4949 RELATING TO STATE GOVERNMENT; CREATING THE OFFICE OF HOUSING
5050 PLANNING AND PRODUCTION; PROVIDING POWERS AND DUTIES; DECLARING
5151 AN EMERGENCY.
5252 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5353 SECTION 1. [NEW MATERIAL] OFFICE OF HOUSING PLANNING AND
5454 PRODUCTION CREATED--ADMINISTRATIVELY ATTACHED--POWERS AND
5555 DUTIES.--
5656 A. As used in this section, "housing" means real
5757 property and infrastructure that is residential housing,
5858 including rental housing, the housing portion of a mixed-use
5959 commercial and housing project and commercial property that is
6060 repurposed for residential housing.
6161 B. The "office of housing planning and production"
6262 is created and is administratively attached to the department

9191 administrative services for the office.
9292 C. The purpose of the office of housing planning
9393 and production is to:
9494 (1) reduce housing costs;
9595 (2) increase statewide housing availability,
9696 including housing for low-income and homeless households;
9797 (3) maximize resources to address statewide
9898 housing needs;
9999 (4) address the underlying factors that are
100100 impacting housing costs and limited supply;
101101 (5) grow local programs and capacity to
102102 address housing needs and further fair housing;
103103 (6) identify state resources for housing; and
104104 (7) track housing progress through goal
105105 setting and data.
106106 D. The director of the office of housing planning
107107 and production shall be appointed by the governor. Subject to
108108 appropriations, the director may employ technical and clerical
109109 assistants as necessary to carry out the powers and duties of
110110 the office.
111111 E. The office of housing planning and production
112112 shall:
113113 (1) develop a statewide strategy to build
114114 collaborative partnerships among state agencies and local

144144 programs and identifying resources;
145145 (2) provide technical assistance to local
146146 governments, Indian nations, tribes and pueblos and regional
147147 entities to improve housing regulation, further fair housing,
148148 increase housing development capacity and housing funding, grow
149149 local and statewide capacity for homelessness services and
150150 prevention and promote public-private housing partnerships;
151151 (3) align resources across state agencies and
152152 the private sector to identify new programs to increase
153153 capacity in housing finance and housing development and to grow
154154 the construction and trades workforces;
155155 (4) address the underlying factors that impact
156156 housing costs and availability, regardless of income, by, at a
157157 minimum:
158158 (a) analyzing regulatory frameworks
159159 surrounding land use and zoning, building codes, permitting and
160160 inspection processes and utility and road connections;
161161 (b) analyzing construction costs
162162 associated with workforce shortages and supply chain
163163 constraints; and
164164 (c) promoting new approaches to housing,
165165 including modular, manufactured and tiny homes and new
166166 construction technologies;
167167 (5) coordinate across state agencies and local

197197 (6) collect and report housing and land use
198198 data and outcomes at least annually to the legislative finance
199199 committee; provided that the data and outcomes shall describe
200200 housing development activities, programs and investments in
201201 regions of the state and statewide to:
202202 (a) evaluate needs and progress toward
203203 housing goals;
204204 (b) identify geographic gaps in housing
205205 availability and services;
206206 (c) assess the relative health of local
207207 and regional housing markets; and
208208 (d) evaluate the impacts of state,
209209 regional and local housing programs;
210210 (7) collect and report data at least annually
211211 to describe and monitor the housing market in regions of the
212212 state and statewide and establish housing production goals
213213 across income levels;
214214 (8) evaluate housing data to identify:
215215 (a) geographic gaps in housing
216216 availability and whether the gaps are the result of increased
217217 or decreased economic activity;
218218 (b) duplications within state agencies
219219 of service and finance efforts; and
220220 (c) adequate progress of local

251251 investments and initiatives, measure impacts of state, regional
252252 and local housing programs, monitor state and local efforts,
253253 support local efforts to meet defined housing goals, make
254254 necessary policy changes and investments to achieve housing
255255 goals and make findings publicly available;
256256 (10) create a framework for local governments
257257 to set goals for meeting housing needs across income levels;
258258 (11) grow local ability to meet housing needs
259259 by:
260260 (a) working with local governments on
261261 land use and zoning, permit, inspection and building codes;
262262 (b) supporting capacity building at the
263263 local and regional level for new housing programs; and
264264 (c) using goal setting frameworks and
265265 land use outcome data to create accountability to solve
266266 problems locally;
267267 (12) identify ways that existing programs and
268268 capacities can address housing needs;
269269 (13) provide support to state agencies
270270 undertaking housing and housing-adjacent activities; and
271271 (14) perform nonduplicative duties assigned by
272272 the governor or the legislature to ensure that the state meets
273273 or exceeds the state's housing goals.
