3151 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3252 SECTION 1. Section 21-21G-3 NMSA 1978 (being Laws 1988,
3353 Chapter 111, Section 3, as amended) is amended to read:
3454 "21-21G-3. DEFINITIONS.--As used in the Graduate
3555 Scholarship Act:
36-A. "academic year" means the consecutive period of
37-two semesters or other comparable units commencing with the
38-fall term each year;
56+A. "academic year" means [any ] the consecutive
57+period of two semesters [three quarters ] or other comparable
58+units commencing with the fall term each year;
3959 B. "award recipient" means a student who is a New
4060 Mexico resident and is awarded a graduate scholarship;
4161 C. "department" means the higher education
4262 department;
43-D. "eligible institution" means a graduate-degree-
44-granting state university enumerated in Article 12, Section
45-11 of the constitution of New Mexico and accredited by the
46-higher learning commission;
47-E. "graduate field" means a program of study
48-intended to result in a master's or doctoral degree,
49-excluding a doctor of medicine; and
50-F. "groups underrepresented in graduate education"
51-means women, minorities, persons with a visual impairment or HB 89

78-other physical disability and other groups that have

94+schools] higher learning commission ;
95+E. "graduate [and professional ] field" means [any]
96+a program of study intended to result in a master's or doctoral
97+degree, excluding [the degree in ] a doctor of medicine; and
98+F. "groups underrepresented in graduate education"
99+means women, minorities, persons with a visual impairment or
100+other physical disability and other groups [who ] that have

80102 graduate study or profession for which the scholarship is

82104 SECTION 2. Section 21-21G-5 NMSA 1978 (being Laws 1988,
83105 Chapter 111, Section 5, as amended) is amended to read:
84106 "21-21G-5. CONDITIONS FOR FIRST-YEAR ELIGIBILITY.--
85-A. Priority shall be given to New Mexico students
86-who are New Mexico residents with the greatest financial need
87-and students who are residents from groups underrepresented
88-in graduate education.
89-B. A scholarship may be awarded to a New Mexico
90-resident who has:
91-(1) earned a bachelor's degree and
92-maintained a grade point average of 3.0 or higher on a 4.0
93-scale or who holds a paid position supporting faculty
94-teaching or research activities;
95-(2) met the admission requirements, is
96-accepted for enrollment and enrolls in at least six credit
97-hours in a graduate field of study; and
98-(3) complied with all the rules adopted by
99-the department for award of the scholarship and the
100-provisions regarding the administration of the graduate
101-scholarship program."
102-SECTION 3. Section 21-21G-6 NMSA 1978 (being Laws 1988, HB 89

143+has a permanent resident visa ] (1) earned a bachelor's degree
144+and maintained a grade point average of 3.0 or higher on a 4.0
145+scale or who holds a paid position supporting faculty teaching
146+or research activities ;
147+[B. has] (2) met the admission requirements,
148+[and] is accepted for enrollment [as a full-time student in an
149+underrepresented] and enrolls in at least six credit hours in a
150+graduate [or professional ] field of study [as determined by the
151+institution]; and
152+[C. has] (3) complied with all the rules [and
153+regulations] adopted by the [commission ] department for award
154+of the scholarship and the provisions regarding the
155+administration of [state ] the graduate [scholarships adopted
156+pursuant to the Graduate Scholarship Act; and
157+D. agrees to serve in an unpaid internship or
158+assistantship at the eligible institution, a government agency
159+or private industry approved by his major department for ten
160+hours per week during the academic year ] scholarship program ."
161+SECTION 3. Section 21-21G-6 NMSA 1978 (being Laws 1988,
129162 Chapter 111, Section 6, as amended) is amended to read:
130163 "21-21G-6. CONDITIONS FOR CONTINUING ELIGIBILITY.--
131164 A. Except as provided in Subsection B of this
132-section, a scholarship may be re-awarded to a student who:
133-(1) was an award recipient the previous
134-year;
135-(2) maintains a grade point average of 3.0
136-or higher on a 4.0 scale and remains in good academic
137-standing as determined by the eligible institution; and
138-(3) is enrolled in at least six credit hours
139-in a graduate field of study.
140-B. A graduate scholarship may be granted until the
141-award recipient either receives a terminal degree or has
142-qualified and received eight semesters of scholarship,
143-whichever occurs first."
144-SECTION 4. Section 21-21G-7 NMSA 1978 (being Laws 1988,
145-Chapter 111, Section 7, as amended) is amended to read:
146-"21-21G-7. AMOUNT OF SCHOLARSHIPS.--Scholarship award
147-amounts shall not exceed one hundred percent of tuition and
148-fees for the graduate program at the eligible institution for
149-the academic year; provided that the department shall fund
150-only one semester at a time and shall not fund the second
151-semester of the academic year if the student does not enroll
152-for that semester or does not otherwise maintain

180-SECTION 5. Section 21-21G-10 NMSA 1978 (being Laws
181-1988, Chapter 111, Section 10, as amended) is amended to

253+SECTION 5. Section 21-21G-10 NMSA 1978 (being Laws 1988,

183255 "21-21G-10. TERMINATION OF SCHOLARSHIPS.--A scholarship
184256 is terminated upon the occurrence of:
185257 A. withdrawal from the eligible institution by the
186-award recipient or failure to reenroll for consecutive
187-academic semesters;
258+award recipient or failure to reenroll for consecutive academic
259+[years or failure to be a full-time graduate student; or ]
260+semesters;
188261 B. failure to maintain the required grade point
189262 average and other qualifications for the scholarship; or
190-C. substantial noncompliance by the award
191-recipient with the Graduate Scholarship Act or the rules or
192-procedures promulgated by the department in accordance with
193-that act."

194267 SECTION 6. EFFECTIVE DATE.--The effective date of the
