4949 RELATING TO ADVANCE PURCHASE COMMITMENTS; CREATING A PROGRAM
5050 FOR THE AWARDING OF ADVANCE PURCHASE COMMITMENTS FOR THE
5151 PURCHASE, THREE OR MORE YEARS IN THE FUTURE, OF LOW-EMISSIONS
5252 CEMENT, CONCRETE, ASPHALT BINDER OR ASPHALT MIXTURES.
5353 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5454 SECTION 1. [NEW MATERIAL] ADVANCE PURCHASE COMMITMENT--
5555 AUTHORITY--REQUIREMENTS--PRIORITIES--ASSIGNMENT.--
5656 A. By January 1, 2026, the department shall
5757 establish a program within the department for the awarding of
5858 advance purchase commitments with the objective of encouraging
5959 innovation and emissions reductions and establishing market
6060 demand for low-emissions cement, concrete, asphalt binder or
6161 asphalt mixtures. An advance purchase commitment may be
6262 awarded under the program only if:

9090 (1) a private entity submits to the department
9191 a statement describing the quantity and cost of the low-
9292 emissions cement, concrete, asphalt binder or asphalt mixture
9393 for which the advance purchase commitment is sought and:
9494 (a) an environmental product
9595 declaration;
9696 (b) if a private entity does not have
9797 sufficient production to generate an environmental product
9898 declaration, a life cycle assessment of the entity's applicable
9999 product that is consistent with the standards of the
100100 international organization for standardization or, if that
101101 organization no longer exists, a national or international
102102 standard development organization selected by the department;
103103 or
104104 (c) a preliminary environmental product
105105 declaration that the department shall verify within one year of
106106 fulfillment of delivery of materials pursuant to the advance
107107 purchase commitment; and
108108 (2) for each submission, the department
109109 confirms that:
110110 (a) the embodied greenhouse gas
111111 emissions of the applicable low-emissions cement, concrete,
112112 asphalt binder or asphalt mixture meets or exceeds the
113113 threshold established by the United States secretary of energy
114114 under Section 458(i)(2) of the federal Energy Independence and

144144 (b) the applicable low-emissions cement,
145145 concrete, asphalt binder or asphalt mixture meets all technical
146146 specifications and requirements established by the department.
147147 B. In awarding advance purchase commitments
148148 pursuant to this section, the department shall prioritize
149149 awards based on the following factors:
150150 (1) the degree of greenhouse gas emissions
151151 reduced during or in connection with the production of the
152152 applicable low-emissions cement, concrete, asphalt binder or
153153 asphalt mixture;
154154 (2) the anticipated suitability of the low-
155155 emissions cement, concrete, asphalt binder or asphalt mixture
156156 for its intended use;
157157 (3) the potential of the advance purchase
158158 commitment to increase the availability of, or financing for,
159159 low-emissions cement, concrete, asphalt binder or asphalt
160160 mixtures in New Mexico; and
161161 (4) the utilization or mineralization of
162162 carbon dioxide in the low-emissions cement, concrete, asphalt
163163 binder or asphalt mixture, but only if it does not lead to
164164 positive net carbon dioxide emissions.
165165 C. A contract entered into or material purchased
166166 pursuant to this section may be assigned to a local
167167 transportation authority at the discretion of the secretary of

197197 D. As used in this section:
198198 (1) "advance purchase commitment" means a
199199 binding commitment from the department to purchase, three or
200200 more years in the future, from a private entity, a specified
201201 minimum quantity of conforming low-emissions cement, concrete,
202202 asphalt binder or asphalt mixtures at a specified minimum
203203 price; and
204204 (2) "department" means the department of
205205 transportation.
206206 SECTION 2. EFFECTIVE DATE.--The effective date of the
207207 provisions of this act is July 1, 2025.
