49	49	RELATING TO CANNABIS; ALLOWING COUNTIES TO PETITION THE
50	50	CANNABIS CONTROL DIVISION OF THE REGULATION AND LICENSING
51	51	DEPARTMENT FOR A MORATORIUM ON NEW CANNABIS PRODUCER LICENSES.
52	52	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
53	53	SECTION 1. A new section of the Cannabis Regulation Act
54	54	is enacted to read:
55	55	"[NEW MATERIAL] NEW CANNABIS PRODUCER LICENSE MORATORIUM--
56	56	COUNTY PETITION.--
57	57	A. A board of county commissioners may vote to
58	58	petition the division to impose a two-year moratorium on the
59	59	issuance of new cannabis producer licenses in that county and
60	60	shall publish a public notice of its petition and notify the
61	61	division. The petition may cover commercial cannabis
62	62	production only or both commercial and medical cannabis

91	91	B. The county shall submit the petition to the
92	92	division within ten days of approving the petition. The
93	93	division shall render its decision on the petition within ten
94	94	days of receipt of the petition and inform the county of its
95	95	decision to approve or deny the petition. If the division
96	96	approves the petition, it shall not issue new cannabis
97	97	production licenses for the two-year period of the moratorium.
98	98	If the division denies the petition, it shall include its
99	99	findings and conclusions in the order of denial.
100	100	C. The county may petition the division to end the
101	101	moratorium before the two-year period has run if the county
102	102	commission determines that the moratorium is no longer
103	103	necessary."
