5454 RESOURCES DEPARTMENT FOR PLUGGING AND ABANDONMENT COSTS AND
5555 OTHER ASSOCIATED COSTS.
5656 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5757 SECTION 1. A new section of the Oil and Gas Act is
5858 enacted to read:
5959 "[NEW MATERIAL] PLUGGING AND ABANDONMENT OF WELLS--
6060 RESPONSIBILITY.--
6161 A. An owner, operator or lessee with a current
6262 interest or control and an owner, operator or lessee with a

9090 prior interest or control that occurs contemporaneously with
9191 oil or gas exploration, development or production of a well,
9292 facility, pit or installation of immobile surface equipment
9393 shall be responsible for reimbursing the division for all
9494 associated costs incurred by the division for the:
9595 (1) plugging and abandonment of oil and gas
9696 production or salt water disposal wells;
9797 (2) deconstruction, removal and disposal of
9898 associated production, operation, surface and facility
9999 equipment, including flow lines;
100100 (3) remediation of any environmental
101101 contamination reasonably associated with the oil and gas
102102 exploration, development or production; and
103103 (4) restoration and revegetation of impacted
104104 areas.
105105 B. Owners, operators and lessees with an interest
106106 or control in an oil or gas well, facility, pit or installation
107107 may contractually allocate responsibility between otherwise
108108 responsible parties pursuant to a contract, lease or instrument
109109 of transfer; provided that any such agreement shall not bind
110110 the division or require the division to seek recovery from any
111111 particular responsible party or from a responsible party in any
112112 particular order."
113113 SECTION 2. APPLICABILITY.--The provisions of this act
114114 apply to owners, operators and lessees with an interest or
