4848 AN ACT
4949 RELATING TO HEALTH CARE; CLARIFYING CONSENT REQUIREMENTS FOR
5050 MINORS RECEIVING HEALTH CARE.
5151 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5252 SECTION 1. Section 24-34-2 NMSA 1978 (being Laws 2023,
5353 Chapter 11, Section 2) is amended to read:
5454 "24-34-2. DEFINITIONS.--As used in the Reproductive and
5555 Gender-Affirming Health Care Freedom Act:
5656 A. "gender-affirming health care" means
5757 psychological, behavioral, surgical, pharmaceutical and medical
5858 care, services and supplies provided to support a person's
5959 gender identity;
6060 B. "minor" means an individual who is under
6161 eighteen years of age;
6262 [B.] C. "public body" means a state or local

9090 government, an advisory board, a commission, an agency or an
9191 entity created by the constitution of New Mexico or any branch
9292 of government that receives public funding, including political
9393 subdivisions, special tax districts, school districts and
9494 institutions of higher education; and
9595 [C.] D. "reproductive health care" means
9696 psychological, behavioral, surgical, pharmaceutical and medical
9797 care, services and supplies that relate to the human
9898 reproductive system, including services related to:
9999 (1) preventing a pregnancy;
100100 (2) abortion;
101101 (3) managing a pregnancy loss;
102102 (4) prenatal, birth, perinatal and postpartum
103103 health;
104104 (5) managing perimenopause and menopause;
105105 (6) managing fertility;
106106 (7) treating cancers of the reproductive
107107 system; or
108108 (8) preventing or treating sexually
109109 transmitted infections."
110110 SECTION 2. Section 24-34-3 NMSA 1978 (being Laws 2023,
111111 Chapter 11, Section 3) is amended to read:
112112 "24-34-3. PUBLIC BODY PROHIBITED ACTION.--
113113 A. A public body or an entity or individual acting
114114 on behalf of or within the scope of the authority of a public

143143 body shall not discriminate against a person based on that
144144 person's use of or refusal to use reproductive health care or
145145 gender-affirming health care services.
146146 B. A public body or an entity or individual acting
147147 on behalf of or within the scope of the authority of a public
148148 body shall not deny, restrict or interfere with a person's
149149 ability to access or provide reproductive health care or
150150 gender-affirming health care within the medical standard of
151151 care.
152152 C. A public body or an entity or individual acting
153153 on behalf of or within the scope of the authority of a public
154154 body shall not deprive, through prosecution, punishment or
155155 other means, a person's ability to act or refrain from acting
156156 during the person's pregnancy based on the potential, actual or
157157 perceived effect on the pregnancy.
158158 D. A public body or an entity or individual acting
159159 on behalf of or within the scope of the authority of a public
160160 body shall not impose or continue in effect any law, ordinance,
161161 policy or regulation that violates or conflicts with the
162162 provisions of the Reproductive and Gender-Affirming Health Care
163163 Freedom Act.
164164 E. Nothing in the Reproductive and Gender-Affirming
165165 Health Care Freedom Act shall be construed to require a health
166166 care provider or entity to provide care:
167167 (1) that the health care provider or entity

196196 does not otherwise provide or have a duty to provide under
197197 state or federal law;
198198 (2) when the provision of service is against
199199 the medical judgment of the treating health care provider while
200200 acting within the standard of care; or
201201 (3) when an individual does not provide
202202 payment or a source of payment for the service when it is
203203 required in the ordinary course of business, unless the health
204204 care provider has a duty to provide services under state or
205205 federal law, regardless of the ability to pay.
206206 F. Nothing in the Reproductive and Gender-Affirming
207207 Health Care Freedom Act shall be construed to require a managed
208208 care organization or health insurance company to cover claims
209209 that are not otherwise required to be covered by the terms and
210210 conditions of an insurance contract, managed care contract or
211211 state or federal law.
212212 G. Nothing in the Reproductive and Gender-Affirming
213213 Health Care Freedom Act shall be construed to allow a minor to
214214 receive gender-affirming health care or reproductive health
215215 care without parental consent in any manner that is not
216216 otherwise provided for by law. "
