5555 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5656 SECTION 1. Section 9-8-4 NMSA 1978 (being Laws 1977,
5757 Chapter 252, Section 4, as amended) is amended to read:
5858 "9-8-4. AUTHORITY ESTABLISHED.--The "health care
5959 authority" is created in the executive branch. The authority
6060 is a cabinet department and consists of:

100100 SECTION 2. A new section of the Health Care Authority Act
101101 is enacted to read:
102102 "[NEW MATERIAL] HOMELESSNESS REDUCTION DIVISION--DUTIES.--
103103 A. The homelessness reduction division of the
104104 authority shall be led by the director of homelessness
105105 reduction, who shall lead the state's comprehensive efforts
106106 related to homelessness prevention and serve as a policymaker
107107 and spokesperson on homelessness prevention, including
108108 coordinating the state's efforts through legislation, rules and
109109 budgets, and shall communicate with federal and local experts
110110 on issues related to homelessness.
111111 B. The homelessness reduction division shall:
112112 (1) develop and facilitate the implementation
113113 of a statewide strategic homelessness reduction plan directed

144144 unnecessary institutionalization in the state;
145145 (b) improving health and human services
146146 outcomes for persons who experience homelessness; and
147147 (c) strengthening the safety nets that
148148 contribute to housing stability;
149149 (2) create a statewide data system, which
150150 shall be known as the "homeless data integration system", that
151151 shall collect local data through homeless management
152152 information systems with the goal of matching data on
153153 homelessness to programs impacting homeless recipients of state
154154 programs;
155155 (3) specify the form and substance of the
156156 required data elements of the homeless data integration system
157157 and may, as required by operational necessity, amend or modify
158158 data elements, disclosure formats or disclosure frequency;
159159 (4) identify mainstream resources, benefits
160160 and services that can be accessed to prevent and end
161161 homelessness in New Mexico;
162162 (5) coordinate efforts to reduce homelessness
163163 across state agencies;
164164 (6) serve within state government and in the
165165 state at large as an advocate for persons experiencing
166166 homelessness; and
167167 (7) provide leadership for and collaborate

199199 C. Upon the creation of the homeless data
200200 integration system, all continuums of care operating in New
201201 Mexico shall provide collected data elements, including health
202202 information, in a manner consistent with federal law, to the
203203 homeless data integration system.
204204 D. Health information or personal identifying
205205 information provided to or maintained within the homeless data
206206 integration system shall not be subject to inspection pursuant
207207 to the Inspection of Public Records Act."
208208 SECTION 3. A new section of the Health Care Authority Act
209209 is enacted to read:
210210 "[NEW MATERIAL] INTERAGENCY HOMELESSNESS REDUCTION TASK
211211 FORCE--CREATED--DUTIES.--
212212 A. The "interagency homelessness reduction task
213213 force" is created and is administratively attached to the
214214 authority. The task force consists of the following members:
215215 (1) the director of the homelessness reduction
216216 division of the authority;
217217 (2) the chief executive officer of the New
218218 Mexico finance authority or the chief executive officer's
219219 designee;
220220 (3) the secretary of economic development or

302302 (16) the chair of the homelessness reduction
303303 advisory council.
304304 B. The chair of the interagency homelessness
305305 reduction task force shall be the director of the homelessness
306306 reduction division of the authority or the director's designee,
307307 and the vice chair of the task force shall be the chair of the
308308 homelessness reduction advisory council. The task force shall
309309 meet at the call of the chair.
310310 C. The interagency homelessness reduction task
311311 force shall advise the homelessness reduction division
312312 regarding initiatives related to decreasing homelessness and
313313 unnecessary institutionalization in New Mexico, improving
314314 health and human services outcomes for persons who experience
315315 homelessness and strengthening the safety nets that contribute
316316 to housing stability.
317317 D. The interagency homelessness reduction task
318318 force shall:
319319 (1) recommend policy, regulatory and resource
320320 changes necessary to accomplish goals and objectives set forth
321321 in the statewide strategic homelessness reduction plan;
322322 (2) recommend the resources needed for
323323 successful implementation of the statewide strategic
324324 homelessness reduction plan and oversee that implementation;
325325 (3) recommend and promote effective
326326 interagency collaboration and system integration to converge

355355 related efforts to draft policy recommendations related to the
356356 intersection of homelessness and poverty; and
357357 (4) recommend policy, regulatory and resource-
358358 distribution changes that will help ensure accountability,
359359 results and sustained success in reducing homelessness,
360360 including specific legislative proposals and recommendations
361361 for consideration.
362362 E. The interagency homelessness reduction task
363363 force may solicit feedback from stakeholders and advocates to
364364 advise the task force on policy and implementation
365365 recommendations.
366366 F. On or before October 1, 2025, and each year
367367 thereafter, the interagency homelessness reduction task force
368368 shall submit a report to the governor, the appropriate interim
369369 legislative committee, the legislative finance committee and
370370 the homelessness reduction division regarding:
371371 (1) the task force's work during the prior
372372 fiscal year;
373373 (2) recommendations developed by the task
374374 force and those made by the homelessness reduction advisory
375375 council regarding implementation of the statewide strategic
376376 homelessness reduction plan and initiatives; and
377377 (3) key outcomes and measures related to
378378 homelessness in New Mexico."

409409 "[NEW MATERIAL] HOMELESSNESS REDUCTION ADVISORY COUNCIL--
410410 CREATED--DUTIES--MEMBERSHIP.--
411411 A. The "homelessness reduction advisory council" is
412412 created and is administratively attached to the authority. The
413413 advisory council shall advise and make recommendations to the
414414 interagency homelessness reduction task force and the director
415415 of the homelessness reduction division of the authority
416416 regarding:
417417 (1) homelessness and unnecessary
418418 institutionalization with the goals of reducing and preventing
419419 homelessness;
420420 (2) improving health and human services
421421 outcomes for persons experiencing homelessness;
422422 (3) strengthening the safety nets that
423423 contribute to housing stability; and
424424 (4) developing and achieving the goals of the
425425 statewide strategic homelessness reduction plan and initiatives
426426 pursuant to the provisions of Section 2 of this 2025 act.
427427 B. The homelessness reduction advisory council
428428 consists of the following members appointed by the governor,
429429 who shall reflect the racial, ethnic and geographic diversity
430430 of New Mexico:
431431 (1) three members with lived experience of
432432 homelessness or housing insecurity, which may include formerly

461461 incarcerated persons, veterans and individuals sixteen to
462462 twenty-five years of age;
463463 (2) one member representing individuals with
464464 disabilities;
465465 (3) two members representing the philanthropic
466466 private-funding sector;
467467 (4) one member representing a statewide
468468 behavioral health advocacy organization;
469469 (5) one member representing a statewide
470470 housing advocacy organization;
471471 (6) two members representing local continuums
472472 of care organizations;
473473 (7) three members representing regional or
474474 local units of government;
475475 (8) one member representing an organization
476476 that supports victims of domestic violence; and
477477 (9) four members representing providers of the
478478 homeless response system, including emergency supportive
479479 housing, rapid rehousing, permanent supportive housing,
480480 homeless youth programs and homelessness prevention.
481481 C. The director of the homelessness reduction
482482 division may appoint as ex-officio, nonvoting members of the
483483 homelessness reduction advisory council any state agency staff
484484 the director deems necessary.
485485 D. The chair of the homelessness reduction advisory

516516 E. Public members of the homelessness reduction
517517 advisory council may receive per diem and mileage pursuant to
518518 the Per Diem and Mileage Act.
519519 F. The authority shall provide the necessary staff
520520 and administrative support to the homelessness reduction
521521 advisory council.
522522 G. On or before September 1, 2025, and each year
523523 thereafter, the homelessness reduction advisory council shall
524524 submit its findings and recommendations to the interagency
525525 homelessness reduction task force."
526526 SECTION 5. APPROPRIATION.--One million dollars
527527 ($1,000,000) is appropriated from the general fund to the
528528 health care authority for expenditure in fiscal year 2026 to
529529 fund the operation of the homelessness reduction division of
530530 the health care authority, the interagency homelessness
531531 reduction task force and the homelessness reduction advisory
532532 council. Any unexpended or unencumbered balance remaining at
533533 the end of fiscal year 2026 shall revert to the general fund.
534534 SECTION 6. EFFECTIVE DATE.--The effective date of the
535535 provisions of this act is July 1, 2025.
