29-RELATING TO PUBLIC SCHOOLS; CLARIFYING THAT LOCAL SCHOOL
30-BOARDS AND GOVERNING BODIES OF CHARTER SCHOOLS SHALL

3454 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3555 SECTION 1. Section 22-2-8.1 NMSA 1978 (being Laws 1986,
3656 Chapter 33, Section 2, as amended by Laws 2023, Chapter 19,
37-Section 1 and by Laws 2023, Chapter 84, Section 22) is

4161 AUTHORITY.--
4262 A. Except as otherwise provided in this section,
43-students shall be in school programs, exclusive of lunch, for
44-a minimum of one thousand one hundred forty instructional
45-hours per year, except half-day kindergarten, which shall
46-have five hundred fifty instructional hours per year;
47-provided that the local school board of a school district or
48-governing body of a charter school shall determine the total
49-number of instructional days per year and the number of
50-instructional days per week that students shall be in school

7898 B. An instructional hour is a period at school
7999 during which students receive instruction aligned to academic
80100 content and performance standards and includes:
81101 (1) a school program set forth in Sections
82102 22-13-1 and 22-13-1.1 NMSA 1978;
83-(2) enrichment programs that focus on
84-problem solving and cognitive skills development;
85-(3) content that provides technical
86-knowledge, skills and competency-based applied learning;
103+(2) enrichment programs that focus on problem
104+solving and cognitive skills development;
105+(3) content that provides technical knowledge,
106+skills and competency-based applied learning;
87107 (4) research- or evidence-based social,
88108 emotional or academic interventions; and
89109 (5) instruction that occurs at the same time
90110 breakfast is served or consumed in accordance with the
91111 breakfast after the bell program or federal requirements.
92112 C. Up to sixty instructional hours per school year
93-for elementary grades and thirty instructional hours for
94-middle and high school grades may be used for professional
95-work hours, which may be embedded during the course of a
96-normal school day. A "professional work hour" means time
97-during which a teacher participates in professional work
98-aligned to challenging academic content and performance
99-standards, including:
100-(1) home visiting or parent-teacher
101-conferences;

144+A "professional work hour" means time during which a teacher
145+participates in professional work aligned to challenging
146+academic content and performance standards, including:
147+(1) home visiting or parent-teacher

131152 between school employees.
132-D. Nothing in this section precludes a local
133-school board from setting a school year or the length of
134-school days in excess of the minimum requirements established
135-by Subsection A of this section.
153+D. Nothing in this section precludes a local school
154+board from setting a school year or the length of school days
155+in excess of the minimum requirements established by Subsection
156+A of this section.
136157 E. The secretary may waive the minimum length of
137-school days in those school districts where such minimums
138-would create undue hardships as defined by the department as
139-long as the school year is adjusted to ensure that students
140-in those school districts receive the same total
141-instructional time as other students in the state.
