9595 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
9696 SECTION 1. A new section of Chapter 24 NMSA 1978 is
9797 enacted to read:
9898 "[NEW MATERIAL] SHORT TITLE.--Sections 1 through 8 of this
9999 act may be cited as the "Hormone Therapy and Puberty Blocker
100100 Child Protection Act"."
101101 SECTION 2. A new section of Chapter 24 NMSA 1978 is
102102 enacted to read:
103103 "[NEW MATERIAL] DEFINITIONS.--As used in the Hormone
104104 Therapy and Puberty Blocker Child Protection Act:
105105 A. "congenital defect" means a physical or chemical
106106 abnormality present in a minor that is inconsistent with the
107107 normal development of a human being of the minor's sex,
108108 including abnormalities caused by a medically verifiable
109109 disorder of sex development, but does not include gender
110110 dysphoria, gender identity disorder, gender incongruence or any
111111 mental condition, disorder, disability or abnormality;
112112 B. "gender-affirming action" means an act by a
113113 minor that is intended to change that minor's sex or change how
114114 others perceive the minor's sex, including the minor:
115115 (1) using pronouns inconsistent with the

145145 (2) changing the minor's name or asking to be
146146 called by a name other than the minor's given name that, based
147147 on generally accepted norms, is inconsistent with that minor's
148148 sex; or
149149 (3) requesting counseling, mental health or
150150 medical services or the use of medical equipment in order to
151151 support the minor's gender identity or desire to live or
152152 present as a different sex;
153153 C. "health care provider" means an individual or
154154 entity licensed in this state to administer or provide health
155155 care services;
156156 D. "hormone" means an androgen or estrogen;
157157 E. "medical procedure" means conduct including:
158158 (1) surgically removing, modifying, altering
159159 or entering into an individual's body tissue, cavities or
160160 organs; or
161161 (2) prescribing, administering or dispensing
162162 any puberty blocker or hormone to an individual;
163163 F. "minor" means an individual who is younger than
164164 eighteen years of age but does not include an emancipated
165165 minor;
166166 G. "parent" means a biological, legal or adoptive
167167 parent of a minor or the minor's legal guardian;
168168 H. "parental notification" means a written document

197197 notifying a parent of a matter concerning that parent's minor
198198 as required pursuant to the Hormone Therapy and Puberty Blocker
199199 Child Protection Act prepared by a health care provider or a
200200 public body and sent:
201201 (1) in a manner that requires a signature
202202 acknowledging receipt of the document; and
203203 (2) to at least one parent of the minor;
204204 I. "precocious puberty" means when a child's sexual
205205 development begins before the typical age;
206206 J. "puberty blocker" means a drug or device that,
207207 when administered to a minor, suppresses the production of
208208 hormones in the minor's body in order to stop, delay or
209209 suppress pubertal development;
210210 K. "public body" means a state or local government,
211211 an advisory board, a commission, an agency or an entity created
212212 by the constitution of New Mexico or a branch of government,
213213 including a health care provider or entity acting on behalf of
214214 or within the scope of the authority of a public body, that
215215 receives public funding and includes political subdivisions,
216216 special tax districts, school districts and institutions of
217217 higher education; and
218218 L. "sex" means an individual's immutable
219219 characteristics of the human reproductive system that define
220220 the individual as male or female, as determined by anatomy and
221221 genetics existing in that individual at the time of birth."

252252 "[NEW MATERIAL] PROHIBITED CONDUCT--MEDICAL PROCEDURES
253253 CONDUCTED ON MINORS.--
254254 A. Except as provided in Subsection B or C of this
255255 section, a health care provider or a public body shall not
256256 knowingly perform or offer to perform on a minor, or administer
257257 or offer to administer to a minor, a medical procedure if the
258258 purpose of the performance or administration of the medical
259259 procedure is to:
260260 (1) enable the minor to identify with, or live
261261 or present as, a purported identity inconsistent with that
262262 minor's sex; or
263263 (2) treat the minor's purported discomfort or
264264 distress from a discordance between the minor's sex and the
265265 minor's asserted or perceived identity.
266266 B. It is not a violation of Subsection A of this
267267 section if the performance or administration of the medical
268268 procedure on the minor is to treat the minor's congenital
269269 defect, precocious puberty, disease or physical injury.
270270 C. It is not a violation of Subsection A of this
271271 section if the performance or administration of the medical
272272 procedure on the minor began prior to the effective date of the
273273 Hormone Therapy and Puberty Blocker Child Protection Act and
274274 the performance or administration of the medical procedure

303303 concludes on or before December 31, 2025; provided, however,
304304 that:
305305 (1) the health care provider or public body
306306 treating the minor shall provide written certification that, in
307307 the health care provider's medical judgment or the medical
308308 judgment of the public body and based upon the facts known to
309309 the health care provider or the public body at the time, ending
310310 the medical procedure would be harmful to the minor. The
311311 certification shall include the findings supporting the
312312 certification and shall be included in the minor's medical
313313 record; and
314314 (2) the health care provider or public body
315315 shall not perform or administer a subsequent medical procedure
316316 that is different from the medical procedure performed prior to
317317 the effective date of the Hormone Therapy and Puberty Blocker
318318 Child Protection Act if the sole purpose of the subsequent
319319 medical procedure is to:
320320 (a) enable the minor to identify with,
321321 or live or present as, a purported identity inconsistent with
322322 the minor's sex; or
323323 (b) treat purported discomfort or
324324 distress from a discordance between the minor's sex and the
325325 minor's asserted or perceived identity.
326326 D. For purposes of this section, "disease" does not
327327 include gender dysphoria, gender identity disorder, gender

357357 abnormality.
358358 E. It is not a defense to legal liability incurred
359359 as a result of a violation of this section that the minor or a
360360 parent of the minor consented to the medical procedure that
361361 constitutes the violation.
362362 F. This section supersedes any common law rule
363363 regarding a minor's ability to consent to a medical procedure
364364 that is performed or administered for the purpose of:
365365 (1) enabling the minor to identify with, or
366366 present or live as, a purported identity inconsistent with the
367367 minor's sex; or
368368 (2) treating purported discomfort or distress
369369 from a discordance between the minor's sex and the minor's
370370 perceived or asserted identity.
371371 G. A minor upon whom a medical procedure pursuant
372372 to Subsection A of this section is performed or administered
373373 shall not be liable for violating the Hormone Therapy and
374374 Puberty Blocker Child Protection Act.
375375 H. Nothing in the Hormone Therapy and Puberty
376376 Blocker Child Protection Act prohibits or restricts the
377377 licensed practice of psychology, psychiatry, counseling or
378378 social work in this state."
379379 SECTION 4. A new section of Chapter 24 NMSA 1978 is

409409 "[NEW MATERIAL] PROHIBITION--DISTRIBUTION OF HORMONES OR
410410 PUBERTY BLOCKERS TO A MINOR.--An individual, a health care
411411 provider or a public body shall not knowingly provide a hormone
412412 or a puberty blocker to a minor if the provision of the hormone
413413 or puberty blocker is not lawfully permitted pursuant to the
414414 Hormone Therapy and Puberty Blocker Child Protection Act."
415415 SECTION 5. A new section of Chapter 24 NMSA 1978 is
416416 enacted to read:
417417 "[NEW MATERIAL] GENDER-AFFIRMING ACTION BY MINOR--HEALTH
418418 CARE PROVIDER OR PUBLIC BODY--PARENTAL NOTIFICATION
419419 REQUIREMENT.--A health care provider or public body shall
420420 provide parental notification to at least one parent of a minor
421421 no later than seven calendar days after the health care
422422 provider or public body observes or has reasonable cause to
423423 believe that the parent's minor has taken a gender-affirming
424424 action while in the presence of the health care provider or
425425 while on the premises of the public body or while interacting
426426 with individuals employed by or representing the health care
427427 provider or public body."
428428 SECTION 6. A new section of Chapter 24 NMSA 1978 is
429429 enacted to read:
430430 "[NEW MATERIAL] PRIVATE RIGHT OF ACTION.--
431431 A. Except as provided in Subsection B of this
432432 section, a minor or the parent of a minor injured as a result
433433 of a violation of the Hormone Therapy and Puberty Blocker Child

462462 Protection Act may bring a civil cause of action for
463463 appropriate relief, including temporary, preliminary or
464464 permanent injunctive relief, compensatory or punitive damages
465465 and reasonable attorney fees, court costs and expenses, against
466466 the health care provider or other person alleged to have
467467 violated that act; provided, however, the parent of a minor
468468 injured as a result of a violation of that act may not bring a
469469 civil cause of action against a health care provider or another
470470 person if the parent consented on behalf of the minor to the
471471 action that constitutes the violation.
472472 B. The parent or next of kin of a deceased minor
473473 may bring a wrongful death action against a health care
474474 provider, an individual or a public body alleged to have
475475 violated the Hormone Therapy and Puberty Blocker Child
476476 Protection Act if:
477477 (1) the minor's death is the result of the
478478 physical or emotional harm inflicted upon the minor as a result
479479 of the violation; and
480480 (2) the parent of the minor did not consent on
481481 behalf of the minor to the conduct that constituted the
482482 violation.
483483 C. In an action brought against a health care
484484 provider pursuant to this section, if the plaintiff prevails,
485485 the plaintiff shall provide a certified copy of the final
486486 judgment in favor of the plaintiff to the licensing authority

515515 responsible for the regulation of the health care provider's
516516 license. Upon receipt of the certified final judgment in favor
517517 of the plaintiff, pursuant to the provisions of the Uniform
518518 Licensing Act, the licensing authority shall:
519519 (1) issue a notice of contemplated action for
520520 revocation of the health care provider's license if the final
521521 judgment includes a finding that the health care provider
522522 knowingly violated the Hormone Therapy and Puberty Blocker
523523 Child Protection Act; or, if the final judgment does not
524524 include a finding that the health care provider knowingly
525525 violated that act, the licensing authority shall issue a notice
526526 of contemplated action for suspension of the health care
527527 provider's license for a period of up to two years; and
528528 (2) send the health care provider a copy of
529529 the notice of contemplated action along with information
530530 regarding the process to file for a hearing before the
531531 licensing authority to contest the contemplated action.
532532 D. For purposes of this section, "compensatory
533533 damages" may include:
534534 (1) reasonable economic losses caused by the
535535 emotional, mental or physical effects of the violation,
536536 including:
537537 (a) the cost of counseling,
538538 hospitalization and any other medical expenses connected with
539539 treating the harm caused by the violation;

569569 paid by the minor to the health care provider or public body
570570 for the prohibited medical procedure; or
571571 (c) any loss of income caused by the
572572 violation; or
573573 (2) noneconomic damages caused by the
574574 violation, including psychological and emotional anguish.
575575 E. An action commenced pursuant to the Hormone
576576 Therapy and Puberty Blocker Child Protection Act shall be
577577 brought:
578578 (1) within thirty days from the date the minor
579579 reaches eighteen years of age; or
580580 (2) if the minor is deceased, within ten years
581581 of the minor's death."
582582 SECTION 7. A new section of Chapter 24 NMSA 1978 is
583583 enacted to read:
584584 "[NEW MATERIAL] ENFORCEMENT--PENALTIES.--
585585 A. The attorney general or a district attorney may
586586 institute a civil action in district court if the attorney
587587 general or district attorney has reasonable cause to believe
588588 that a violation has occurred or to prevent a violation of the
589589 Hormone Therapy and Puberty Blocker Child Protection Act.
590590 B. In any action brought pursuant to this section,
591591 the court may award appropriate relief, including temporary,
592592 preliminary or permanent injunctive relief. The court may

625625 SECTION 8. A new section of Chapter 24 NMSA 1978 is
626626 enacted to read:
627627 "[NEW MATERIAL] SEVERABILITY.--If any part or application
628628 of the Hormone Therapy and Puberty Blocker Child Protection Act
629629 is held invalid, the remainder of its application to other
630630 situations or persons shall not be affected."
631631 SECTION 9. Section 24-34-2 NMSA 1978 (being Laws 2023,
632632 Chapter 11, Section 2) is amended to read:
633633 "24-34-2. DEFINITIONS.--As used in the Reproductive and
634634 Gender-Affirming Health Care Freedom Act:
635635 A. "adult" means an individual who is eighteen
636636 years of age or older;
637637 B. "emancipated minor" means an individual who is
638638 sixteen years of age or older who:
639639 (1) has entered into a valid marriage;
640640 (2) is on active duty with any of the armed
641641 services in the United States; or
642642 (3) has received a declaration of emancipation
643643 pursuant to the Emancipation of Minors Act;
644644 [A.] C. "gender-affirming health care" means
645645 psychological, behavioral, surgical, pharmaceutical and medical

676676 D. "health care provider" means an individual or
677677 entity licensed in this state to administer or provide health

679679 E. "minor" means an individual who is younger than
680680 eighteen years of age;
681681 F. "parent" means a biological, legal or adoptive
682682 father or mother or legal guardian of another person;
683683 G. "parental consent" means a notarized written
684684 document that is signed by at least one parent of a minor and
685685 provides permission for a public body to:
686686 (1) engage or meet with, contact or speak to
687687 or provide information to the minor regarding reproductive
688688 health care; or
689689 (2) provide the minor with access to
690690 reproductive health care;
691691 H. "parental notification" means a written document
692692 notifying a parent of a matter concerning that parent's minor
693693 as required pursuant to the Reproductive and Gender-Affirming
694694 Health Care Freedom Act that is prepared by a health care
695695 provider or a public body and is sent:
696696 (1) in a manner that requires a signature
697697 acknowledging receipt of the document; and
698698 (2) to at least one parent of the minor;

741741 (1) preventing a pregnancy;
742742 (2) abortion;
743743 (3) managing a pregnancy loss;
744744 (4) prenatal, birth, perinatal and postpartum
745745 health;
746746 (5) managing perimenopause and menopause;
747747 (6) managing fertility;
748748 (7) treating cancers of the reproductive
749749 system; or
750750 (8) preventing or treating sexually
751751 transmitted infections."

783783 NOTIFICATION AND CONSENT .--
784784 A. A public body [or an entity or individual acting
785785 on behalf of or within the scope of the authority of a public
786786 body] shall not discriminate against a [person ] health care
787787 provider, an adult or an emancipated minor based on that
788788 [person's] health care provider's, adult's or emancipated
789789 minor's use of or refusal to use reproductive health care or
790790 gender-affirming health care services.
791791 B. A public body [or an entity or individual acting
792792 on behalf of or within the scope of the authority of a public
793793 body] shall not deny, restrict or interfere with a [person's ]
794794 health care provider's, an adult's or an emancipated minor's
795795 ability to access or provide reproductive health care or
796796 gender-affirming health care within the medical standard of
797797 care.
798798 C. A public body [or an entity or individual acting
799799 on behalf of or within the scope of the authority of a public
800800 body] shall not deprive, through prosecution, punishment or
801801 other means, [a person's ] an adult's or an emancipated minor's
802802 ability to act or refrain from acting during the [person's ]
803803 adult's or emancipated minor's pregnancy based on the

15811581 copy of the final judgment in favor of the plaintiff to the
15821582 licensing authority responsible for the regulation of the
15831583 health care provider's license. Upon receipt of the certified
15841584 final judgment in favor of the plaintiff, pursuant to the
15851585 requirements of the Uniform Licensing Act, the licensing
15861586 authority shall:
15871587 (1) issue a notice of contemplated action for
15881588 revocation of the health care provider's license if the final
15891589 judgment includes a finding of gross negligence, knowingly
15901590 violating or willful or egregious misconduct, or if the final
15911591 judgment does not include a finding of gross negligence,
15921592 knowingly violating or willful or egregious misconduct, issue a
15931593 notice of contemplated action for suspension of the health care
15941594 provider's license for a period of up to two years; and
15951595 (2) send the health care provider a copy of
15961596 the notice of contemplated action along with the information
15971597 regarding the process to file for a hearing before the
15981598 licensing authority to contest the contemplated action.
