3838 NEW MEXICO TO REMOVE A FELONY CONVICTION AS A DISQUALIFIER TO

4040 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
4141 SECTION 1. It is proposed to amend Article 7, Section 1
4242 of the constitution of New Mexico to read:
4343 "A. Every person who is a qualified elector
4444 pursuant to the constitution and laws of the United States and
4545 a citizen [thereof] of the United States shall be qualified to
4646 vote in all elections in New Mexico, subject to residency and
4747 registration requirements provided by law, except [as
4848 restricted by statute either by reason of criminal conviction
4949 for a felony or by] for reason of mental incapacity, [being ]
5050 which is limited only to those persons who are unable to mark

7979 communicate their voting preference. The legislature may enact
8080 laws providing for absentee voting by qualified electors. All
8181 school elections shall be held at different times from partisan
8282 elections.
8383 B. The legislature shall have the power to require
8484 the registration of [the ] qualified electors as a requisite for
8585 voting and shall regulate the manner, time and places of
8686 voting. The legislature shall enact such laws as will secure
8787 the secrecy of the ballot and the purity of elections and guard
8888 against the abuse of elective franchise. Not more than two
8989 members of the board of registration and not more than two
9090 judges of election shall belong to the same political party at
9191 the time of their appointment."
9292 SECTION 2. The amendment proposed by this resolution
9393 shall be submitted to the people for their approval or
9494 rejection at the next general election or at any special
9595 election prior to that date that may be called for that
9696 purpose.
