3737 A JOINT RESOLUTION
3838 PROPOSING AN AMENDMENT TO ARTICLE 10, SECTION 2 OF THE
3939 CONSTITUTION OF NEW MEXICO TO ALLOW COUNTY SHERIFFS TO SERVE
4040 UNLIMITED CONSECUTIVE FOUR-YEAR TERMS.
4141 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
4242 SECTION 1. It is proposed to amend Article 10, Section 2
4343 of the constitution of New Mexico to read:
4444 "A. In every county, all elected officials shall
4545 serve four-year terms, subject to the provisions of Subsection
4646 B of this section.
4747 B. In those counties that prior to 1992 have not
4848 had four-year terms for elected officials, the assessor,
4949 sheriff and probate judge shall be elected to four-year terms
5050 and the treasurer and clerk shall be elected to two-year terms
5151 in the first election following the adoption of this amendment.

7979 In subsequent elections, the treasurer and clerk shall be

8181 C. To provide for staggered county commission
8282 terms, in counties with three county commissioners, the terms
8383 of no more than two commissioners shall expire in the same
8484 year; and in counties with five county commissioners, the terms
8585 of no more than three commissioners shall expire in the same
8686 year.
8787 D. All county officers, after having served two
8888 consecutive four-year terms, shall be ineligible to hold any
8989 county office for two years thereafter; provided that a person
9090 shall be eligible to hold the office of sheriff for an
9191 unlimited number of consecutive four-year terms ."
9292 SECTION 2. The amendment proposed by this resolution
9393 shall be submitted to the people for their approval or
9494 rejection at the next general election or at any special
9595 election prior to that date that may be called for that
9696 purpose.
