49	49	RELATING TO ADVANCE PURCHASE COMMITMENTS; CREATING A PROGRAM
50	50	FOR THE AWARDING OF ADVANCE PURCHASE COMMITMENTS FOR THE
51	51	PURCHASE, THREE OR MORE YEARS IN THE FUTURE, OF LOW-EMISSIONS
52	52	CEMENT, CONCRETE, ASPHALT BINDER OR ASPHALT MIXTURES.
53	53	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
54	54	SECTION 1. [NEW MATERIAL] ADVANCE PURCHASE COMMITMENT--
55	55	AUTHORITY--REQUIREMENTS--PRIORITIES--ASSIGNMENT.--
56	56	A. By January 1, 2026, the department shall
57	57	establish a program within the department for the awarding of
58	58	advance purchase commitments with the objective of encouraging
59	59	innovation and emissions reductions and establishing market
60	60	demand for low-emissions cement, concrete, asphalt binder or
61	61	asphalt mixtures. An advance purchase commitment may be
62	62	awarded under the program only if:

90	90	(1) a private entity submits to the department
91	91	a statement describing the quantity and cost of the low-
92	92	emissions cement, concrete, asphalt binder or asphalt mixture
93	93	for which the advance purchase commitment is sought and:
94	94	(a) an environmental product
95	95	declaration;
96	96	(b) if a private entity does not have
97	97	sufficient production to generate an environmental product
98	98	declaration, a life cycle assessment of the entity's applicable
99	99	product that is consistent with the standards of the
100	100	international organization for standardization or, if that
101	101	organization no longer exists, a national or international
102	102	standard development organization selected by the department;
103	103	or
104	104	(c) a preliminary environmental product
105	105	declaration that the department shall verify within one year of
106	106	fulfillment of delivery of materials pursuant to the advance
107	107	purchase commitment; and
108	108	(2) for each submission, the department
109	109	confirms that:
110	110	(a) the embodied greenhouse gas
111	111	emissions of the applicable low-emissions cement, concrete,
112	112	asphalt binder or asphalt mixture meets or exceeds the
113	113	threshold established by the United States secretary of energy
114	114	under Section 458(i)(2) of the federal Energy Independence and

144	144	(b) the applicable low-emissions cement,
145	145	concrete, asphalt binder or asphalt mixture meets all technical
146	146	specifications and requirements established by the department.
147	147	B. In awarding advance purchase commitments
148	148	pursuant to this section, the department shall prioritize
149	149	awards based on the following factors:
150	150	(1) the degree of greenhouse gas emissions
151	151	reduced during or in connection with the production of the
152	152	applicable low-emissions cement, concrete, asphalt binder or
153	153	asphalt mixture;
154	154	(2) the anticipated suitability of the low-
155	155	emissions cement, concrete, asphalt binder or asphalt mixture
156	156	for its intended use;
157	157	(3) the potential of the advance purchase
158	158	commitment to increase the availability of, or financing for,
159	159	low-emissions cement, concrete, asphalt binder or asphalt
160	160	mixtures in New Mexico; and
161	161	(4) the utilization or mineralization of
162	162	carbon dioxide in the low-emissions cement, concrete, asphalt
163	163	binder or asphalt mixture, but only if it does not lead to
164	164	positive net carbon dioxide emissions.
165	165	C. A contract entered into or material purchased
166	166	pursuant to this section may be assigned to a local
167	167	transportation authority at the discretion of the secretary of

197	197	D. As used in this section:
198	198	(1) "advance purchase commitment" means a
199	199	binding commitment from the department to purchase, three or
200	200	more years in the future, from a private entity, a specified
201	201	minimum quantity of conforming low-emissions cement, concrete,
202	202	asphalt binder or asphalt mixtures at a specified minimum
203	203	price; and
204	204	(2) "department" means the department of
205	205	transportation.
206	206	SECTION 2. EFFECTIVE DATE.--The effective date of the
207	207	provisions of this act is July 1, 2025.
