4343 HOME PARKS.
4444 WHEREAS, manufactured homes, known in New Mexico law as
4545 mobile homes, are a major source of housing for New Mexico
4646 residents; and
4747 WHEREAS, mobile home park tenancies are unique because
4848 residents can own the home while renting the land the home
4949 occupies, but residents still risk the possibility of eviction;

7878 WHEREAS, evictions from mobile home parks can be far more
7979 costly and risky to residents, especially to those who cannot
8080 afford to move, as residents must choose to pay five thousand
8181 dollars ($5,000) to ten thousand dollars ($10,000) to move or
8282 abandon the homes they own; and
8383 WHEREAS, in addition to the possibility of an extremely
8484 expensive move or significant loss of property, current state
8585 law does not limit the amount by which a mobile home park
8686 landlord may increase rent when rent increases occur; and
8787 WHEREAS, oversight and regulation of mobile home park
8888 tenancies are needed to create a state framework for rent
8989 stabilization for this particularly vulnerable class of New
9090 Mexico residents;
9191 NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF
9292 REPRESENTATIVES OF THE STATE OF NEW MEXICO that the regulation
9393 and licensing department, the New Mexico mortgage finance
9494 authority, the public regulation commission, the governor's
9595 office of housing, the chair of the opportunity enterprise and
9696 housing development review board or the chair's designee and
9797 the attorney general be requested to develop recommendations
9898 for:
9999 A. a regulatory framework for mobile home park
100100 tenancies after installation of homes in a park; and
101101 B. a rent stabilization program for mobile home

131131 BE IT FURTHER RESOLVED that the regulation and licensing
132132 department, the New Mexico mortgage finance authority, the
133133 public regulation commission, the governor's office of housing,
134134 the chair of the opportunity enterprise and housing development
135135 review board or the chair's designee and the attorney general
136136 report findings, conclusions and recommendations to the
137137 appropriate interim legislative committees that study housing
138138 and property issues by September 1, 2025; and
139139 BE IT FURTHER RESOLVED that copies of this memorial be
140140 transmitted to the regulation and licensing department, the New
141141 Mexico mortgage finance authority, the public regulation
142142 commission, the governor's office of housing, the chair of the
143143 opportunity enterprise and housing development review board and
144144 the attorney general for appropriate distribution.
