33	33	REQUESTING THE APPROPRIATE INTERIM LEGISLATIVE COMMITTEES TO
34	34	STUDY ISSUES STEMMING FROM THE REGIONAL SPACEPORT DISTRICT ACT
35	35	AND THE SPACEPORT DEVELOPMENT ACT AND MAKE RECOMMENDATIONS.
36	36	WHEREAS, nearly twenty years ago, the Regional Spaceport
37	37	District Act and the Spaceport Development Act were enacted to
38	38	provide a framework for the establishment of spaceports in New
39	39	Mexico and grow the state's aerospace industry; and
40	40	WHEREAS, these acts have provided a strong inception to
41	41	spaceport America and New Mexico's aerospace industry, but
42	42	issues have emerged; and
43	43	WHEREAS, the acts allow for discrepancies in the financial
44	44	contributions of governmental units relative to their
45	45	representation and the lack of ability of the governmental
46	46	units to exercise control over their financial destiny and

75	75	WHEREAS, there is a substantial imbalance between the
76	76	level of contributions made by counties and the counties'
77	77	representation on the board and in the decision-making
78	78	processes; and
79	79	WHEREAS, these imbalanced financial obligations and
80	80	contributions of governmental units can continue to be
81	81	determined and imposed without the governmental unit's
82	82	agreement; and
83	83	WHEREAS, these concerns warrant a thorough and deliberate
84	84	examination to ensure that the interests of all local
85	85	governments and constituents are fairly represented, that
86	86	financial responsibilities are clearly defined and properly
87	87	managed and that the governance structure reflects the
88	88	realities of contributions made by those who are expected to
89	89	bear the costs and risks associated with spaceport development
90	90	and operations;
91	91	NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF
92	92	REPRESENTATIVES OF THE STATE OF NEW MEXICO that the appropriate
93	93	interim legislative committee that studies science, technology
94	94	and telecommunications and the revenue stabilization and tax
95	95	policy committee be requested to study the provisions,
96	96	execution and impacts of the Regional Spaceport District Act
97	97	and the Spaceport Development Act, specifically examining House
98	98	Bill 396 of the first session of the fifty-seventh legislature

130	130	BE IT FURTHER RESOLVED that the interim legislative
131	131	committees be requested to examine potential reforms to the
132	132	Regional Spaceport District Act and the Spaceport Development
133	133	Act and make recommendations for legislation for the second
134	134	session of the fifty-seventh legislature; and
135	135	BE IT FURTHER RESOLVED that copies of this memorial be
136	136	transmitted to the co-chairs of the New Mexico legislative
137	137	council, the director of the legislative council service,
138	138	members of the spaceport authority and members of all regional
139	139	spaceport districts.
