4949 RELATING TO TRANSPORTATION; CREATING THE TOWING SERVICES
5050 OVERSIGHT AND ADVISORY BOARD; PROVIDING DUTIES.
5151 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5252 SECTION 1. [NEW MATERIAL] TOWING SERVICES OVERSIGHT AND
5353 ADVISORY BOARD--CREATED--MEMBERSHIP--DUTIES.--
5454 A. The "towing services oversight and advisory
5555 board" is created in the department of transportation to
5656 provide recommendations, oversight and regulatory guidance to
5757 the department regarding the operations of licensed towing
5858 services. The towing services oversight and advisory board
5959 consists of twelve members, including six primary members and
6060 six alternate members. One primary member and one alternate
6161 member shall be from each of the six state transportation
6262 commission districts.

9090 B. The towing services oversight and advisory board
9191 shall:
9292 (1) review and provide recommendations on
9393 department of transportation policies, regulations and
9494 procedures related to towing services;
9595 (2) propose improvements to service standards
9696 and compliance requirements;
9797 (3) evaluate citizen complaints regarding
9898 towing services and ensure that complaints are properly
9999 investigated and resolved;
100100 (4) facilitate mediation for towing-related
101101 disputes arising between citizens and towing services;
102102 (5) assess whether licensed towing services
103103 are complying with state regulations and contractual
104104 obligations;
105105 (6) conduct audits and inspections as
106106 necessary to verify compliance with industry standards;
107107 (7) submit quarterly reports to the department
108108 of transportation summarizing activities, findings, complaints,
109109 resolutions, licensed towing services that are out of
110110 compliance and recommendations;
111111 (8) engage with state agencies, industry
112112 associations and community representatives to promote
113113 regulatory transparency and public awareness; and
114114 (9) provide education to towing service

143143 providers and the public on towing regulations, consumer rights
144144 and responsibilities.
145145 C. The department of transportation shall seek,
146146 interview, evaluate and select members of the towing services
147147 oversight and advisory board. The department shall seek
148148 candidates from stakeholders within the towing and
149149 transportation industry, including towing service owners and
150150 operators, industry associations and department of
151151 transportation representatives. Members shall have
152152 professional experience in towing operations, transportation
153153 regulations, customer service, legal matters or community
154154 advocacy.
155155 D. Selections to the towing services oversight and
156156 advisory board shall be made by January 1, 2026. The terms of
157157 service of appointed members shall start on January 1, 2026.
158158 The terms shall be three years, and the initial terms shall be
159159 staggered so that the terms of three primary members and three
160160 alternate members expire at the end of the initial two years
161161 and the terms of the remaining members expire at the end of the
162162 initial three years. The initial terms shall be selected by
163163 random drawing.
164164 E. The towing services oversight and advisory board
165165 shall meet not less than quarterly at the call of the chair or
166166 the secretary of transportation. A majority of the members
167167 constitutes a quorum for the transaction of business, and the

196196 support of a majority of the quorum is required for adoption of
197197 any action. Members of the advisory board shall select a chair
198198 and vice chair from among its members.
199199 F. Public members of the towing services oversight
200200 and advisory board are entitled to receive per diem and mileage
201201 as provided in the Per Diem and Mileage Act and shall receive
202202 no other compensation, perquisite or allowance.
203203 G. The department of transportation shall provide
204204 staffing, resources, funding and administrative support
205205 necessary for the operation of the towing services oversight
206206 and advisory board.
207207 SECTION 2. EFFECTIVE DATE.--The effective date of the
208208 provisions of this act is July 1, 2025.
