49	49	RELATING TO CHILDREN; ENACTING THE EXCLUSIONARY PRACTICES ACT;

51	51	CHILDREN IN AN EARLY PRE-KINDERGARTEN OR PRE-KINDERGARTEN
52	52	PROGRAM OR IN A LICENSED CHILD CARE FACILITY; PROVIDING
53	53	EXCEPTIONS; REQUIRING REPORTING.
54	54	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
55	55	SECTION 1. A new section of the Children's Code is
56	56	enacted to read:
57	57	"[NEW MATERIAL] SHORT TITLE.--This act may be cited as the
58	58	"Exclusionary Practices Act"."
59	59	SECTION 2. A new section of the Children's Code is
60	60	enacted to read:
61	61	"[NEW MATERIAL] DEFINITIONS.--As used in the Exclusionary
62	62	Practices Act:

90	90	A. "enrolling entity" means any community- or
91	91	school-based pre-kindergarten or early pre-kindergarten program
92	92	or any licensed child care facility in New Mexico that serves
93	93	children aged six weeks through five years;
94	94	B. "expulsion" means the permanent removal or
95	95	dismissal of a child from a program or facility and includes a
96	96	soft expulsion;
97	97	C. "in-school suspension" means the removal or
98	98	exclusion of a child from the general classroom or program
99	99	setting to another setting;
100	100	D. "out-of-school suspension" means the temporary
101	101	removal of a child from the classroom or program setting; and
102	102	E. "soft expulsion" means a practice that makes the
103	103	program an unviable or unwelcoming care arrangement and leaves
104	104	a parent or legal guardian with little choice other than to
105	105	withdraw the child."
106	106	SECTION 3. A new section of the Children's Code is
107	107	enacted to read:
108	108	"[NEW MATERIAL] EXPULSION--OUT-OF-SCHOOL SUSPENSION--
109	109	PROHIBITED--EXCEPTIONS.--
110	110	A. An enrolling entity shall not expel a child for
111	111	a reason related to the child's behavior or for a disciplinary
112	112	reason.
113	113	B. An enrolling entity shall not in-school or
114	114	out-of-school suspend a child for a reason related to the

143	143	child's behavior or for a disciplinary reason, unless it is
144	144	determined by the enrolling entity that the child has willfully
145	145	caused or attempted to cause bodily injury or threatened
146	146	serious bodily injury to another person, except in
147	147	self-defense. The length of an out-of-school suspension given
148	148	pursuant to this subsection shall not exceed three school days
149	149	for any individual incident.
150	150	C. Planned transitions to settings that are jointly
151	151	agreed upon by the parent or legal guardian of a child and an
152	152	enrolling entity to better meet a child's needs shall not be
153	153	considered a suspension or expulsion so long as the enrolling
154	154	entity did not create the conditions to encourage the parent or
155	155	legal guardian to withdraw their child.
156	156	D. A request by an enrolling entity that a parent
157	157	or legal guardian remove a child for disciplinary reasons from
158	158	the enrolling entity for any length of time during the day
159	159	constitutes an out-of-school suspension and is subject to the
160	160	requirements of this section.
161	161	E. Changes to services for a child with an
162	162	individualized education program or individual family service
163	163	plan shall be construed in a manner consistent with the federal
164	164	Individuals with Disabilities Education Act.
165	165	F. Nothing in this section shall:
166	166	(1) preclude the right of a parent or legal
167	167	guardian to voluntarily withdraw the parent's or legal

197	197	(2) prevent an enrolling entity from
198	198	suspending, expelling or disenrolling a child for reasons
199	199	outside of those stated in the Exclusionary Practices Act and
200	200	unrelated to discipline or a child's behavior."
201	201	SECTION 4. A new section of the Children's Code is
202	202	enacted to read:
203	203	"[NEW MATERIAL] REPORTING REQUIREMENTS.--An enrolling
204	204	entity shall report to the early childhood education and care
205	205	department a disenrollment, expulsion or suspension of a child
206	206	in the manner and on forms required by that department."
207	207	SECTION 5. A new section of the Children's Code is
208	208	enacted to read:
209	209	"[NEW MATERIAL] RULEMAKING AUTHORITY.--The early childhood
210	210	education and care department shall promulgate rules necessary
211	211	to carry out the provisions and requirements of the
212	212	Exclusionary Practices Act."
213	213	SECTION 6. EFFECTIVE DATE.--The effective date of the
214	214	provisions of this act is July 1, 2025.
