4949 RELATING TO RENEWABLE ENERGY; REQUIRING THE PUBLIC REGULATION
5050 COMMISSION TO PROMULGATE AND IMPLEMENT RULES GOVERNING THE
5151 SITING OF RENEWABLE ENERGY GENERATION, STORAGE AND INTRASTATE
5252 TRANSMISSION FACILITIES.
5353 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5454 SECTION 1. A new section of Chapter 62 NMSA 1978 is
5555 enacted to read:
5656 "[NEW MATERIAL] ADDITIONAL PUBLIC REGULATION COMMISSION
5757 POWERS AND DUTIES.--
5858 A. The public regulation commission shall
5959 promulgate and implement rules to govern the permitting and
6060 siting of renewable energy generation, storage and intrastate
6161 transmission facilities capable of generating, storing or
6262 transmitting more than five megawatts.

9090 B. The rules shall:
9191 (1) provide for input from political
9292 subdivisions of the state and the public;
9393 (2) establish a process for evaluating the
9494 local impact of renewable energy generation, storage and
9595 intrastate transmission facilities on the health, safety and
9696 welfare of the community in which the renewable energy facility
9797 is to be located; and
9898 (3) address the scenic, cultural,
9999 archaeological and environmental impacts of a public regulation
100100 commission decision to issue or deny a permit."
101101 SECTION 2. APPLICABILITY.--The provisions of this act
102102 apply to renewable energy projects that have not received final
103103 approval on the date the rules promulgated pursuant to Section
104104 1 of this act take effect.
