49	49	RELATING TO SEXUAL OFFENSES; CREATING THE CRIME OF INDECENT
50	50	EXPOSURE TO A CHILD OUT OF PUBLIC VIEW; PROVIDING A PENALTY.
51	51	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
52	52	SECTION 1. A new section of Chapter 30, Article 9 NMSA
53	53	1978 is enacted to read:
54	54	"[NEW MATERIAL] INDECENT EXPOSURE TO A CHILD OUT OF PUBLIC
55	55	VIEW--PENALTY.--
56	56	A. Indecent exposure to a child out of public view
57	57	consists of a person eighteen years of age or older knowingly
58	58	and intentionally exposing the person's primary genital area to
59	59	a child in a lewd and lascivious manner, when the person and
60	60	child are in a nonpublic place.
61	61	B. As used in this section:
62	62	(1) "child" means a person under eighteen

92	92	pubis, penis, testicles, mons veneris, vulva or vagina.
93	93	C. Whoever commits indecent exposure to a child out
94	94	of public view is guilty of a misdemeanor.
95	95	D. This section is retroactive and applies to all
96	96	actions not currently pending based on indecent exposure to a
97	97	child out of public view, regardless of the date of the
98	98	exposure and regardless of whether any statute of limitations
99	99	on such actions expired prior to the effective date of this
100	100	2025 act."
