49	49	RELATING TO LARCENY; REMOVING "DWELLING" FROM AGGRAVATED
50	50	BURGLARY; CREATING THE CRIME OF HOME INVASION; PROVIDING A

52	52	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
53	53	SECTION 1. Section 30-16-4 NMSA 1978 (being Laws 1963,
54	54	Chapter 303, Section 16-4) is amended to read:
55	55	"30-16-4. AGGRAVATED BURGLARY.--
56	56	A. Aggravated burglary consists of the unauthorized
57	57	entry of [any] a vehicle, a watercraft, an aircraft [dwelling]
58	58	or other structure, movable or immovable, with intent to commit
59	59	[any] a felony or theft [therein ] in it and the person either:
60	60	[A.] (1) is armed with a deadly weapon;
61	61	[B.] (2) after entering, [arms himself ] is
62	62	armed with a deadly weapon; or

93	93	B. Whoever commits aggravated burglary is guilty of
94	94	a second degree felony."
95	95	SECTION 2. A new Section 30-16-4.1 NMSA 1978 is enacted
96	96	to read:
97	97	"30-16-4.1. [NEW MATERIAL ] HOME INVASION.--
98	98	A. Home invasion consists of the unlawful entry of
99	99	a dwelling while an occupant is inside with the intent to
100	100	commit a felony or theft in it and the person either:
101	101	(1) is armed with a deadly weapon;
102	102	(2) after entering, is armed with a deadly
103	103	weapon; or
104	104	(3) commits any unlawful act, threat or
105	105	menacing conduct that causes another person to reasonably
106	106	believe that the person is in danger of receiving an immediate
107	107	battery.
108	108	B. Whoever commits home invasion is guilty of a
109	109	second degree felony."
