5656 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5757 SECTION 1. A new section of Chapter 17, Article 3 NMSA
5858 1978 is enacted to read:
5959 "[NEW MATERIAL] DONOR REGISTRY.--
6060 A. In addition to other requirements established

6262 department of game and fish pursuant to Section 17-3-5 NMSA

9393 B. The applicant may indicate the applicant's donor
9494 status on the space provided on the application if the
9595 applicant has not already marked the applicant's donor status
9696 on an application form for a driver's license pursuant to
9797 Section 66-5-10 NMSA 1978. If the applicant desires to be a
9898 new donor, the form shall be signed by the donor in the
9999 presence of a witness who shall also sign the form in the

101101 C. The director of the department of game and fish
102102 shall, by January 1, 2026, include the following donor
103103 statement on each license application form:

143143 D. A license vendor that issues a hunting or
144144 fishing license pursuant to Chapter 17, Article 3 NMSA 1978
145145 shall submit a copy of each application form or its image of a
146146 person who wishes to be a donor to the division.
147147 E. The division shall maintain each application the
148148 division receives from a license vendor pursuant to this
149149 section in the statewide donor registry that the division
150150 maintains pursuant to Section 66-5-10 NMSA 1978. Authorized
151151 hospital or organ and tissue donor program personnel,
152152 immediately prior to or after a donor's death, may request
153153 verification of the donor's status from the division and may
154154 obtain a copy of the application from the division.
155155 F. For the purposes of this section, "division"
156156 means the motor vehicle division of the taxation and revenue
157157 department."
158158 SECTION 2. A new section of the Public Assistance Act is
159159 enacted to read:
160160 "[NEW MATERIAL] DONOR REGISTRY.--
161161 A. In addition to other requirements established

163163 1978 the authority shall include on any application form or
164164 renewal application form for assistance or services under the
165165 Public Assistance Act a space to show whether the applicant is

356356 SECTION 4. A new section of the School Personnel Act
357357 is enacted to read:
358358 "[NEW MATERIAL] LICENSE APPLICATION AND RENEWAL FORMS--
359359 SPACE FOR ANATOMICAL GIFT DONATION.--A license application form
360360 or license renewal application form issued by the department
361361 shall include a space, as required by the Uniform Licensing
362362 Act, to show whether the applicant is a donor as provided in
363363 the Jonathan Spradling Revised Uniform Anatomical Gift Act.
364364 The department shall submit a copy of each form for which that
365365 space is completed to the motor vehicle division of the
366366 taxation and revenue department for inclusion as part of its
367367 statewide donor registry pursuant to Section 66-5-10 NMSA
368368 1978."
369369 SECTION 5. Section 29-19-5 NMSA 1978 (being Laws 2003,
370370 Chapter 255, Section 5, as amended) is amended to read:
371371 "29-19-5. APPLICATION FORM--SCREENING OF APPLICANTS--
372372 FEE--LIMITATIONS ON LIABILITY.--
373373 A. [Effective July 1, 2003 ] Applications for
374374 concealed handgun licenses shall be made readily available at
375375 locations designated by the department. Applications for
376376 concealed handgun licenses shall be completed, under penalty of
377377 perjury, on a form designed and provided by the department and
378378 shall include:
379379 (1) the applicant's name, current address,

409409 weight, gender, hair color, eye color and driver's license
410410 number or other state-issued identification number;
411411 (2) a statement that the applicant is aware
412412 of, understands and is in compliance with the requirements for
413413 licensure set forth in the Concealed Handgun Carry Act;
414414 (3) a statement that the applicant has been
415415 furnished a copy of the Concealed Handgun Carry Act and is
416416 knowledgeable of its provisions; [and ]
417417 (4) a conspicuous warning that the application
418418 form is executed under penalty of perjury and that a materially
419419 false answer or the submission of a materially false document
420420 to the department may result in denial or revocation of a
421421 concealed handgun license and may subject the applicant to
422422 criminal prosecution for perjury as provided in Section 30-25-1
423423 NMSA 1978; and
424424 (5) a space, as required by Section 3 of this
425425 2025 act, to show whether the applicant is a donor as provided
426426 in the Jonathan Spradling Revised Uniform Anatomical Gift Act .
427427 B. The applicant shall submit to the department:
428428 (1) a completed application form;
429429 (2) a nonrefundable application fee in an
430430 amount not to exceed one hundred dollars ($100);
431431 (3) two full sets of fingerprints;
432432 (4) a certified copy of a certificate of

461461 completion for a firearms training course approved by the
462462 department;
463463 (5) two color photographs of the applicant;
464464 (6) a certified copy of a birth certificate or
465465 proof of United States citizenship, if the applicant was not
466466 born in the United States; and
467467 (7) proof of residency in New Mexico.
468468 C. A law enforcement agency may fingerprint an
469469 applicant and may charge a reasonable fee.
470470 D. Upon receipt of the items listed in Subsection B
471471 of this section, the department shall make a reasonable effort
472472 to determine if an applicant is qualified to receive a
473473 concealed handgun license. The department shall conduct an
474474 appropriate check of available records and shall forward the
475475 applicant's fingerprints to the federal bureau of investigation
476476 for a national criminal background check. The department shall
477477 comply with the license-issuing requirements set forth in
478478 Section 29-19-7 NMSA 1978. However, the department shall
479479 suspend or revoke a license if the department receives
480480 information that would disqualify an applicant from receiving a
481481 concealed handgun license after the thirty-day time period has
482482 elapsed.
483483 E. A state or local government agency shall comply
484484 with a request from the department pursuant to the Concealed
485485 Handgun Carry Act within thirty days of the request."

634634 board shall submit a copy of each form for which that space is
635635 completed to the motor vehicle division of the taxation and

685685 Jonathan Spradling Revised Uniform Anatomical Gift Act. The
686686 board shall submit a copy of each form for which that space is
687687 completed to the motor vehicle division of the taxation and
688688 revenue department for inclusion as part of its statewide donor
