39	39	COMMITTEE AND ALLOW THAT COMMITTEE TO RECOMMEND THE OVERTURNING
40	40	OF AGENCY RULES TO THE LEGISLATURE; ALLOWING THE LEGISLATURE TO
41	41	OVERTURN AGENCY RULES DURING A LEGISLATIVE SESSION.
42	42	BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
43	43	SECTION 1. It is proposed to amend Article 4 of the
44	44	constitution of New Mexico by adding a new section to read:
45	45	"A. The "interim administrative rule oversight
46	46	committee" is established and shall consist of twelve members.
47	47	Three members each shall be appointed by the majority floor
48	48	leader of the house of representatives, the minority floor
49	49	leader of the house of representatives, the majority floor
50	50	leader of the senate and the minority floor leader of the

79	79	B. The position of chair shall alternate between
80	80	the house and the senate and the two political parties having
81	81	the most members in both houses each year; provided that at no
82	82	time shall the political parties having the most members in
83	83	both houses not be represented as either a chair or a vice
84	84	chair.
85	85	C. Members shall be appointed for two-year terms
86	86	that shall expire on the third Tuesday in January of an
87	87	odd-numbered year; provided that the term of a member shall
88	88	terminate when the member ceases to be a member of the
89	89	legislature, and a member may be removed at any time by the
90	90	original appointing authority. A vacancy shall be filled by
91	91	appointment for the remainder of the unexpired term by the
92	92	original appointing authority.
93	93	D. The interim administrative rule oversight
94	94	committee shall meet no less than once per month during the
95	95	interim between legislative sessions.
96	96	E. The interim administrative rule oversight
97	97	committee shall:
98	98	(1) review rules proposed by an executive
99	99	agency, an analysis of the rules conducted by committee staff
100	100	and fiscal impact reports conducted by the legislative finance
101	101	committee associated with the rules at least two weeks prior to
102	102	the public rule hearing for the rules, except when the

132	132	(2) make recommendations on the rules to the
133	133	proposing executive agency;
134	134	(3) recommend changes to the authorizing
135	135	statutes of a rule to clarify legislative intent; and
136	136	(4) direct the work of committee staff.
137	137	F. If the interim administrative rule oversight
138	138	committee determines that an agency rule does not comply with
139	139	the authorizing law, the committee may make a recommendation to
140	140	the legislature to overturn the rule during a legislative
141	141	session. Pursuant to this subsection, the legislature may
142	142	overturn agency rules."
143	143	SECTION 2. The amendment proposed by this resolution
144	144	shall be submitted to the people for their approval or
145	145	rejection at the next general election or at any special
146	146	election prior to that date that may be called for that
147	147	purpose.
