49	49	RELATING TO HEALTH CARE; CLARIFYING CONSENT REQUIREMENTS FOR
50	50	MINORS RECEIVING HEALTH CARE.
51	51	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
52	52	SECTION 1. Section 24-34-2 NMSA 1978 (being Laws 2023,
53	53	Chapter 11, Section 2) is amended to read:
54	54	"24-34-2. DEFINITIONS.--As used in the Reproductive and
55	55	Gender-Affirming Health Care Freedom Act:
56	56	A. "gender-affirming health care" means
57	57	psychological, behavioral, surgical, pharmaceutical and medical
58	58	care, services and supplies provided to support a person's
59	59	gender identity;
60	60	B. "minor" means an individual who is under
61	61	eighteen years of age;
62	62	[B.] C. "public body" means a state or local

90	90	government, an advisory board, a commission, an agency or an
91	91	entity created by the constitution of New Mexico or any branch
92	92	of government that receives public funding, including political
93	93	subdivisions, special tax districts, school districts and
94	94	institutions of higher education; and
95	95	[C.] D. "reproductive health care" means
96	96	psychological, behavioral, surgical, pharmaceutical and medical
97	97	care, services and supplies that relate to the human
98	98	reproductive system, including services related to:
99	99	(1) preventing a pregnancy;
100	100	(2) abortion;
101	101	(3) managing a pregnancy loss;
102	102	(4) prenatal, birth, perinatal and postpartum
103	103	health;
104	104	(5) managing perimenopause and menopause;
105	105	(6) managing fertility;
106	106	(7) treating cancers of the reproductive
107	107	system; or
108	108	(8) preventing or treating sexually
109	109	transmitted infections."
110	110	SECTION 2. Section 24-34-3 NMSA 1978 (being Laws 2023,
111	111	Chapter 11, Section 3) is amended to read:
112	112	"24-34-3. PUBLIC BODY PROHIBITED ACTION.--
113	113	A. A public body or an entity or individual acting
114	114	on behalf of or within the scope of the authority of a public

143	143	body shall not discriminate against a person based on that
144	144	person's use of or refusal to use reproductive health care or
145	145	gender-affirming health care services.
146	146	B. A public body or an entity or individual acting
147	147	on behalf of or within the scope of the authority of a public
148	148	body shall not deny, restrict or interfere with a person's
149	149	ability to access or provide reproductive health care or
150	150	gender-affirming health care within the medical standard of
151	151	care.
152	152	C. A public body or an entity or individual acting
153	153	on behalf of or within the scope of the authority of a public
154	154	body shall not deprive, through prosecution, punishment or
155	155	other means, a person's ability to act or refrain from acting
156	156	during the person's pregnancy based on the potential, actual or
157	157	perceived effect on the pregnancy.
158	158	D. A public body or an entity or individual acting
159	159	on behalf of or within the scope of the authority of a public
160	160	body shall not impose or continue in effect any law, ordinance,
161	161	policy or regulation that violates or conflicts with the
162	162	provisions of the Reproductive and Gender-Affirming Health Care
163	163	Freedom Act.
164	164	E. Nothing in the Reproductive and Gender-Affirming
165	165	Health Care Freedom Act shall be construed to require a health
166	166	care provider or entity to provide care:
167	167	(1) that the health care provider or entity

196	196	does not otherwise provide or have a duty to provide under
197	197	state or federal law;
198	198	(2) when the provision of service is against
199	199	the medical judgment of the treating health care provider while
200	200	acting within the standard of care; or
201	201	(3) when an individual does not provide
202	202	payment or a source of payment for the service when it is
203	203	required in the ordinary course of business, unless the health
204	204	care provider has a duty to provide services under state or
205	205	federal law, regardless of the ability to pay.
206	206	F. Nothing in the Reproductive and Gender-Affirming
207	207	Health Care Freedom Act shall be construed to require a managed
208	208	care organization or health insurance company to cover claims
209	209	that are not otherwise required to be covered by the terms and
210	210	conditions of an insurance contract, managed care contract or
211	211	state or federal law.
212	212	G. Nothing in the Reproductive and Gender-Affirming
213	213	Health Care Freedom Act shall be construed to allow a minor to
214	214	receive gender-affirming health care or reproductive health
215	215	care without parental consent in any manner that is not
216	216	otherwise provided for by law. "
