54	54	CERTIFIED LAW ENFORCEMENT OFFICER, A COMMISSIONED LAW
55	55	ENFORCEMENT OFFICER OR A LAW ENFORCEMENT OFFICER OF AN INDIAN
56	56	NATION, TRIBE OR PUEBLO.
57	57	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
58	58	SECTION 1. Section 30-7-7.3 NMSA 1978 (being Laws 2024,
59	59	Chapter 46, Section 1) is amended to read:
60	60	"30-7-7.3. UNLAWFUL SALE OF A FIREARM BEFORE REQUIRED
61	61	WAITING PERIOD ENDS.--
62	62	A. A waiting period of seven calendar days shall be
63	63	required for the sale of a firearm and the transfer of the

91	91	firearm to the buyer. The seven-calendar-day waiting period
92	92	shall include the period required to conduct a federal instant
93	93	background check; provided that, if the seven-calendar-day
94	94	waiting period has expired without the completion of a required
95	95	federal instant background check, the seller shall not transfer
96	96	the firearm to the buyer until the federal instant background
97	97	check is completed. If the required federal instant background
98	98	check has not been completed within twenty days, the seller may
99	99	transfer the firearm to the buyer.
100	100	B. The firearm shall remain in the custody of the
101	101	seller or the federal firearms licensee performing the federal
102	102	instant background check during the entirety of the waiting
103	103	period.
104	104	C. Unlawful sale of a firearm before the required
105	105	waiting period ends consists of the transfer of ownership,
106	106	possession or physical control of the firearm from the seller
107	107	to the buyer before the end of the required seven-calendar-day
108	108	waiting period, but does not include temporary possession or
109	109	control of a firearm provided to a customer by the proprietor
110	110	of a licensed business in the conduct of that business.
111	111	D. Each party to an unlawful sale of a firearm
112	112	before the required waiting period ends is in violation of this
113	113	section and may be separately charged for the same sale.
114	114	E. Each firearm sold contrary to the provisions of
115	115	this section constitutes a separate offense under Subsection C

145	145	F. Two or more offenses may be charged in the same
146	146	complaint, information or indictment and shall be punished as
147	147	separate offenses.
148	148	G. Whoever violates the provisions of this section
149	149	is guilty of a misdemeanor.
150	150	H. The provisions of this section do not apply to
151	151	the sale of a firearm:
152	152	(1) to a buyer who holds a valid federal
153	153	firearms license;
154	154	(2) to a buyer who holds a valid New Mexico
155	155	concealed handgun license pursuant to the Concealed Handgun
156	156	Carry Act;
157	157	(3) to a law enforcement agency;
158	158	(4) between two law enforcement officers
159	159	authorized to carry a firearm and certified pursuant to federal
160	160	law or the Law Enforcement Training Act; [or ]
161	161	(5) to a buyer who is not by action of law
162	162	permanently disqualified from possessing a firearm and who is
163	163	a:
164	164	(a) law enforcement officer authorized
165	165	to carry a firearm and certified pursuant to federal law or the
166	166	Law Enforcement Training Act;
167	167	(b) former or retired law enforcement
168	168	officer who was authorized to carry a firearm and certified

201	201	(d) law enforcement officer of an Indian
202	202	nation, tribe or pueblo who is authorized to carry a firearm;

204	204	[(5)] (6) between immediate family members.
205	205	I. As used in this section:
206	206	(1) "firearm" means any weapon that will or is
207	207	designed to or may readily be converted to expel a projectile
208	208	by the action of an explosion; the frame or receiver of any
209	209	such weapon; and includes any handgun, rifle or shotgun; but
210	210	shall not include an antique firearm as defined in 18 U.S.C.
211	211	Section 921(16), a powder-actuated tool or other device
212	212	designed to be used for construction purposes, an emergency
213	213	flare or a firearm in permanently inoperable condition; and
214	214	(2) "immediate family member" means a spouse,
215	215	a parent, a child, a sibling, a grandparent, a grandchild, a
216	216	great-grandchild, a niece, a nephew, a first cousin, an aunt or
217	217	an uncle."
