affecting persons served by the agency. An order or
372372 decision or other document issued or promulgated in connection
373373 with the disposition of any case or agency decision upon a
374374 particular matter as applied to a specific set of facts shall
375375 not be deemed such a rule, nor shall it constitute specific
376376 adoption thereof by the agency. "Rule" does not include rules
377377 relating to the management, confinement, discipline or release
378378 of [inmates of any penal or ] a person housed at any charitable
379379 institution, the New Mexico boys' school, the girls' welfare

408408 home or any hospital; rules made relating to the management of
409409 any particular educational institution, whether elementary or
410410 otherwise; or rules made relating to admissions, discipline,
411411 supervision, expulsion or graduation of students from any
412412 educational institution; and
413413 G. "rulemaking" means the process for adoption of a
414414 new rule or the amendment, readoption or repeal of an existing
415415 rule."
416416 SECTION 3. Section 33-2-1 NMSA 1978 (being Laws 1955,
417417 Chapter 149, Section 1, as amended) is amended to read:
418418 "33-2-1. ADOPTION OF RULES.--
419419 A. The corrections [division ] department shall
420420 adopt such rules concerning [all prisoners committed to the
421421 penitentiary] New Mexico inmates, probationers and parolees
422422 under the supervision of the corrections department as shall
423423 best accomplish their confinement and rehabilitation.
424424 B. Prior to the adoption, amendment or repeal of
425425 such rules, the corrections department shall:
426426 (1) provide forty-five days for public
427427 comment; and
428428 (2) publish notice of the proposed action in a
429429 newspaper or trade, industrial or professional publications as
430430 will reasonably give the public notice to interested persons,
431431 as well as in all corrections facilities. "
