49	49	RELATING TO MOTOR VEHICLES; LIMITING A COURT'S ABILITY TO DEFER
50	50	THE SENTENCE OF A PERSON WHO COMMITS A MOVING TRAFFIC
51	51	VIOLATION.
52	52	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
53	53	SECTION 1. A new section of the Motor Vehicle Code,
54	54	Section 66-8-142 NMSA 1978, is enacted to read:
55	55	"66-8-142. [NEW MATERIAL ] MOVING TRAFFIC VIOLATIONS--
56	56	DEFERRED SENTENCES.--
57	57	A. A court shall not defer the sentence of a person
58	58	who commits a moving traffic violation if that person has,
59	59	within the past year, had the sentence for a moving traffic
60	60	violation deferred.
61	61	B. As used in this section, a "moving traffic
62	62	violation" means:

91	91	as provided in Section 66-7-104 NMSA 1978;
92	92	(2) failure to obey traffic-control signals,
93	93	as provided in Section 66-7-105 NMSA 1978;
94	94	(3) speeding, as provided in Section 66-7-301
95	95	NMSA 1978;
96	96	(4) failure to yield, as provided in Sections
97	97	66-7-328 through 66-7-332.1 NMSA 1978;
98	98	(5) reckless driving, as provided in Section
99	99	66-8-113 NMSA 1978;
100	100	(6) careless driving, as provided in Section
101	101	66-8-114 NMSA 1978; or
102	102	(7) racing on highways, as provided in Section
103	103	66-8-115 NMSA 1978."
104	104	SECTION 2. Section 31-20-3 NMSA 1978 (being Laws 1963,
105	105	Chapter 303, Section 29-15, as amended) is amended to read:
106	106	"31-20-3. ORDER DEFERRING OR SUSPENDING SENTENCE--
107	107	DIAGNOSTIC COMMITMENT.--Except as provided in Section 66-8-142
108	108	NMSA 1978, upon entry of a judgment of conviction of any crime
109	109	not constituting a capital or first degree felony, any court
110	110	having jurisdiction, when it is satisfied that the ends of
111	111	justice and the best interest of the public as well as the
112	112	defendant will be served thereby, may either:
113	113	A. enter an order deferring the imposition of
114	114	sentence;

143	143	B. sentence the defendant and enter an order
144	144	suspending in whole or in part the execution of the sentence;
145	145	or
146	146	C. commit the convicted person, if convicted of a
147	147	felony and not committed for diagnostic purposes within the
148	148	twelve-month period immediately preceding that conviction, to
149	149	the [department of] corrections department for an indeterminate
150	150	period not to exceed sixty days for purposes of diagnosis, with
151	151	direction that the court be given a report when the diagnosis
152	152	is complete as to what disposition appears best when the
153	153	[interest] interests of the public and the individual are
154	154	evaluated."
155	155	SECTION 3. APPLICABILITY.--The provisions of this act
156	156	apply to violations of traffic laws that occur on or after the
157	157	effective date of this act.
158	158	SECTION 4. EFFECTIVE DATE.--The effective date of the
159	159	provisions of this act is July 1, 2025.
