49	49	RELATING TO PUBLIC SCHOOL PERSONNEL; ENACTING A NEW SECTION OF
50	50	THE SCHOOL PERSONNEL ACT TO REQUIRE SCHOOL EMPLOYEES TO REPORT
51	51	TO A SCHOOL ADMINISTRATOR IF A STUDENT IS EXPERIENCING GENDER
52	52	INCONGRUENCE AT SCHOOL AND REQUIRING NOTIFICATION TO THE
53	53	STUDENT'S PARENT; DEFINING TERMS; ALLOWING A PARENT TO GIVE
54	54	DIRECTION AND PERMISSION FOR THE DEVELOPMENT AND IMPLEMENTATION
55	55	OF A RESPONSE PLAN.
56	56	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
57	57	SECTION 1. A new section of the School Personnel Act is
58	58	enacted to read:
59	59	"[NEW MATERIAL] STUDENTS EXPERIENCING GENDER
60	60	INCONGRUENCE--PARENTAL NOTIFICATION--RESPONSE PLANS.--
61	61	A. As used in this section, "gender incongruence"
62	62	means a difference between a person's biological sex and the

91	91	B. A school employee shall immediately report to a
92	92	school administrator if a student:
93	93	(1) expresses to the school employee that the
94	94	student is experiencing gender incongruence; or
95	95	(2) requests that the school employee
96	96	participate in:
97	97	(a) social affirmation of the student's
98	98	gender incongruence; or
99	99	(b) the student's transition to a sex or
100	100	gender different from the student's biological sex while at
101	101	school.
102	102	C. If a school administrator receives a report
103	103	pursuant to Subsection B of this section or otherwise possesses
104	104	information regarding a student's gender incongruence, the
105	105	school administrator or the administrator's designee shall
106	106	notify the student's parent.
107	107	D. When a school administrator or the
108	108	administrator's designee notifies a parent about a student's
109	109	gender incongruence, the administrator shall request the
110	110	parent's direction and permission to develop and implement a
111	111	response plan to address the student's gender incongruence,
112	112	which shall be in writing and signed by the parent. A response
113	113	plan shall include a provision for parental participation to
114	114	the extent participation is requested by the parent. A
