5353 EXEMPTION TO THE INSPECTION OF PUBLIC RECORDS ACT; REPEALING
5454 SECTION 21-1-16.1 NMSA 1978 (BEING LAWS 2011, CHAPTER 134,

5656 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5757 SECTION 1. A new section of the Inspection of Public
5858 Records Act is enacted to read:
5959 "[NEW MATERIAL] APPOINTIVE EXECUTIVE POSITION--
6060 EXCEPTION--PUBLICATION REQUIRED OF FINALISTS.--
6161 A. A state agency or institution or political
6262 subdivision of the state shall make publicly available on the

9090 agency's, institution's or political subdivision's website the
9191 names and resumes of no fewer than three finalists for an
9292 appointive executive position. The names and resumes shall be
9393 made publicly available no fewer than ten days prior to the
9494 final decision to select one of the finalists for the position.
9595 If fewer than three applicants or candidates for an appointive
9696 executive position possess the minimum qualifications for the
9797 position, those applicants or candidates shall be considered
9898 finalists.
9999 B. A state agency or institution or political
100100 subdivision of the state shall establish and maintain a process
101101 for collecting demographic data from applicants and candidates
102102 for appointive executive positions on a voluntary and anonymous
103103 basis. The data collected shall include the applicant's or
104104 candidate's self-reported sex, gender identity, sexual
105105 orientation, race, ethnicity and primary and other languages
106106 spoken. The individual-level data collected shall be
107107 maintained as confidential and shall not be disclosed to any
108108 person involved in, or who may affect, the selection,
109109 appointment or hiring process. When the finalists for the
110110 appointive executive position are announced, the state agency
111111 or institution or political subdivision of the state shall make
112112 publicly available the demographic data collected; provided
113113 that the data shall be aggregated and shall not contain
114114 personally identifiable information.

143143 C. Records that would reveal the identity of an
144144 applicant or candidate for an appointive executive position,
145145 except for finalists as provided in this section, are exempt
146146 from inspection pursuant to the Inspection of Public Records
147147 Act.
148148 D. Letters of reference or medical or psychological
149149 data concerning finalists shall not be made public or made
150150 available for public inspection or copying.
151151 E. For the purposes of this section:
152152 (1) "appointive executive position" means a
153153 non-elected chief executive officer of a state agency or
154154 institution or political subdivision of the state, but does not
155155 include a political appointment, including a cabinet secretary;
156156 and
157157 (2) "finalist" means an applicant or candidate
158158 for an appointive executive position who is a member of the
159159 final group of applicants or candidates."
160160 SECTION 2. REPEAL.--Section 21-1-16.1 NMSA 1978 (being
161161 Laws 2011, Chapter 134, Section 23) is repealed.
162162 SECTION 3. EFFECTIVE DATE.--The effective date of the
163163 provisions of this act is July 1, 2025.
