5454 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5555 SECTION 1. A new section of the Massage Therapy Practice
5656 Act is enacted to read:
5757 "[NEW MATERIAL] REQUIREMENTS FOR LICENSURE OF MASSAGE
5858 THERAPY ESTABLISHMENTS.--
5959 A. The board shall establish by rule procedures for
6060 the licensure of massage therapy establishments and shall issue
6161 a license to massage therapy establishments that meet the
6262 requirements of the Massage Therapy Practice Act and rules

9393 SECTION 2. A new section of the Massage Therapy Practice
9494 Act is enacted to read:
9595 "[NEW MATERIAL] MASSAGE THERAPY ESTABLISHMENT LICENSURE,
9696 RENEWAL, SUSPENSION AND REVOCATION--APPLICABILITY.--
9797 A. On or after January 1, 2026, a person shall not
9898 maintain, manage or operate a massage therapy establishment
9999 unless the establishment is a licensed massage therapy
100100 establishment.
101101 B. Massage therapy establishment licenses shall
102102 expire biennially. Expiration dates shall be established by
103103 rule of the board.
104104 C. A license shall be renewed by submitting a
105105 renewal application on a form provided by the board.
106106 D. A sixty-day grace period shall be allowed each
107107 licensee after the end of the renewal period, during which time
108108 a license may be renewed upon payment of the renewal fee and a
109109 late fee as prescribed by the board.
110110 E. Proceedings to determine whether to suspend or
111111 revoke the license of a massage therapy establishment may be
112112 instituted by sworn complaint of any individual, including
113113 members of the board, and shall conform with the provisions of
114114 the Uniform Licensing Act."

143143 SECTION 3. Section 61-12C-3 NMSA 1978 (being Laws 1991,
144144 Chapter 147, Section 3, as amended) is amended to read:
145145 "61-12C-3. DEFINITIONS.--As used in the Massage Therapy
146146 Practice Act:
147147 A. "board" means the massage therapy board;
148148 B. "continuing education" means courses, seminars,
149149 workshops and classes in areas related to the practice of
150150 massage therapy, such as:
151151 (1) massage;
152152 (2) bodywork;
153153 (3) health care;

155155 (5) anatomy and physiology;

197197 C. "continuing education provider" means:
198198 (1) an individual who was an active
199199 New Mexico registered independent massage therapy instructor on
200200 [the effective date of this 2019 act ] February 4, 2019;
201201 (2) a massage therapy school regulated by the
202202 requisite regulatory agency where the massage therapy school is
203203 located;
204204 (3) a national or international professional
205205 association for massage therapists;
206206 (4) an individual or an organization approved
207207 by a national or international massage therapy continuing
208208 education approval agency;
209209 (5) a health care professional organization;
210210 or
211211 (6) accredited post-secondary educational
212212 institutions;
213213 D. "department" means the regulation and licensing
214214 department;
215215 E. "home-based establishment" means a physical
216216 premises where massage therapy may be offered by not more than
217217 two licensed massage therapists who personally reside at the
218218 premises, the massage therapy offered is only incidental and
219219 secondary to the use of the premises for a dwelling and the use
220220 of the premises for the offering of massage therapy is in

249249 compliance with any applicable county or municipal zoning or
250250 business licensing requirements;
251251 [E.] F. "jurisprudence" means the statutes and
252252 rules of the state pertaining to the practice of massage
253253 therapy;
254254 [F.] G. "massage therapist" means an individual
255255 licensed to practice massage therapy pursuant to the Massage
256256 Therapy Practice Act;
257257 [G.] H. "massage therapy" means the treatment of
258258 soft tissues for therapeutic purposes, primarily comfort and
259259 relief of pain; it is a health care service that includes
260260 gliding, kneading, percussion, compression, vibration,
261261 friction, nerve strokes, stretching the tissue and exercising
262262 the range of motion and may include the use of oils, salt
263263 glows, hot or cold packs or hydrotherapy. Synonymous terms for
264264 massage therapy include massage, therapeutic massage, body
265265 massage, myomassage, bodywork, body rub or any derivation of
266266 those terms. "Massage therapy" does not include the diagnosis
267267 or treatment of illness or disease or any service or procedure
268268 for which a license to practice medicine, nursing,
269269 chiropractic, physical therapy, occupational therapy,
270270 acupuncture or podiatry is required by law; [and ]
271271 I. "massage therapy establishment" or "massage
272272 establishment" means a place of business in which massage
273273 therapy is offered or performed but shall not include:

303303 to Section 24A-1-5 NMSA 1978;
304304 (2) a health care facility owned, managed or
305305 operated by a federal agency of the United States, including
306306 the department of defense, the veterans health administration
307307 and the bureau of Indian affairs of the department of the
308308 interior;
309309 (3) a health care facility authorized under
310310 Chapter 23 NMSA 1978;
311311 (4) health care offices owned, or directly
312312 operated or managed on a daily basis, by an individual or
313313 individuals licensed pursuant to:
314314 (a) the Medical Practice Act;
315315 (b) the Chiropractic Physician Practice
316316 Act;
317317 (c) the Physician Assistant Act;
318318 (d) the Physical Therapy Act; or
319319 (e) the Nursing Practice Act;
320320 (5) a home-based establishment; and
321321 (6) services provided by a licensed massage
322322 therapist to a client at a premises selected by the client to
323323 receive massage therapy, such as the client's home or place of
324324 business, and such premises is not under the ownership, custody
325325 or control of the massage therapist; and
326326 [H.] J. "massage therapy school" means a facility

356356 registered with the board."
357357 SECTION 4. Section 61-12C-8 NMSA 1978 (being Laws 1991,
358358 Chapter 147, Section 8, as amended) is amended to read:
359359 "61-12C-8. BOARD POWERS.--The board has the power to:
360360 A. adopt and file, in accordance with the State
361361 Rules Act, rules necessary to carry out the provisions of the
362362 Massage Therapy Practice Act, in accordance with the provisions
363363 of the Uniform Licensing Act;
364364 B. provide for the evaluation of the qualifications
365365 of applicants for licensure as a massage therapist or
366366 registration as a massage therapy school under the Massage
367367 Therapy Practice Act;
368368 C. provide for the issuance of massage therapist
369369 licenses to applicants who meet the requirements of the Massage
370370 Therapy Practice Act;
371371 D. establish minimum curricula for massage therapy
372372 schools and provide for the issuance and revocation of massage
373373 therapy school registrations;
374374 E. establish minimum standards for massage therapy
375375 establishments and provide for the issuance and revocation of
376376 massage therapy establishment licenses;
377377 [E.] F. establish instructor qualifications for
378378 hands-on massage therapy instruction within the minimum
379379 curricula;

409409 of the business premises of any licensee or registrant [during
410410 regular business hours ] as follows:
411411 (1) inspections of massage establishments may
412412 be conducted at any time, including when the massage
413413 establishment is in operation or customers are present; and
414414 (2) the licensee or operator of a massage
415415 establishment shall be given an opportunity to accompany the
416416 board official conducting an inspection and to receive a report
417417 of the inspection within fourteen days after the inspection ;
418418 [G.] H. establish minimum training and educational
419419 standards for licensure as a massage therapist;
420420 [H.] I. pursuant to the Uniform Licensing Act,
421421 conduct hearings on charges against applicants or licensees and
422422 take actions described in Section 61-1-3 NMSA 1978;
423423 [I.] J. bring an action for injunctive relief in
424424 district court seeking to enjoin a person from violating the
425425 provisions of the Massage Therapy Practice Act;
426426 [J.] K. issue cease and desist orders to persons
427427 violating the provisions of the Massage Therapy Practice Act or
428428 any rule adopted by the board pursuant to that act;
429429 [K.] L. adopt an annual budget;
430430 [L.] M. adopt a code of professional conduct for
431431 massage therapists;
432432 [M.] N. provide for the investigation of complaints

465465 SECTION 5. Section 61-12C-11 NMSA 1978 (being Laws 1991,
466466 Chapter 147, Section 11, as amended) is amended to read:
467467 "61-12C-11. DISPLAY OF LICENSE OR REGISTRATION.--
468468 A. A massage therapy license or registration issued
469469 by the board shall at all times be posted in a conspicuous
470470 place in the holder's principal place of business.
471471 B. An original or renewal massage therapy license
472472 or registration issued by the board on or after July 1, 2025
473473 shall include a current photograph of the licensee or
474474 registration holder."
475475 SECTION 6. Section 61-12C-17 NMSA 1978 (being Laws 1991,
476476 Chapter 147, Section 17, as amended) is amended to read:
477477 "61-12C-17. LICENSE RENEWAL--CONTINUING EDUCATION.--
478478 A. Except as provided for initial licensure in
479479 Subsection B of Section 61-12C-9 NMSA 1978, massage therapy
480480 licenses shall expire biennially. Expiration dates shall be
481481 established by rule.
482482 B. The board may establish continuing education
483483 requirements as a condition of the renewal of massage therapy
484484 licenses.

517517 D. A continuing education provider who is an
518518 individual who was an active New Mexico registered independent
519519 massage therapy instructor on [the effective date of this 2019
520520 act] February 4, 2019 shall submit to the board a syllabus and
521521 one-time fee for any course not previously approved by the
522522 board.
523523 E. Within thirty days of application, the board may
524524 approve or deny the application of an individual who is not a
525525 continuing education provider to offer a particular continuing
526526 education course; provided that the individual submits:
527527 (1) a copy of any relevant license;
528528 (2) proof of a minimum of two years'
529529 experience in the area of instruction;
530530 (3) a course syllabus for the proposed course;
531531 (4) a resume; and
532532 (5) a one-time fee to be determined by the
533533 board by rule.
534534 F. A license shall be renewed by submitting a
535535 renewal application on a form provided by the board.
536536 G. A sixty-day grace period shall be allowed each
537537 licensee after the end of the renewal period, during which time
538538 a license may be renewed upon payment of the renewal fee and a

568568 SECTION 7. Section 61-12C-18 NMSA 1978 (being Laws 1991,
569569 Chapter 147, Section 18, as amended) is amended to read:
570570 "61-12C-18. INACTIVE STATUS.--
571571 A. A massage therapy license not renewed at the end
572572 of the sixty-day grace period shall be placed on inactive
573573 status for a period not to exceed two years. At the end of two
574574 years, if the license has not been reactivated, it shall
575575 automatically expire.
576576 B. If within a period of two years from the date
577577 the license was placed on inactive status the licensee wishes
578578 to resume practice, the licensee shall notify the board in
579579 writing, and, upon proof of completion of any continuing
580580 education or refresher courses prescribed by rule of the board
581581 and payment of an amount set by the board in lieu of all lapsed
582582 renewal fees, the license shall be restored in full.
583583 C. A massage therapy establishment license not
584584 renewed at the end of the sixty-day grace period shall be
585585 placed on inactive status for a period not to exceed two years.
586586 At the end of two years, if the license has not been
587587 reactivated, it shall automatically expire.
588588 D. If within a period of two years from the date
589589 the license was placed on inactive status the licensee wishes
590590 to resume maintenance, management or operation of the massage
591591 therapy establishment, the licensee shall notify the board in

624624 SECTION 8. Section 61-12C-24 NMSA 1978 (being Laws 1991,
625625 Chapter 147, Section 24, as amended) is amended to read:
626626 "61-12C-24. SUSPENSION, REVOCATION AND REINSTATEMENT OF
627627 LICENSES.--
628628 A. Pursuant to the Uniform Licensing Act, the board
629629 may take disciplinary action against an individual licensed
630630 pursuant to the Massage Therapy Practice Act.
631631 B. The board has authority to take an action set
632632 forth in Section 61-1-3 NMSA 1978 upon a finding by the board
633633 that the licensee:
634634 (1) is guilty of fraud, deceit or
635635 misrepresentation;
636636 (2) attempted to use as the licensee's own the
637637 license of another;
638638 (3) allowed the use of the licensee's license
639639 by another;
640640 (4) has been adjudicated as mentally
641641 incompetent by regularly constituted authorities;
642642 (5) has been convicted of a crime that
643643 substantially relates to the qualifications, functions or
644644 duties of a massage therapist. A copy of the record of

675675 (6) is guilty of unprofessional or unethical
676676 conduct or a violation of the code of ethics;
677677 (7) is habitually or excessively using
678678 controlled substances or alcohol;
679679 (8) is guilty of false, deceptive or
680680 misleading advertising;
681681 (9) is guilty of aiding, assisting or
682682 advertising an unlicensed individual in the practice of massage
683683 therapy;
684684 (10) is grossly negligent or incompetent in
685685 the practice of massage therapy;
686686 (11) has had a license to practice massage
687687 therapy revoked, suspended or denied in any jurisdiction,
688688 territory or possession of the United States or another country
689689 for acts of the licensee similar to acts described in this
690690 section. A certified copy of the [record of conviction ] order
691691 of revocation, suspension or denial shall be conclusive
692692 evidence of the [conviction; or ] revocation, suspension or
693693 denial;
694694 (12) performs massage therapy at or maintains,
695695 manages or operates a massage therapy establishment that is not
696696 licensed pursuant to the Massage Therapy Practice Act;
697697 (13) refused to allow an inspection of a

727727 tendered proper identification to the licensee or operator of
728728 the massage establishment prior to the refusal; or
729729 [(12)] (14) is guilty of failing to comply
730730 with a provision of the Massage Therapy Practice Act or rules
731731 of the board adopted pursuant to that act and filed in
732732 accordance with the State Rules Act.
733733 C. Disciplinary proceedings may be instituted by
734734 sworn complaint of any individual, including members of the
735735 board, and shall conform with the provisions of the Uniform
736736 Licensing Act.
737737 D. The board shall establish the guidelines for the
738738 disposition of disciplinary cases. Guidelines may include
739739 minimum and maximum fines, periods of probation, conditions of
740740 probation or reissuance of a license.
741741 E. Licensees who have been found culpable and
742742 sanctioned by the board shall be responsible for the payments
743743 of all costs of the disciplinary proceedings."
744744 SECTION 9. Section 61-12C-24.1 NMSA 1978 (being Laws
745745 2019, Chapter 40, Section 13) is amended to read:
746746 "61-12C-24.1. DENIAL OF LICENSE.--
747747 A. Pursuant to the Uniform Licensing Act, the board
748748 may deny the issuance of a massage therapist license to an
749749 applicant.

835835 territory or possession of the United States or another country
836836 for acts of the applicant similar to acts described in this

846846 with a provision of the Massage Therapy Practice Act or rules

853853 shall be sentenced pursuant to Section 31-19-1 NMSA 1978:
854854 A. violates a provision of the Massage Therapy
855855 Practice Act or rules adopted pursuant to that act;

893893 a current valid license or registration issued by the board."
894894 SECTION 11. EFFECTIVE DATE.--The effective date of the
895895 provisions of this act is July 1, 2025.
