5050 RELATING TO LABOR; REQUIRING THE HEALTH CARE AUTHORITY TO SET A
5151 MINIMUM MEDICAID FEE SCHEDULE FOR REIMBURSING PERSONAL CARE
5252 SERVICES; REQUIRING AT LEAST SEVENTY PERCENT OF MEDICAID
5353 REIMBURSEMENT FOR PERSONAL CARE SERVICES TO BE USED FOR
5454 COMPENSATING DIRECT CARE WORKERS; MAKING AN APPROPRIATION.
5555 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5656 SECTION 1. A new section of the Public Assistance Act is
5757 enacted to read:
5858 "[NEW MATERIAL] MEDICAID REIMBURSEMENT FOR PERSONAL CARE
5959 SERVICES.--
6060 A. For the purposes of this section:
6161 (1) "compensation" means all payments and
6262 benefits provided to direct care workers, including:
6363 (a) salary, wages, overtime pay and

9292 (b) health, dental, life and disability
9393 insurance;
9494 (c) paid leave, retirement benefits and
9595 tuition reimbursement; and
9696 (d) the employer share of payroll taxes;
9797 (2) "direct care worker" means a non-
9898 administrative employee of a personal care services provider
9999 agency who spends the majority of the employee's work hours
100100 providing personal care services;
101101 (3) "medicaid" means the medical assistance
102102 program established pursuant to Title 19 of the federal act and
103103 regulations issued pursuant to that act;
104104 (4) "personal care services" means services
105105 provided to an individual to assist with activities of daily
106106 living; and
107107 (5) "personal care services provider agency"
108108 means an entity that:
109109 (a) has entered into a medicaid provider
110110 participation agreement with the medical assistance division of
111111 the authority and: 1) is contracted with a managed care
112112 organization to provide personal care services to medicaid
113113 recipients; or 2) provides personal care services to medicaid
114114 recipients through fee-for-service arrangements;
115115 (b) is reimbursed for personal care

144144 services provided to individuals covered by medicaid; and
145145 (c) employs direct care workers to
146146 provide personal care services to individuals covered by
147147 medicaid.
148148 B. The authority shall implement a minimum medicaid
149149 fee schedule for personal care services that requires managed
150150 care organizations and fee-for-service arrangements to
151151 reimburse personal care services provider agencies at least
152152 twenty-three dollars fifty cents ($23.50) per hour for
153153 providing personal care services.
154154 C. A personal care services provider agency that
155155 receives medicaid reimbursement for providing personal care
156156 services shall use at least seventy percent of the medicaid
157157 reimbursement as compensation to direct care workers for
158158 furnishing their services.
159159 D. Before calculating the minimum amount of
160160 medicaid reimbursement that a personal care services provider
161161 agency is required to use to compensate direct care workers,
162162 the costs of providing training, travel and personal protective
163163 equipment to direct care workers shall be deducted from the
164164 total amount of medicaid reimbursement that the personal care
165165 services provider agency receives."
166166 SECTION 2. APPROPRIATION.--Twenty million eight hundred
167167 thousand dollars ($20,800,000) is appropriated from the general
168168 fund to the health care authority for expenditure in fiscal

197197 year 2026 to update the medicaid personal care services fee
198198 schedule and increase medicaid reimbursement for personal care
199199 services pursuant to Section 1 of this act. Any unexpended or
200200 unencumbered balance remaining at the end of fiscal year 2026
201201 shall revert to the general fund.
