3737 PROPOSING TO AMEND ARTICLE 4 OF THE CONSTITUTION OF NEW MEXICO

4141 OVERTURN AGENCY RULES DURING A LEGISLATIVE SESSION.
4242 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
4343 SECTION 1. It is proposed to amend Article 4 of the
4444 constitution of New Mexico by adding a new section to read:
4545 "A. The "interim administrative rule oversight
4646 committee" is established and shall consist of twelve members.
4747 Three members each shall be appointed by the majority floor
4848 leader of the house of representatives, the minority floor
4949 leader of the house of representatives, the majority floor
5050 leader of the senate and the minority floor leader of the

7979 B. The position of chair shall alternate between
8080 the house and the senate and the two political parties having
8181 the most members in both houses each year; provided that at no
8282 time shall the political parties having the most members in
8383 both houses not be represented as either a chair or a vice
8484 chair.
8585 C. Members shall be appointed for two-year terms
8686 that shall expire on the third Tuesday in January of an
8787 odd-numbered year; provided that the term of a member shall
8888 terminate when the member ceases to be a member of the
8989 legislature, and a member may be removed at any time by the
9090 original appointing authority. A vacancy shall be filled by
9191 appointment for the remainder of the unexpired term by the
9292 original appointing authority.
9393 D. The interim administrative rule oversight
9494 committee shall meet no less than once per month during the
9595 interim between legislative sessions.
9696 E. The interim administrative rule oversight
9797 committee shall:
9898 (1) review rules proposed by an executive
9999 agency, an analysis of the rules conducted by committee staff
100100 and fiscal impact reports conducted by the legislative finance
101101 committee associated with the rules at least two weeks prior to
102102 the public rule hearing for the rules, except when the

132132 (2) make recommendations on the rules to the
133133 proposing executive agency;
134134 (3) recommend changes to the authorizing
135135 statutes of a rule to clarify legislative intent; and
136136 (4) direct the work of committee staff.
137137 F. If the interim administrative rule oversight
138138 committee determines that an agency rule does not comply with
139139 the authorizing law, the committee may make a recommendation to
140140 the legislature to overturn the rule during a legislative
141141 session. Pursuant to this subsection, the legislature may
142142 overturn agency rules."
143143 SECTION 2. The amendment proposed by this resolution
144144 shall be submitted to the people for their approval or
145145 rejection at the next general election or at any special
146146 election prior to that date that may be called for that
147147 purpose.
