2949 RELATING TO PROCUREMENT; INCREASING THE LIMIT ON THE TOTAL
3050 AMOUNT ON CONTRACTS FOR PROCUREMENT OF ARCHITECTURAL AND
3151 ENGINEERING SERVICES AND CONSTRUCTION THAT STATE AGENCIES AND
3252 LOCAL PUBLIC BODIES MAY ENTER INTO AND FOR PURCHASE ORDERS
3353 UNDER THE CONTRACTS.
3454 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
35-SECTION 1. Section 13-1-154.1 NMSA 1978 (being Laws
36-2007, Chapter 312, Section 1, as amended) is amended to read:
37-"13-1-154.1. MULTIPLE SOURCE CONTRACTS--ARCHITECTURAL
38-AND ENGINEERING SERVICES CONTRACTS--INDEFINITE QUANTITY
55+SECTION 1. Section 13-1-154.1 NMSA 1978 (being Laws 2007,
56+Chapter 312, Section 1, as amended) is amended to read:
57+"13-1-154.1. MULTIPLE SOURCE CONTRACTS--ARCHITECTURAL AND
58+ENGINEERING SERVICES CONTRACTS--INDEFINITE QUANTITY
3959 CONSTRUCTION CONTRACTS.--
4060 A. A state agency or local public body may procure
4161 multiple architectural or engineering services contracts for
4262 multiple projects under a single qualifications-based request
43-for proposals; provided that the total amount of multiple
44-contracts and all renewals for a single contractor does not
45-exceed seven million five hundred thousand dollars
46-($7,500,000) over four years and that a single contract,
47-including any renewals, does not exceed two million dollars
48-($2,000,000).
49-B. A state agency or local public body may procure
50-multiple indefinite quantity construction contracts pursuant
51-to a price agreement for multiple projects under a single HB 456

85-procurements in accordance with the provisions of Subsection
86-A or B of this section if:

89111 awarded, states the number of contracts that may or will be
90112 awarded and describes the services or construction to be

93-all of the multiple contracts, except that for each contract
94-there may be a separate final list and a separate negotiation
95-of contract terms; and
96-(3) each of the multiple contracts for
97-architectural or engineering services has a term not
98-exceeding four years, or for construction, has a term not
99-exceeding three years, each including all extensions and
100-renewals.
101-D. A contract to be awarded pursuant to this
102-section to a firm that is currently performing under a HB 456

129-contract issued pursuant to this section shall not cause the
130-total amount of all contracts issued pursuant to this section
131-to that firm to exceed:
132-(1) fifteen million dollars ($15,000,000) in
133-any four-year period for architectural or engineering
134-services; or
135-(2) thirty million dollars ($30,000,000) in
136-any ten-year period for construction.
143+all of the multiple contracts, except that for each contract
144+there may be a separate final list and a separate negotiation

137162 E. Procurement pursuant to this section is subject
138163 to the limitations of Sections 13-1-150 through 13-1-154 NMSA
139164 1978.
140165 F. A state agency and a local public body, not
141166 including an agency of the legislative or judicial branch of
142167 state government, shall report to the legislative finance
