49	49	RELATING TO RENEWABLE ENERGY; REQUIRING THE PUBLIC REGULATION
50	50	COMMISSION TO PROMULGATE AND IMPLEMENT RULES GOVERNING THE
51	51	SITING OF RENEWABLE ENERGY GENERATION, STORAGE AND INTRASTATE
52	52	TRANSMISSION FACILITIES.
53	53	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
54	54	SECTION 1. A new section of Chapter 62 NMSA 1978 is
55	55	enacted to read:
56	56	"[NEW MATERIAL] ADDITIONAL PUBLIC REGULATION COMMISSION
57	57	POWERS AND DUTIES.--
58	58	A. The public regulation commission shall
59	59	promulgate and implement rules to govern the permitting and
60	60	siting of renewable energy generation, storage and intrastate
61	61	transmission facilities capable of generating, storing or
62	62	transmitting more than five megawatts.

90	90	B. The rules shall:
91	91	(1) provide for input from political
92	92	subdivisions of the state and the public;
93	93	(2) establish a process for evaluating the
94	94	local impact of renewable energy generation, storage and
95	95	intrastate transmission facilities on the health, safety and
96	96	welfare of the community in which the renewable energy facility
97	97	is to be located; and
98	98	(3) address the scenic, cultural,
99	99	archaeological and environmental impacts of a public regulation
100	100	commission decision to issue or deny a permit."
101	101	SECTION 2. APPLICABILITY.--The provisions of this act
102	102	apply to renewable energy projects that have not received final
103	103	approval on the date the rules promulgated pursuant to Section
104	104	1 of this act take effect.
