52	52	"AUTHORITY"; CLARIFYING THE DEFINITION OF "RIGHT OF WAY".
53	53	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
54	54	SECTION 1. Section 63-9I-2 NMSA 1978 (being Laws 2018,
55	55	Chapter 17, Section 2 and Laws 2018, Chapter 69, Section 2) is
56	56	amended to read:
57	57	"63-9I-2. DEFINITIONS.--As used in the Wireless Consumer
58	58	Advanced Infrastructure Investment Act:
59	59	A. "antenna" means communications equipment that
60	60	transmits or receives electromagnetic radio frequency signals
61	61	and that is used to provide wireless services;
62	62	B. "applicable codes" means uniform building, fire,

91	91	recognized national code organization and enacted by the
92	92	authority, including the local amendments to those codes
93	93	enacted by the authority solely to address imminent threats of
94	94	destruction of property or injury to persons, to the extent
95	95	that those amendments are consistent with the Wireless Consumer
96	96	Advanced Infrastructure Investment Act;
97	97	C. "applicant" means a wireless provider that
98	98	submits an application;
99	99	D. "application" means a request submitted by an
100	100	applicant to an authority for a permit to collocate one or more
101	101	small wireless facilities or to approve the installation,
102	102	modification or replacement of a utility pole or wireless
103	103	support structure;
104	104	E. "authority" means a [municipality or county ]
105	105	political subdivision of the state or a state agency ;
106	106	F. "authority utility pole" means a utility pole,
107	107	owned or operated by an authority, in a right of way;
108	108	G. "collocate" means to install, mount, maintain,
109	109	modify, operate or replace one or more wireless facilities on,
110	110	in or adjacent to a wireless support structure or utility pole;
111	111	H. "communications service" means cable service as
112	112	defined in 47 U.S.C. Section 522(6), information service as
113	113	defined in 47 U.S.C. Section 153(24), mobile service as defined
114	114	in 47 U.S.C. Section 153(33), telecommunications service as

146	146	J. "law" includes federal, state or local law;
147	147	K. "permit" means the written permission of an

150	150	small wireless facility on a utility pole or wireless support
151	151	structure;
152	152	L. "person":
153	153	(1) means an individual, corporation, limited
154	154	liability company, partnership, association, trust or other
155	155	entity or organization; and
156	156	(2) includes an authority;
157	157	M. "private easement" means an easement or other
158	158	real property right given for the benefit of the grantee of the
159	159	easement and the grantee's successors and assigns;
160	160	N. "rate" means a recurring charge;
161	161	O. "right of way":
162	162	(1) means the area on, below or above a public
163	163	roadway, highway, street, sidewalk, alley or utility easement;
164	164	and
165	165	(2) does not include the area on, below or
166	166	above:

201	201	"road" or "highway" include a travel lane, roadside area,
202	202	shoulder, median, ditch, culvert, ramp, turnout and
203	203	construction or maintenance easement;
204	204	[(c)] (b) a private easement; or
205	205	[(d)] (c) a utility easement that does
206	206	not authorize the deployment sought by a wireless provider;
207	207	P. "small wireless facility" means a wireless
208	208	facility whose:
209	209	(1) antennas are, or could fit, inside an
210	210	enclosure with a volume of six or fewer cubic feet; and
211	211	(2) other ground- or pole-mounted wireless
212	212	equipment, not including the following, is twenty-eight or
213	213	fewer cubic feet in volume:
214	214	(a) electric meter;
215	215	(b) concealment elements;
216	216	(c) telecommunications demarcation box;
217	217	(d) grounding equipment;
218	218	(e) power transfer switch;
219	219	(f) cutoff switch;

250	250	(h) elements required by an authority in
251	251	accordance with Subsection H of Section [3 of the Wireless
252	252	Consumer Advanced Infrastructure Investment Act ] 63-9I-3 NMSA

254	254	Q. "utility pole":
255	255	(1) means a pole or similar structure used in
256	256	whole or in part for communications services, electricity
257	257	distribution, lighting or traffic signals; and
258	258	(2) does not include a wireless support
259	259	structure or electric transmission structure;
260	260	R. "wireless facility":
261	261	(1) means equipment at a fixed location that
262	262	enables wireless communications between user equipment and a
263	263	communications network, including:
264	264	(a) equipment associated with wireless
265	265	communications; and
266	266	(b) radio transceivers, antennas,
267	267	coaxial or fiber-optic cables, regular and backup power
268	268	supplies and comparable equipment, regardless of technological
269	269	configuration;
270	270	(2) includes a small wireless facility; and
271	271	(3) does not include:
272	272	(a) the structure or improvements on,
273	273	under or within which the equipment is collocated;

303	303	coaxial cable or fiber-optic cable between wireless support
304	304	structures or utility poles; or
305	305	(c) coaxial or fiber-optic cable
306	306	otherwise not immediately adjacent to, or directly associated
307	307	with, an antenna;
308	308	S. "wireless infrastructure provider" means a
309	309	person, other than a wireless services provider, that may
310	310	provide telecommunications service in New Mexico and that
311	311	builds or installs wireless communications transmission
312	312	equipment, wireless facilities' utility poles or wireless
313	313	support structures;
314	314	T. "wireless provider" means a wireless
315	315	infrastructure provider or wireless services provider;
316	316	U. "wireless services" means services provided to
317	317	the public that use licensed or unlicensed spectrum, either
318	318	mobile or at a fixed location, through wireless facilities;
319	319	V. "wireless services provider" means a person that
320	320	provides wireless services;
321	321	W. "wireless support structure" means a
322	322	freestanding structure, including a monopole or guyed or
323	323	self-supporting tower, but not including a utility pole; and
324	324	X. "wireline backhaul facility" means a facility
325	325	used to transport services by wire from a wireless facility to
326	326	a network."
