3333 REQUESTING THE APPROPRIATE INTERIM LEGISLATIVE COMMITTEES TO
3434 STUDY ISSUES STEMMING FROM THE REGIONAL SPACEPORT DISTRICT ACT
3535 AND THE SPACEPORT DEVELOPMENT ACT AND MAKE RECOMMENDATIONS.
3636 WHEREAS, nearly twenty years ago, the Regional Spaceport
3737 District Act and the Spaceport Development Act were enacted to
3838 provide a framework for the establishment of spaceports in New
3939 Mexico and grow the state's aerospace industry; and
4040 WHEREAS, these acts have provided a strong inception to
4141 spaceport America and New Mexico's aerospace industry, but
4242 issues have emerged; and
4343 WHEREAS, the acts allow for discrepancies in the financial
4444 contributions of governmental units relative to their
4545 representation and the lack of ability of the governmental
4646 units to exercise control over their financial destiny and

7575 WHEREAS, there is a substantial imbalance between the
7676 level of contributions made by counties and the counties'
7777 representation on the board and in the decision-making
7878 processes; and
7979 WHEREAS, these imbalanced financial obligations and
8080 contributions of governmental units can continue to be
8181 determined and imposed without the governmental unit's
8282 agreement; and
8383 WHEREAS, these concerns warrant a thorough and deliberate
8484 examination to ensure that the interests of all local
8585 governments and constituents are fairly represented, that
8686 financial responsibilities are clearly defined and properly
8787 managed and that the governance structure reflects the
8888 realities of contributions made by those who are expected to
8989 bear the costs and risks associated with spaceport development
9090 and operations;
9191 NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF
9292 REPRESENTATIVES OF THE STATE OF NEW MEXICO that the appropriate
9393 interim legislative committee that studies science, technology
9494 and telecommunications and the revenue stabilization and tax
9595 policy committee be requested to study the provisions,
9696 execution and impacts of the Regional Spaceport District Act
9797 and the Spaceport Development Act, specifically examining House
9898 Bill 396 of the first session of the fifty-seventh legislature

130130 BE IT FURTHER RESOLVED that the interim legislative
131131 committees be requested to examine potential reforms to the
132132 Regional Spaceport District Act and the Spaceport Development
133133 Act and make recommendations for legislation for the second
134134 session of the fifty-seventh legislature; and
135135 BE IT FURTHER RESOLVED that copies of this memorial be
136136 transmitted to the co-chairs of the New Mexico legislative
137137 council, the director of the legislative council service,
138138 members of the spaceport authority and members of all regional
139139 spaceport districts.
