4343 WHEREAS, artificial intelligence is rapidly transforming
4444 industries, government operations, health care, education and
4545 daily life, offering significant economic and social benefits
4646 while also raising concerns regarding bias, security,
4747 transparency, workforce displacement and ethical implications;

4949 WHEREAS, the collection, use and sharing of personal data
5050 have become increasingly complex, leading to growing concerns
5151 about consumer privacy, data security, digital rights and the

8282 New Mexico places residents at risk of unauthorized data
8383 collection, breaches and exploitation, and businesses lack
8484 clear regulatory guidance on responsible data practices; and
8585 WHEREAS, several states have enacted or are considering
8686 comprehensive data-privacy- and artificial-intelligence-related
8787 legislation, and New Mexico must evaluate these developments to
8888 ensure its policies align with national and global best
8989 practices while reflecting the state's unique needs; and
9090 WHEREAS, New Mexico is home to national laboratories,
9191 research institutions and a growing technology sector; and
9292 WHEREAS, because of the state's technology sector, it is
9393 critical for the state to proactively engage in artificial
9494 intelligence and data privacy policy discussions to foster
9595 responsible innovation and economic growth; and
9696 WHEREAS, artificial intelligence and data privacy
9797 regulations impact numerous stakeholders, including businesses,
9898 consumers, educators, health care providers and government
9999 agencies, necessitating a broad and inclusive approach to

101101 WHEREAS, the establishment of a special legislative
102102 committee would provide a structured forum for experts,
103103 industry leaders, public interest groups and community members

132132 to offer insights and ensure that artificial intelligence and
133133 data privacy policies are well-informed and effectively address
134134 potential risks and opportunities;
135135 NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
136136 STATE OF NEW MEXICO that the New Mexico legislative council be
137137 requested to create a special interim legislative committee
138138 during the 2025 interim to hold hearings, gather testimony from
139139 stakeholders and develop recommendations for legislation in the
140140 2026 legislative session that addresses artificial intelligence
141141 development, deployment and regulation, as well as
142142 comprehensive data privacy protections for New Mexico
143143 residents; and
144144 BE IT FURTHER RESOLVED that the special interim
145145 legislative committee be requested to discuss artificial
146146 intelligence and comprehensive data privacy legislation,
147147 including an examination of existing and proposed federal,
148148 state and international approaches to artificial intelligence
149149 governance and data protection; and
150150 BE IT FURTHER RESOLVED that copies of this memorial be
151151 transmitted to the governor, the director of the legislative
152152 council service, the New Mexico legislative council, the
153153 secretary of information technology, the directors of New
154154 Mexico's national laboratories, the presidents or chancellors
155155 of the state's post-secondary educational institutions,
156156 representatives of the state's technology businesses and
