4949 RELATING TO CORRECTIONS; AMENDING THE RESTRICTED HOUSING ACT;
5050 EXPANDING THE AGE LIMIT ON SOLITARY CONFINEMENT; REDUCING THE
5151 NUMBER OF HOURS AND DAYS AN INMATE MAY BE HELD IN SOLITARY
5252 CONFINEMENT.
5353 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5454 SECTION 1. Section 33-16-1 NMSA 1978 (being Laws 2019,
5555 Chapter 194, Section 1) is amended to read:
5656 "33-16-1. SHORT TITLE.--[This act ] Chapter 33, Article 16
5757 NMSA 1978 may be cited as the "Restricted Housing Act"."
5858 SECTION 2. Section 33-16-2 NMSA 1978 (being Laws 2019,
5959 Chapter 194, Section 2) is amended to read:
6060 "33-16-2. DEFINITIONS.--As used in the Restricted Housing
6161 Act:
6262 A. "correctional facility" means a jail, prison or

9191 adult or juvenile persons, whether operated by the state or a
9292 political subdivision of the state or a private contractor on
9393 behalf of the state or a political subdivision of the state;
9494 B. "inmate" means an adult or juvenile person who
9595 is under sentence to or confined in a correctional facility;
9696 C. "meaningful human contact" means in-person or
9797 virtual interactions with family, peers, counselors, educators
9898 or other persons for purposes other than institutional
9999 discipline;
100100 [C.] D. "restricted housing", whether instituted
101101 pursuant to disciplinary, administrative, inmate classification
102102 or other action, means confinement of an inmate locked in a
103103 cell or similar living quarters in a correctional facility for
104104 [twenty-two] seventeen or more hours each day without any
105105 rehabilitative programming that includes daily, meaningful [and
106106 sustained] human [interaction] contact; and
107107 [D.] E. "serious mental disability" means:
108108 (1) a serious mental illness, including
109109 schizophrenia, psychosis, major depression and bipolar
110110 disorder; or
111111 (2) having a significant functional impairment
112112 along with a brain injury, organic brain syndrome or
113113 intellectual disability."

143143 Chapter 194, Section 3) is amended to read:
144144 "33-16-3. RESTRICTIONS ON THE USE OF RESTRICTED
145145 HOUSING.--
146146 A. An inmate who is younger than [eighteen ] twenty-
147147 one or older than fifty-five years of age shall not be placed
148148 in restricted housing.
149149 B. An inmate who is known to be pregnant or in the
150150 first eight weeks of the postpartum recovery period after
151151 giving birth shall not be placed in restricted housing.
152152 C. An inmate who belongs to a vulnerable
153153 population, including an inmate who identifies as lesbian, gay,
154154 bisexual, transgender or queer, shall not be placed in
155155 restricted housing involuntarily or for protective custody.
156156 D. An inmate in a facility operated by the
157157 corrections department or by a contractor with the department
158158 shall not be housed in restricted housing for more than fifteen
159159 consecutive days or more than ninety days total in a twelve-
160160 month period.
161161 E. If a warden, jail administrator or other person
162162 in charge of a correctional facility finds that an inmate
163163 requires housing in restricted housing for more than ninety
164164 days total in a twelve-month period, the person shall:
165165 (1) make a written record of the facts and
166166 circumstances that necessitated the inmate's placement in
167167 restricted housing; and

196196 (2) prepare a written action plan describing
197197 how the facility will transition the inmate out of restricted
198198 housing at the earliest opportunity.
199199 F. An inmate in a jail of a political subdivision
200200 of the state shall not be held in restricted housing during the
201201 first three days of incarceration in that jail, except when the
202202 findings of a suicide screening instrument conclude that the
203203 inmate is not likely to engage in harm to self.
204204 G. Correctional facilities shall not implement or
205205 enforce any policy or practice that is functionally equivalent
206206 to restricted housing, solitary confinement or other term,
207207 regardless of the name or designation of such policy or
208208 practice of such action or housing unit. "
209209 SECTION 4. Section 33-16-5 NMSA 1978 (being Laws 2019,
210210 Chapter 194, Section 5) is amended to read:
211211 "33-16-5. CORRECTIONAL FACILITIES--TRANSPARENCY AND
212212 REPORTING.--
213213 A. Every three months, every correctional facility
214214 shall:
215215 (1) produce a report that includes:
216216 (a) the name, inmate identification ,
217217 age, gender and ethnicity of every inmate who was placed in
218218 restricted housing during the previous three months, including
219219 every inmate who is in restricted housing at the time the
220220 report is produced; and

254254 (2) submit a report prepared in accordance
255255 with this subsection to the:
256256 (a) legislature, if the correctional
257257 facility is a prison; and
258258 (b) board of county commissioners of the
259259 county in which the correctional facility is located, if the
260260 facility is a jail.
261261 B. The corrections department shall post to its
262262 public website every report produced pursuant to Subsection A
263263 of this section."
