54	54	STUDENT HEALTH AND SAFETY, PROMOTE ENVIRONMENTAL PROTECTION AND
55	55	REDUCE THE COSTS OF ENERGY CONSUMPTION; MAKING CONFORMING
56	56	AMENDMENTS TO THE PUBLIC SCHOOL CAPITAL OUTLAY ACT; MAKING AN
57	57	APPROPRIATION.
58	58	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
59	59	SECTION 1. Section 22-24-4.6 NMSA 1978 (being Laws 2015,
60	60	Chapter 93, Section 3, as amended) is amended to read:
61	61	"22-24-4.6. BUILDING SYSTEM REPAIR, RENOVATION OR
62	62	REPLACEMENT.--

90	90	A. The council shall develop guidelines for a
91	91	building system repair, renovation or replacement initiative
92	92	pursuant to the provisions of this section, and, except as
93	93	provided in Section 22-24-13 NMSA 1978, those guidelines shall
94	94	apply to all applications and grant assistance awards for
95	95	building system repair, renovation or replacement projects .
96	96	B. A school district [desiring a grant award
97	97	pursuant to this section shall submit ] may request grant
98	98	assistance for a building system repair, renovation or
99	99	replacement by submitting an application to the council. The
100	100	application shall include an assessment of the building system
101	101	that, in the opinion of the school district, the repair,
102	102	renovation or replacement of which would extend the useful life
103	103	of the building itself.
104	104	C. Upon receipt of an application , the authority
105	105	shall verify the assessment made by the school district and
106	106	rank the application with similar applications pursuant to a
107	107	methodology adopted by the council.
108	108	D. [After a public hearing and to the extent that
109	109	money is available in the fund for such purposes, the council
110	110	shall approve building system repair, renovation or replacement
111	111	projects on the established priority basis ] The council shall
112	112	review an application at a public hearing and, subject to
113	113	availability of money in the fund, approve grant assistance for
114	114	building system repair, renovation or replacement projects in

143	143	accordance with the priorities adopted by the council ; provided
144	144	that no project shall be approved unless the council determines
145	145	that the school district is willing and able to pay the portion
146	146	of the total cost of the project that is not funded with grant
147	147	assistance from the fund.
148	148	E. The [state share] state's and school district's
149	149	shares of the total cost of an approved building system repair,
150	150	renovation or replacement project shall be calculated pursuant
151	151	to the methodology in Subsection B of Section 22-24-5 NMSA
152	152	1978.
153	153	F. A grant made pursuant to this section shall be
154	154	expended by the school district within three years of the grant
155	155	allocation."
156	156	SECTION 2. A new section of the Public School Capital
157	157	Outlay Act, Section 22-24-13 NMSA 1978, is enacted to read:
158	158	"22-24-13. [NEW MATERIAL ] BUILDING SYSTEM INNOVATION
159	159	PROJECT INITIATIVE.--
160	160	A. As used in this section, "building system
161	161	innovation project" means a building system replacement project
162	162	that involves the concerted replacement of a heating,
163	163	ventilation and air conditioning system and an electrical
164	164	distribution system.
165	165	B. Beginning July 1, 2025, a school district may
166	166	submit an application for grant assistance for a building
167	167	system innovation project to the council. The application

197	197	(1) an assessment of the existing heating,
198	198	ventilation and air conditioning and electrical distribution
199	199	systems; and
200	200	(2) a description of desired replacement
201	201	systems that, in the opinion of the school district, will
202	202	extend the useful life of the building, promote student health
203	203	and safety, promote environmental improvement and reduce the
204	204	costs of energy consumption.
205	205	C. The authority shall verify the assessment and
206	206	evaluate the description submitted with an application and rank
207	207	the application with other grant assistance applications for
208	208	building system innovation projects in accordance with council
209	209	rules.
210	210	D. The council shall review an application at a
211	211	public hearing and, subject to availability of money in the
212	212	fund for that purpose, approve the application if the council
213	213	determines that the building system innovation project is
214	214	likely to extend the useful life of the building, promote
215	215	student health and safety, promote environmental improvement
216	216	and reduce the costs of energy consumption.
217	217	E. The council shall prioritize applications for
218	218	building system innovation projects that:
219	219	(1) are eligible to receive federal funding;
220	220	(2) include the replacement of an evaporative

250	250	(3) utilize photovoltaic technology in the
251	251	electrical distribution system.
252	252	F. The state's and school district's shares of the
253	253	total cost of a project shall be calculated in accordance with
254	254	Subsection B of Section 22-24-5 NMSA 1978. The council shall
255	255	not approve an application unless it determines that the school
256	256	district is willing and able to pay the school district's share
257	257	of the total cost of a project.
258	258	G. Grant assistance awarded pursuant to this
259	259	section shall be expended by the school district within three
260	260	years from the date the council approved the application."
261	261	SECTION 3. APPROPRIATION.--Ten million dollars
262	262	($10,000,000) is appropriated from the general fund to the
263	263	public school capital outlay fund for expenditure in fiscal
264	264	year 2026 and subsequent fiscal years to provide grant
265	265	assistance for building system innovation projects. Any
266	266	unexpended or unencumbered balance remaining at the end of a
267	267	fiscal year shall not revert to the general fund.
