4949 RELATING TO ECONOMIC DEVELOPMENT; AMENDING THE LOCAL ECONOMIC
5050 DEVELOPMENT ACT TO PROVIDE NEW QUALIFYING ENTITIES.
5151 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5252 SECTION 1. Section 5-10-3 NMSA 1978 (being Laws 1993,
5353 Chapter 297, Section 3, as amended by Laws 2021, Chapter 3,
5454 Section 1 and by Laws 2021, Chapter 135, Section 1) is amended
5555 to read:
5656 "5-10-3. DEFINITIONS.--As used in the Local Economic
5757 Development Act:
5858 A. "arts and cultural district" means a developed
5959 district of public and private uses that is created pursuant to
6060 the Arts and Cultural District Act;
6161 B. "broadband telecommunications network
6262 facilities" means the electronics, equipment, transmission

9090 facilities, fiber-optic cables and any other item directly
9191 related to a system capable of transmission of internet
9292 protocol or other formatted data at current federal
9393 communications commission baseline speed standard, all of which
9494 will be owned and used by a provider of internet access
9595 services;
9696 C. "cultural facility" means a facility that is
9797 owned by the state, a county, a municipality or a qualifying
9898 entity that serves the public through preserving, educating and
9999 promoting the arts and culture of a particular locale,
100100 including theaters, museums, libraries, galleries, cultural
101101 compounds, educational organizations, performing arts venues
102102 and organizations, fine arts organizations, studios and media
103103 laboratories and live-work housing facilities;
104104 D. "dental clinic" means a person, corporation,
105105 organization, facility or institution licensed or certified by
106106 this state to provide dental health care that does not receive
107107 state government revenues pursuant to the Local Economic
108108 Development Act;
109109 [D.] E. "department" means the economic development
110110 department;
111111 [E.] F. "economic development project" or "project"
112112 means the project of a qualifying entity for which public
113113 support may be provided pursuant to the Local Economic
114114 Development Act;

143143 [F.] G. "governing body" means the city council,
144144 city commission or board of trustees of a municipality or the
145145 board of county commissioners of a county;
146146 H. "independent medical practice" means a person,
147147 corporation, organization, facility or institution licensed or
148148 certified by this state to provide health care or professional
149149 services as or by a doctor of medicine, doctor of osteopathy,
150150 podiatric physician, physician assistant, certified nurse
151151 practitioner or certified nurse-midwife that does not receive
152152 state government revenues pursuant to the Local Economic
153153 Development Act; "independent medical practice" does not
154154 include a hospital licensed in this state or a hospital-
155155 controlled facility;
156156 [G.] I. "local government" means a municipality or
157157 county;
158158 [H.] J. "municipality" means an incorporated city,
159159 town or village;
160160 [I.] K. "new full-time economic base job" means a
161161 job:
162162 (1) that is primarily performed in New Mexico;
163163 (2) that is held by an employee who is hired
164164 to work an average of at least thirty-two hours per week for at
165165 least forty-eight weeks per year;
166166 (3) that is:
167167 (a) involved, directly or in a

196196 supervisory capacity, with the production of: 1) a service;
197197 provided that the majority of the revenue generated from the
198198 service is from sources outside the state; or 2) tangible or
199199 intangible personal property for sale; or
200200 (b) held by an employee who is employed
201201 at a regional, national or international headquarters operation
202202 or at an operation that primarily provides services for other
203203 operations of the qualifying entity that are located outside
204204 the state; and
205205 (4) that is not directly involved with natural
206206 resources extraction or processing, on-site services where the
207207 customer is present for the delivery of the service, retail,
208208 construction or agriculture except for value-added processing
209209 performed on agricultural products that would then be sold for
210210 wholesale or retail consumption;
211211 [J.] L. "person" means an individual, corporation,
212212 association, partnership or other legal entity;
213213 [K.] M. "public support" means the provision of
214214 assistance by the state to a local or regional government or
215215 the provision of direct or indirect assistance to a qualifying
216216 entity by a local or regional government for an economic
217217 development project. "Public support":
218218 (1) includes the provision of:
219219 (a) land, buildings or other
220220 infrastructure, by purchase, lease, grant, construction,

249249 reconstruction, improvement or other acquisition or conveyance;
250250 (b) the placement of new broadband
251251 telecommunications network facilities; provided that the
252252 facilities shall not serve a public facility or location that
253253 already meets federal communications commission baseline speed
254254 standards;
255255 (c) rights-of-way infrastructure,
256256 including trenching and conduit, for the placement of new
257257 broadband telecommunications network facilities;
258258 (d) public works improvements essential
259259 to the location or expansion of a qualifying entity;
260260 (e) payments for professional services
261261 contracts necessary for local or regional governments to
262262 implement a plan or provide public support for a project;
263263 (f) direct loans or grants for land,
264264 buildings or infrastructure;
265265 (g) technical assistance to cultural
266266 facilities;
267267 (h) loan guarantees securing the cost of
268268 land, buildings or infrastructure in an amount not to exceed
269269 the revenue that may be derived from an increment of the: 1)
270270 municipal gross receipts tax imposed at a rate not to exceed
271271 one-fourth percent and dedicated by the ordinance imposing the
272272 increment for projects; or 2) county gross receipts tax imposed
273273 at a rate not to exceed one-eighth percent and dedicated by the

302302 ordinance imposing the increment for projects;
303303 (i) grants for public works
304304 infrastructure improvements essential to the location or
305305 expansion of a qualifying entity and grants or subsidies to
306306 cultural facilities;
307307 (j) land for a publicly held industrial
308308 park or a publicly owned cultural facility, by purchase; and
309309 (k) the construction of a building for
310310 use by a qualifying entity; but
311311 (2) does not include the purchase, lease,
312312 grant or other acquisition or conveyance of water rights;
313313 [L.] N. "qualifying entity" means a corporation,
314314 limited liability company, partnership, joint venture,
315315 syndicate, association or other person that is one or a
316316 combination of two or more of the following:
317317 (1) an industry for the manufacturing,
318318 processing or assembling of agricultural or manufactured
319319 products;
320320 (2) a commercial enterprise for storing,
321321 warehousing, distributing or selling products of agriculture,
322322 mining or industry, but, other than as provided in Paragraph
323323 (5), (6) or [(9)] (12) of this subsection, not including any
324324 enterprise for sale of goods or commodities at retail or for
325325 distribution to the public of electricity, gas, water or
326326 telephone or other services commonly classified as public

356356 (3) a business, including a restaurant or
357357 lodging establishment, in which all or part of the activities
358358 of the business involves the supplying of services to the
359359 general public or to governmental agencies or to a specific
360360 industry or customer, but, other than as provided in Paragraph
361361 (5) or [(9)] (12) of this subsection, not including businesses
362362 primarily engaged in the sale of goods or commodities at
363363 retail;
364364 (4) an Indian nation, tribe or pueblo or a
365365 federally chartered tribal corporation;
366366 (5) a telecommunications sales enterprise that
367367 makes the majority of its sales to persons outside New Mexico;
368368 (6) a facility for the direct sales by growers
369369 of agricultural products, commonly known as farmers' markets;
370370 (7) a business that is the developer of a
371371 metropolitan redevelopment project;
372372 (8) a cultural facility;
373373 (9) an independent medical practice;
374374 (10) a veterinary facility;
375375 (11) a dental clinic; and
376376 [(9)] (12) a retail business;
377377 [M.] O. "regional government" means any combination
378378 of municipalities and counties that enter into a joint powers
379379 agreement to provide public support for economic development

408408 projects pursuant to a plan adopted by all parties to the joint
409409 powers agreement; [and
410410 N.] P. "retail business" means a business that is
411411 primarily engaged in the sale of goods or commodities at retail
412412 and that is located:
413413 (1) in a municipality with a population,
414414 according to the most recent federal decennial census, of:
415415 (a) fifteen thousand or less; or
416416 (b) more than fifteen thousand if the
417417 economic development project is not funded or financed with
418418 state government revenues; or
419419 (2) in an unincorporated area of a county; and
420420 Q. "veterinary facility" means a facility that is
421421 licensed by this state to practice veterinary medicine as
422422 defined pursuant to Section 61-14-2 NMSA 1978 and does not
423423 receive state government revenues pursuant to the Local
424424 Economic Development Act ."
