4949 RELATING TO CANNABIS; ALLOWING COUNTIES TO PETITION THE
5050 CANNABIS CONTROL DIVISION OF THE REGULATION AND LICENSING
5151 DEPARTMENT FOR A MORATORIUM ON NEW CANNABIS PRODUCER LICENSES.
5252 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5353 SECTION 1. A new section of the Cannabis Regulation Act
5454 is enacted to read:
5555 "[NEW MATERIAL] NEW CANNABIS PRODUCER LICENSE MORATORIUM--
5656 COUNTY PETITION.--
5757 A. A board of county commissioners may vote to
5858 petition the division to impose a two-year moratorium on the
5959 issuance of new cannabis producer licenses in that county and
6060 shall publish a public notice of its petition and notify the
6161 division. The petition may cover commercial cannabis
6262 production only or both commercial and medical cannabis

9191 B. The county shall submit the petition to the
9292 division within ten days of approving the petition. The
9393 division shall render its decision on the petition within ten
9494 days of receipt of the petition and inform the county of its
9595 decision to approve or deny the petition. If the division
9696 approves the petition, it shall not issue new cannabis
9797 production licenses for the two-year period of the moratorium.
9898 If the division denies the petition, it shall include its
9999 findings and conclusions in the order of denial.
100100 C. The county may petition the division to end the
101101 moratorium before the two-year period has run if the county
102102 commission determines that the moratorium is no longer
103103 necessary."
