34	34	NEW SECTION TO PROVIDE FOR THE CREATION OF THE CHILDREN, YOUTH
35	35	AND FAMILIES DEPARTMENT, A CHILDREN, YOUTH AND FAMILIES
36	36	COMMISSION AND AN EXECUTIVE DIRECTOR TO ASSUME THE MANAGEMENT
37	37	AND OPERATIONS OF THE CHILDREN, YOUTH AND FAMILIES DEPARTMENT
38	38	AND ENFORCE THE LAWS UNDER THE DEPARTMENT'S JURISDICTION.
39	39	BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
40	40	SECTION 1. It is proposed to amend the constitution of
41	41	New Mexico by adding a new section to read:
42	42	"A. The "children, youth and families commission"
43	43	and "children, youth and families department" are created and
44	44	shall each have such powers and duties as provided by law.
45	45	B. The children, youth and families commission
46	46	consists of five members who shall be appointed for six-year

74	74	terms. Beginning January 1, 2027, the governor, the president
75	75	pro tempore of the senate, the speaker of the house of
76	76	representatives, the minority floor leader of the senate and
77	77	the minority floor leader of the house of representatives shall
78	78	each appoint one member as provided by law. For the initial
79	79	appointment of commission members, the member appointed by the
80	80	governor shall serve for a term of two years and the members
81	81	appointed by the speaker of the house of representatives, the
82	82	president pro tempore of the senate, the minority floor leader
83	83	of the senate and the minority floor leader of the house of
84	84	representatives shall each serve a term of four years.
85	85	Vacancies on the commission shall be filled by the original
86	86	appointing authority, and a person appointed to fill a vacancy
87	87	shall serve for the remainder of the unexpired term. Members
88	88	of the children, youth and families commission shall only be
89	89	removed as provided by law. The legislature shall provide by
90	90	law for the professional qualifications for members of the
91	91	children, youth and families commission.
92	92	C. No later than July 1, 2027, the children, youth
93	93	and families commission shall hire an executive director to
94	94	assume the management and operations of the children, youth and
95	95	families department and enforce the laws under the jurisdiction
96	96	of the children, youth and families department. The
97	97	legislature shall provide by law for the professional
98	98	qualifications of the executive director of the children, youth

128	128	SECTION 2. The amendment proposed by this resolution
129	129	shall be submitted to the people for their approval or
130	130	rejection at the next general election or at any special
131	131	election prior to that date that may be called for that
