5050 CAPTIONING ACT; REQUIRING PLACES OF PUBLIC ACCOMMODATION THAT
5151 DISPLAY TELEVISION PROGRAMMING TO PROVIDE CLOSED CAPTIONING;
5252 REQUIRING THE ATTORNEY GENERAL TO ENFORCE THE CLOSED CAPTIONING
5353 ACT; PROVIDING PENALTIES.
5454 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5555 SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be
5656 cited as the "Closed Captioning Act ".
5757 SECTION 2. [NEW MATERIAL] DEFINITIONS.--As used in the
5858 Closed Captioning Act:
5959 A. "closed captioning" means a transcript or
6060 written dialogue of the audio portion of a television program
6161 that is displayed on the screen of a television receiver;
6262 B. "place of public accommodation" means a place

9090 that is open to the public where commerce is carried out and
9191 includes:
9292 (1) an inn, a hotel, a motel or other place of
9393 lodging, except for an establishment located within a building
9494 that contains fewer than five rooms for rent and that is
9595 actually occupied by the proprietor of such establishment as
9696 the proprietor's residence;
9797 (2) a restaurant, a bar or other establishment
9898 serving food or drink;
9999 (3) a motion picture house, a theater, a
100100 concert hall, a stadium or other place of exhibition or
101101 entertainment;
102102 (4) an auditorium, a convention center, a
103103 lecture hall or other place of public gathering;
104104 (5) a bakery, a grocery store, a clothing
105105 store, a hardware store, a shopping center or other sales or
106106 rental establishment;
107107 (6) a department store, a laundromat, a dry
108108 cleaner, a bank, a barber shop, a beauty shop, a travel
109109 service, a shoe repair service, a funeral parlor, a gas
110110 station, an office of an accountant or lawyer, a pharmacy, an
111111 insurance office, a professional office of a health care
112112 provider, a hospital or any other retail or service
113113 establishment;
114114 (7) a terminal, a depot or other station used

144144 (8) a museum, a library, a gallery or other
145145 place of public display or collection;
146146 (9) a park, a zoo, an amusement park or other
147147 place of recreation;
148148 (10) a nursery, elementary, secondary,
149149 undergraduate, postgraduate or private school;
150150 (11) a senior citizen center, a homeless
151151 shelter, a food bank, an adoption agency or other social
152152 service center establishment; and
153153 (12) a gymnasium, a health spa, a bowling
154154 alley, a golf course or other place of exercise or recreation;
155155 C. "public area" means any part of a place of
156156 public accommodation that is open to the general public;
157157 D. "regular hours" means the hours of the day in
158158 which a place of public accommodation is generally open to
159159 members of the general public;
160160 E. "television program" means any recorded media
161161 that has audio and visual components and is displayed on a
162162 television receiver; and
163163 F. "television receiver" means a device that is
164164 capable of displaying a television program. "Television
165165 receiver" includes:
166166 (1) a television;

196196 (3) a digital set top box;
197197 (4) a monitor; and
198198 (5) other technology capable of displaying
199199 closed captioning for a television program.
200200 SECTION 3. [NEW MATERIAL] CLOSED CAPTIONING IN PLACES OF
201201 PUBLIC ACCOMMODATION.--A person that owns or manages a place of
202202 public accommodation shall activate closed captioning on all
203203 television receivers that are turned on and operating in public
204204 areas during regular hours, except when:
205205 A. the television program or television receiver
206206 available in the public area is not technologically able to
207207 display closed captioning;
208208 B. the television program being displayed is exempt
209209 from closed captioning requirements under federal law; and
210210 C. multiple television receivers are displaying the
211211 same television program, in which case only one television
212212 receiver is required to display closed captioning.
213213 SECTION 4. [NEW MATERIAL] ENFORCEMENT.--
214214 A. The attorney general shall enforce the
215215 provisions of the Closed Captioning Act and shall adopt rules
216216 in accordance with the Closed Captioning Act to provide for the
217217 protection of people with hearing disabilities.
218218 B. The attorney general shall establish a complaint
219219 process whereby an aggrieved member of the public may file a
220220 complaint against a place of public accommodation that violates

249249 the provisions of the Closed Captioning Act. All complaints
250250 shall be considered public records pursuant to the Inspection
251251 of Public Records Act, with the exception of the complainant's
252252 name, address or protected personal identifier information as
253253 defined in the Inspection of Public Records Act.
254254 C. If the attorney general finds that a place of
255255 public accommodation has violated the provisions of the Closed
256256 Captioning Act, the attorney general shall notify the place of
257257 public accommodation that it is in violation of that act. If
258258 the place of public accommodation fails to demonstrate
259259 compliance with the provisions of the Closed Captioning Act
260260 within thirty days of receiving notice of the violation, it
261261 shall be assessed a civil penalty not to exceed two hundred
262262 fifty dollars ($250). For subsequent violations of the Closed
263263 Captioning Act, the place of public accommodation shall be
264264 assessed a civil penalty not to exceed five hundred dollars
265265 ($500).
