3333 RELATING TO CRIMINAL LAW; CREATING THE CRIME OF UNLAWFUL
3434 CARRYING OF A FIREARM WHILE TRAFFICKING A CONTROLLED SUBSTANCE;
3535 PROVIDING A PENALTY.
3636 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3737 SECTION 1. A new section of Chapter 30, Article 7 NMSA
3838 1978 is enacted to read:
3939 "[NEW MATERIAL] UNLAWFUL CARRYING OF A FIREARM WHILE
4040 TRAFFICKING A CONTROLLED SUBSTANCE.--Unlawful carrying of a
4141 firearm while trafficking a controlled substance consists of
4242 carrying a firearm while violating the provisions of Section
4343 30-31-20 NMSA 1978. Whoever commits unlawful carrying of a
4444 firearm while trafficking a controlled substance is guilty of a
4545 third degree felony and shall be sentenced pursuant to the
4646 provisions of Section 31-18-15 NMSA 1978. As used in this
