5151 SUBDIVISIONS AND STATE AGENCIES IN THE DEFINITION OF
5252 "AUTHORITY"; CLARIFYING THE DEFINITION OF "RIGHT OF WAY".
5353 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5454 SECTION 1. Section 63-9I-2 NMSA 1978 (being Laws 2018,
5555 Chapter 17, Section 2 and Laws 2018, Chapter 69, Section 2) is
5656 amended to read:
5757 "63-9I-2. DEFINITIONS.--As used in the Wireless Consumer
5858 Advanced Infrastructure Investment Act:
5959 A. "antenna" means communications equipment that
6060 transmits or receives electromagnetic radio frequency signals
6161 and that is used to provide wireless services;
6262 B. "applicable codes" means uniform building, fire,

9292 authority, including the local amendments to those codes
9393 enacted by the authority solely to address imminent threats of
9494 destruction of property or injury to persons, to the extent
9595 that those amendments are consistent with the Wireless Consumer
9696 Advanced Infrastructure Investment Act;
9797 C. "applicant" means a wireless provider that
9898 submits an application;
9999 D. "application" means a request submitted by an
100100 applicant to an authority for a permit to collocate one or more
101101 small wireless facilities or to approve the installation,
102102 modification or replacement of a utility pole or wireless
103103 support structure;
104104 E. "authority" means a [municipality or county ]
105105 political subdivision of the state or a state agency ;
106106 F. "authority utility pole" means a utility pole,
107107 owned or operated by an authority, in a right of way;
108108 G. "collocate" means to install, mount, maintain,
109109 modify, operate or replace one or more wireless facilities on,
110110 in or adjacent to a wireless support structure or utility pole;
111111 H. "communications service" means cable service as
112112 defined in 47 U.S.C. Section 522(6), information service as
113113 defined in 47 U.S.C. Section 153(24), mobile service as defined
114114 in 47 U.S.C. Section 153(33), telecommunications service as

145145 I. "fee" means a one-time charge;
146146 J. "law" includes federal, state or local law;
147147 K. "permit" means the written permission of an
148148 authority for a wireless provider to install, mount, maintain,
149149 modify, operate or replace a utility pole or to collocate a
150150 small wireless facility on a utility pole or wireless support
151151 structure;
152152 L. "person":
153153 (1) means an individual, corporation, limited
154154 liability company, partnership, association, trust or other
155155 entity or organization; and
156156 (2) includes an authority;
157157 M. "private easement" means an easement or other
158158 real property right given for the benefit of the grantee of the
159159 easement and the grantee's successors and assigns;
160160 N. "rate" means a recurring charge;
161161 O. "right of way":
162162 (1) means the area on, below or above a public
163163 roadway, highway, street, sidewalk, alley or utility easement;
164164 and
165165 (2) does not include the area on, below or
166166 above:

196196 (b) a state highway or route under the
197197 jurisdiction of the department of transportation ]
198198 (a) a federal or state highway, road or
199199 patrol yard, including patrol yards owned, controlled or
200200 maintained by the department of transportation. The terms
201201 "road" or "highway" include a travel lane, roadside area,
202202 shoulder, median, ditch, culvert, ramp, turnout and
203203 construction or maintenance easement;
204204 [(c)] (b) a private easement; or
205205 [(d)] (c) a utility easement that does
206206 not authorize the deployment sought by a wireless provider;
207207 P. "small wireless facility" means a wireless
208208 facility whose:
209209 (1) antennas are, or could fit, inside an
210210 enclosure with a volume of six or fewer cubic feet; and
211211 (2) other ground- or pole-mounted wireless
212212 equipment, not including the following, is twenty-eight or
213213 fewer cubic feet in volume:
214214 (a) electric meter;
215215 (b) concealment elements;
216216 (c) telecommunications demarcation box;
217217 (d) grounding equipment;
218218 (e) power transfer switch;
219219 (f) cutoff switch;
220220 (g) vertical cable runs for the

250250 (h) elements required by an authority in
251251 accordance with Subsection H of Section [3 of the Wireless
252252 Consumer Advanced Infrastructure Investment Act ] 63-9I-3 NMSA
253253 1978;
254254 Q. "utility pole":
255255 (1) means a pole or similar structure used in
256256 whole or in part for communications services, electricity
257257 distribution, lighting or traffic signals; and
258258 (2) does not include a wireless support
259259 structure or electric transmission structure;
260260 R. "wireless facility":
261261 (1) means equipment at a fixed location that
262262 enables wireless communications between user equipment and a
263263 communications network, including:
264264 (a) equipment associated with wireless
265265 communications; and
266266 (b) radio transceivers, antennas,
267267 coaxial or fiber-optic cables, regular and backup power
268268 supplies and comparable equipment, regardless of technological
269269 configuration;
270270 (2) includes a small wireless facility; and
271271 (3) does not include:
272272 (a) the structure or improvements on,
273273 under or within which the equipment is collocated;

302302 (b) a wireline backhaul facility,
303303 coaxial cable or fiber-optic cable between wireless support
304304 structures or utility poles; or
305305 (c) coaxial or fiber-optic cable
306306 otherwise not immediately adjacent to, or directly associated
307307 with, an antenna;
308308 S. "wireless infrastructure provider" means a
309309 person, other than a wireless services provider, that may
310310 provide telecommunications service in New Mexico and that
311311 builds or installs wireless communications transmission
312312 equipment, wireless facilities' utility poles or wireless
313313 support structures;
314314 T. "wireless provider" means a wireless
315315 infrastructure provider or wireless services provider;
316316 U. "wireless services" means services provided to
317317 the public that use licensed or unlicensed spectrum, either
318318 mobile or at a fixed location, through wireless facilities;
319319 V. "wireless services provider" means a person that
320320 provides wireless services;
321321 W. "wireless support structure" means a
322322 freestanding structure, including a monopole or guyed or
323323 self-supporting tower, but not including a utility pole; and
324324 X. "wireline backhaul facility" means a facility
325325 used to transport services by wire from a wireless facility to
326326 a network."
