53	53	FREE CONDOMS TO PUBLIC SECONDARY SCHOOL STUDENTS.
54	54	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
55	55	SECTION 1. A new section of Chapter 21 NMSA 1978 is
56	56	enacted to read:
57	57	"[NEW MATERIAL] FREE CONDOMS AVAILABLE FOR STUDENTS IN
58	58	PUBLIC POST-SECONDARY EDUCATIONAL INSTITUTIONS.--Public post-
59	59	secondary educational institutions shall make condoms available
60	60	to all students, free of charge. Institution administrators,
61	61	in consultation with student health centers and other entities
62	62	that provide services to students, shall determine the best

91	91	minimum, condoms shall be placed in locations that are safe and
92	92	readily accessible to students, including student health
93	93	centers and restrooms."
94	94	SECTION 2. A new section of the Public School Code is
95	95	enacted to read:
96	96	"[NEW MATERIAL] FREE CONDOMS AVAILABLE FOR STUDENTS IN
97	97	PUBLIC SECONDARY SCHOOLS.--Local school boards and governing
98	98	bodies of charter schools shall adopt policies to make condoms
99	99	available for high school students, free of charge. Public
100	100	school administrators, in consultation with school nurses,
101	101	shall determine the best manner in which to make condoms
102	102	available to students. At a minimum, condoms shall be placed
103	103	in locations that are safe and readily accessible to students,
104	104	including the school nurse's office and restrooms."
