4949 RELATING TO UNFAIR BUSINESS PRACTICES; AMENDING THE UNFAIR
5050 PRACTICES ACT; ADDING PROVIDING IMMIGRATION CONSULTATIONS OR
5151 SERVICES WITHOUT HOLDING A LICENSE TO PRACTICE LAW OR WITHOUT
5252 BEING UNDER THE SUPERVISION OF A LICENSED ATTORNEY, INCLUDING
5353 HOLDING ONESELF OUT AS A "NOTARIO" OR "NOTARIO PUBLICO", TO THE
5454 DEFINITION OF "UNFAIR OR DECEPTIVE TRADE PRACTICE".
5555 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5656 SECTION 1. Section 57-12-2 NMSA 1978 (being Laws 1967,
5757 Chapter 268, Section 2, as amended) is amended to read:
5858 "57-12-2. DEFINITIONS.--As used in the Unfair Practices
5959 Act:
6060 A. "person" means, where applicable, natural
6161 persons, corporations, trusts, partnerships, associations,
6262 cooperative associations, clubs, companies, firms, joint

9191 B. "seller-initiated telephone sale" means a sale,
9292 lease or rental of goods or services in which the seller or the
9393 seller's representative solicits the sale by telephoning the
9494 prospective purchaser and in which the sale is consummated
9595 entirely by telephone or mail, but does not include a
9696 transaction:
9797 (1) in which a person solicits a sale from a
9898 prospective purchaser who has previously made an authorized
9999 purchase from the seller's business; or
100100 (2) in which the purchaser is accorded the
101101 right of rescission by the provisions of the federal Consumer
102102 Credit Protection Act, 15 U.S.C. 1635, or regulations issued
103103 pursuant thereto;
104104 C. "trade" or "commerce" includes the advertising,
105105 offering for sale or distribution of any services and any
106106 property and any other article, commodity or thing of value,
107107 including any trade or commerce directly or indirectly
108108 affecting the people of this state;
109109 D. "unfair or deceptive trade practice" means an
110110 act specifically declared unlawful pursuant to the Unfair
111111 Practices Act, a false or misleading oral or written statement,
112112 visual description or other representation of any kind
113113 knowingly made in connection with the sale, lease, rental or
114114 loan of goods or services or in the extension of credit or in

143143 the collection of debts by a person in the regular course of
144144 the person's trade or commerce, that may, tends to or does
145145 deceive or mislead any person and includes:
146146 (1) representing goods or services as those of
147147 another when the goods or services are not the goods or
148148 services of another;
149149 (2) causing confusion or misunderstanding as
150150 to the source, sponsorship, approval or certification of goods
151151 or services;
152152 (3) causing confusion or misunderstanding as
153153 to affiliation, connection or association with or certification
154154 by another;
155155 (4) using deceptive representations or
156156 designations of geographic origin in connection with goods or
157157 services;
158158 (5) representing that goods or services have
159159 sponsorship, approval, characteristics, ingredients, uses,
160160 benefits or quantities that they do not have or that a person
161161 has a sponsorship, approval, status, affiliation or connection
162162 that the person does not have;
163163 (6) representing that goods are original or
164164 new if they are deteriorated, altered, reconditioned,
165165 reclaimed, used or secondhand;
166166 (7) representing that goods or services are of
167167 a particular standard, quality or grade or that goods are of a

197197 (8) disparaging the goods, services or
198198 business of another by false or misleading representations;
199199 (9) offering goods or services with intent not
200200 to supply them in the quantity requested by the prospective
201201 buyer to the extent of the stock available, unless the
202202 purchaser is purchasing for resale;
203203 (10) offering goods or services with intent
204204 not to supply reasonable expectable public demand;
205205 (11) making false or misleading statements of
206206 fact concerning the price of goods or services, the prices of
207207 competitors or one's own price at a past or future time or the
208208 reasons for, existence of or amounts of price reduction;
209209 (12) making false or misleading statements of
210210 fact for the purpose of obtaining appointments for the
211211 demonstration, exhibition or other sales presentation of goods
212212 or services;
213213 (13) packaging goods for sale in a container
214214 that bears a trademark or trade name identified with goods
215215 formerly packaged in the container, without authorization,
216216 unless the container is labeled or marked to disclaim a
217217 connection between the contents and the trademark or trade
218218 name;
219219 (14) using exaggeration, innuendo or ambiguity
220220 as to a material fact or failing to state a material fact if

249249 doing so deceives or tends to deceive;
250250 (15) stating that a transaction involves
251251 rights, remedies or obligations that it does not involve;
252252 (16) stating that services, replacements or
253253 repairs are needed if they are not needed;
254254 (17) failing to deliver the quality or
255255 quantity of goods or services contracted for;
256256 (18) violating the Tobacco Escrow Fund Act;
257257 [or]
258258 (19) providing immigration consultations or
259259 services without holding a license to practice law or without
260260 being under the supervision of a licensed attorney, including
261261 holding oneself out as a "notario" or "notario publico" in
262262 violation of Subsection C of Section 14-14A-24 NMSA 1978; or
263263 [(19)] (20) offering or providing unposted or
264264 unadvertised pricing or service based on the buyer's gender or
265265 perceived gender identity; provided, however, that this
266266 provision does not apply to persons regulated by the office of
267267 superintendent of insurance pursuant to the New Mexico
268268 Insurance Code; and
269269 E. "unconscionable trade practice" means an act or
270270 practice in connection with the sale, lease, rental or loan, or
271271 in connection with the offering for sale, lease, rental or
272272 loan, of any goods or services, including services provided by
273273 licensed professionals, or in the extension of credit or in the
