2949 RELATING TO PUBLIC UTILITIES; ALLOWING ADDITIONAL RATE
3050 STRUCTURES.
3151 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3252 SECTION 1. Section 62-8-6 NMSA 1978 (being Laws 1941,
3353 Chapter 84, Section 42, as amended) is amended to read:
34-"62-8-6. DISCRIMINATION.--No public utility shall, as
35-to rates or services, make or grant any unreasonable
36-preference or advantage to any corporation or person within
37-any classification or subject any corporation or person
38-within any classification to any unreasonable prejudice or
39-disadvantage. No public utility shall establish and maintain
40-any unreasonable differences as to rates of service either as
41-between localities or as between classes of service. Nothing
42-shall prohibit, however, the commission from approving:
43-A. economic development rates;
44-B. rates designed to retain load;
45-C. rates and programs designed to reduce the
46-burden of energy costs on low-income customers; and
47-D. energy efficiency programs designed to reduce
48-the burden of energy costs on low-income customers pursuant
49-to the Efficient Use of Energy Act."
