54	54	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
55	55	SECTION 1. A new section of the Massage Therapy Practice
56	56	Act is enacted to read:
57	57	"[NEW MATERIAL] REQUIREMENTS FOR LICENSURE OF MASSAGE
58	58	THERAPY ESTABLISHMENTS.--
59	59	A. The board shall establish by rule procedures for
60	60	the licensure of massage therapy establishments and shall issue
61	61	a license to massage therapy establishments that meet the
62	62	requirements of the Massage Therapy Practice Act and rules

91	91	B. The board shall establish minimum standards of
92	92	health and safety for massage therapy establishments."
93	93	SECTION 2. A new section of the Massage Therapy Practice
94	94	Act is enacted to read:
95	95	"[NEW MATERIAL] MASSAGE THERAPY ESTABLISHMENT LICENSURE,
96	96	RENEWAL, SUSPENSION AND REVOCATION--APPLICABILITY.--
97	97	A. On or after January 1, 2026, a person shall not
98	98	maintain, manage or operate a massage therapy establishment
99	99	unless the establishment is a licensed massage therapy
100	100	establishment.
101	101	B. Massage therapy establishment licenses shall
102	102	expire biennially. Expiration dates shall be established by
103	103	rule of the board.
104	104	C. A license shall be renewed by submitting a
105	105	renewal application on a form provided by the board.
106	106	D. A sixty-day grace period shall be allowed each
107	107	licensee after the end of the renewal period, during which time
108	108	a license may be renewed upon payment of the renewal fee and a
109	109	late fee as prescribed by the board.
110	110	E. Proceedings to determine whether to suspend or
111	111	revoke the license of a massage therapy establishment may be
112	112	instituted by sworn complaint of any individual, including
113	113	members of the board, and shall conform with the provisions of
114	114	the Uniform Licensing Act."

145	145	"61-12C-3. DEFINITIONS.--As used in the Massage Therapy

147	147	A. "board" means the massage therapy board;

149	149	workshops and classes in areas related to the practice of

201	201	(2) a massage therapy school regulated by the
202	202	requisite regulatory agency where the massage therapy school is
203	203	located;
204	204	(3) a national or international professional
205	205	association for massage therapists;
206	206	(4) an individual or an organization approved
207	207	by a national or international massage therapy continuing
208	208	education approval agency;
209	209	(5) a health care professional organization;
210	210	or
211	211	(6) accredited post-secondary educational
212	212	institutions;
213	213	D. "department" means the regulation and licensing
214	214	department;
215	215	E. "home-based establishment" means a physical
216	216	premises where massage therapy may be offered by not more than
217	217	two licensed massage therapists who personally reside at the
218	218	premises, the massage therapy offered is only incidental and
219	219	secondary to the use of the premises for a dwelling and the use
220	220	of the premises for the offering of massage therapy is in

251	251	[E.] F. "jurisprudence" means the statutes and
252	252	rules of the state pertaining to the practice of massage
253	253	therapy;
254	254	[F.] G. "massage therapist" means an individual
255	255	licensed to practice massage therapy pursuant to the Massage
256	256	Therapy Practice Act;
257	257	[G.] H. "massage therapy" means the treatment of
258	258	soft tissues for therapeutic purposes, primarily comfort and
259	259	relief of pain; it is a health care service that includes
260	260	gliding, kneading, percussion, compression, vibration,
261	261	friction, nerve strokes, stretching the tissue and exercising
262	262	the range of motion and may include the use of oils, salt
263	263	glows, hot or cold packs or hydrotherapy. Synonymous terms for
264	264	massage therapy include massage, therapeutic massage, body
265	265	massage, myomassage, bodywork, body rub or any derivation of
266	266	those terms. "Massage therapy" does not include the diagnosis
267	267	or treatment of illness or disease or any service or procedure
268	268	for which a license to practice medicine, nursing,
269	269	chiropractic, physical therapy, occupational therapy,
270	270	acupuncture or podiatry is required by law; [and ]
271	271	I. "massage therapy establishment" or "massage
272	272	establishment" means a place of business in which massage
273	273	therapy is offered or performed but shall not include:

310	310	Chapter 23 NMSA 1978;
311	311	(4) health care offices owned, or directly
312	312	operated or managed on a daily basis, by an individual or
313	313	individuals licensed pursuant to:
314	314	(a) the Medical Practice Act;
315	315	(b) the Chiropractic Physician Practice
316	316	Act;
317	317	(c) the Physician Assistant Act;
318	318	(d) the Physical Therapy Act; or
319	319	(e) the Nursing Practice Act;
320	320	(5) a home-based establishment; and
321	321	(6) services provided by a licensed massage
322	322	therapist to a client at a premises selected by the client to
323	323	receive massage therapy, such as the client's home or place of
324	324	business, and such premises is not under the ownership, custody
325	325	or control of the massage therapist; and
326	326	[H.] J. "massage therapy school" means a facility

357	357	SECTION 4. Section 61-12C-8 NMSA 1978 (being Laws 1991,
358	358	Chapter 147, Section 8, as amended) is amended to read:
359	359	"61-12C-8. BOARD POWERS.--The board has the power to:
360	360	A. adopt and file, in accordance with the State
361	361	Rules Act, rules necessary to carry out the provisions of the
362	362	Massage Therapy Practice Act, in accordance with the provisions
363	363	of the Uniform Licensing Act;
364	364	B. provide for the evaluation of the qualifications
365	365	of applicants for licensure as a massage therapist or
366	366	registration as a massage therapy school under the Massage
367	367	Therapy Practice Act;
368	368	C. provide for the issuance of massage therapist
369	369	licenses to applicants who meet the requirements of the Massage
370	370	Therapy Practice Act;
371	371	D. establish minimum curricula for massage therapy
372	372	schools and provide for the issuance and revocation of massage
373	373	therapy school registrations;
374	374	E. establish minimum standards for massage therapy
375	375	establishments and provide for the issuance and revocation of
376	376	massage therapy establishment licenses;
377	377	[E.] F. establish instructor qualifications for
378	378	hands-on massage therapy instruction within the minimum
379	379	curricula;

411	411	(1) inspections of massage establishments may
412	412	be conducted at any time, including when the massage
413	413	establishment is in operation or customers are present; and
414	414	(2) the licensee or operator of a massage
415	415	establishment shall be given an opportunity to accompany the
416	416	board official conducting an inspection and to receive a report
417	417	of the inspection within fourteen days after the inspection ;
418	418	[G.] H. establish minimum training and educational
419	419	standards for licensure as a massage therapist;
420	420	[H.] I. pursuant to the Uniform Licensing Act,
421	421	conduct hearings on charges against applicants or licensees and
422	422	take actions described in Section 61-1-3 NMSA 1978;
423	423	[I.] J. bring an action for injunctive relief in
424	424	district court seeking to enjoin a person from violating the
425	425	provisions of the Massage Therapy Practice Act;
426	426	[J.] K. issue cease and desist orders to persons
427	427	violating the provisions of the Massage Therapy Practice Act or
428	428	any rule adopted by the board pursuant to that act;
429	429	[K.] L. adopt an annual budget;
430	430	[L.] M. adopt a code of professional conduct for
431	431	massage therapists;
432	432	[M.] N. provide for the investigation of complaints

465	465	SECTION 5. Section 61-12C-11 NMSA 1978 (being Laws 1991,
466	466	Chapter 147, Section 11, as amended) is amended to read:
467	467	"61-12C-11. DISPLAY OF LICENSE OR REGISTRATION.--
468	468	A. A massage therapy license or registration issued
469	469	by the board shall at all times be posted in a conspicuous
470	470	place in the holder's principal place of business.
471	471	B. An original or renewal massage therapy license
472	472	or registration issued by the board on or after July 1, 2025
473	473	shall include a current photograph of the licensee or
474	474	registration holder."
475	475	SECTION 6. Section 61-12C-17 NMSA 1978 (being Laws 1991,
476	476	Chapter 147, Section 17, as amended) is amended to read:
477	477	"61-12C-17. LICENSE RENEWAL--CONTINUING EDUCATION.--
478	478	A. Except as provided for initial licensure in
479	479	Subsection B of Section 61-12C-9 NMSA 1978, massage therapy
480	480	licenses shall expire biennially. Expiration dates shall be
481	481	established by rule.
482	482	B. The board may establish continuing education
483	483	requirements as a condition of the renewal of massage therapy
484	484	licenses.

520	520	act] February 4, 2019 shall submit to the board a syllabus and
521	521	one-time fee for any course not previously approved by the
522	522	board.
523	523	E. Within thirty days of application, the board may
524	524	approve or deny the application of an individual who is not a
525	525	continuing education provider to offer a particular continuing
526	526	education course; provided that the individual submits:
527	527	(1) a copy of any relevant license;
528	528	(2) proof of a minimum of two years'
529	529	experience in the area of instruction;
530	530	(3) a course syllabus for the proposed course;
531	531	(4) a resume; and
532	532	(5) a one-time fee to be determined by the
533	533	board by rule.
534	534	F. A license shall be renewed by submitting a
535	535	renewal application on a form provided by the board.
536	536	G. A sixty-day grace period shall be allowed each
537	537	licensee after the end of the renewal period, during which time
538	538	a license may be renewed upon payment of the renewal fee and a

568	568	SECTION 7. Section 61-12C-18 NMSA 1978 (being Laws 1991,
569	569	Chapter 147, Section 18, as amended) is amended to read:
570	570	"61-12C-18. INACTIVE STATUS.--
571	571	A. A massage therapy license not renewed at the end
572	572	of the sixty-day grace period shall be placed on inactive
573	573	status for a period not to exceed two years. At the end of two
574	574	years, if the license has not been reactivated, it shall
575	575	automatically expire.
576	576	B. If within a period of two years from the date
577	577	the license was placed on inactive status the licensee wishes
578	578	to resume practice, the licensee shall notify the board in
579	579	writing, and, upon proof of completion of any continuing
580	580	education or refresher courses prescribed by rule of the board
581	581	and payment of an amount set by the board in lieu of all lapsed
582	582	renewal fees, the license shall be restored in full.
583	583	C. A massage therapy establishment license not
584	584	renewed at the end of the sixty-day grace period shall be
585	585	placed on inactive status for a period not to exceed two years.
586	586	At the end of two years, if the license has not been
587	587	reactivated, it shall automatically expire.
588	588	D. If within a period of two years from the date
589	589	the license was placed on inactive status the licensee wishes
590	590	to resume maintenance, management or operation of the massage
591	591	therapy establishment, the licensee shall notify the board in

626	626	"61-12C-24. SUSPENSION, REVOCATION AND REINSTATEMENT OF
627	627	LICENSES.--
628	628	A. Pursuant to the Uniform Licensing Act, the board
629	629	may take disciplinary action against an individual licensed
630	630	pursuant to the Massage Therapy Practice Act.
631	631	B. The board has authority to take an action set
632	632	forth in Section 61-1-3 NMSA 1978 upon a finding by the board
633	633	that the licensee:
634	634	(1) is guilty of fraud, deceit or
635	635	misrepresentation;
636	636	(2) attempted to use as the licensee's own the
637	637	license of another;
638	638	(3) allowed the use of the licensee's license
639	639	by another;
640	640	(4) has been adjudicated as mentally
641	641	incompetent by regularly constituted authorities;
642	642	(5) has been convicted of a crime that
643	643	substantially relates to the qualifications, functions or
644	644	duties of a massage therapist. A copy of the record of

674	674	conviction, is conclusive evidence of conviction;
675	675	(6) is guilty of unprofessional or unethical
676	676	conduct or a violation of the code of ethics;
677	677	(7) is habitually or excessively using
678	678	controlled substances or alcohol;
679	679	(8) is guilty of false, deceptive or
680	680	misleading advertising;
681	681	(9) is guilty of aiding, assisting or
682	682	advertising an unlicensed individual in the practice of massage
683	683	therapy;
684	684	(10) is grossly negligent or incompetent in
685	685	the practice of massage therapy;
686	686	(11) has had a license to practice massage
687	687	therapy revoked, suspended or denied in any jurisdiction,
688	688	territory or possession of the United States or another country
689	689	for acts of the licensee similar to acts described in this
690	690	section. A certified copy of the [record of conviction ] order
691	691	of revocation, suspension or denial shall be conclusive
692	692	evidence of the [conviction; or ] revocation, suspension or
693	693	denial;
694	694	(12) performs massage therapy at or maintains,
695	695	manages or operates a massage therapy establishment that is not
696	696	licensed pursuant to the Massage Therapy Practice Act;
697	697	(13) refused to allow an inspection of a

732	732	accordance with the State Rules Act.
733	733	C. Disciplinary proceedings may be instituted by
734	734	sworn complaint of any individual, including members of the
735	735	board, and shall conform with the provisions of the Uniform
736	736	Licensing Act.
737	737	D. The board shall establish the guidelines for the
738	738	disposition of disciplinary cases. Guidelines may include
739	739	minimum and maximum fines, periods of probation, conditions of
740	740	probation or reissuance of a license.
741	741	E. Licensees who have been found culpable and
742	742	sanctioned by the board shall be responsible for the payments
743	743	of all costs of the disciplinary proceedings."
744	744	SECTION 9. Section 61-12C-24.1 NMSA 1978 (being Laws
745	745	2019, Chapter 40, Section 13) is amended to read:
746	746	"61-12C-24.1. DENIAL OF LICENSE.--
747	747	A. Pursuant to the Uniform Licensing Act, the board
748	748	may deny the issuance of a massage therapist license to an
749	749	applicant.

787	787	(4) has been adjudicated as mentally
788	788	incompetent by regularly constituted authorities;
789	789	(5) has been convicted of a crime that
790	790	substantially relates to the qualifications, functions or
791	791	duties of a massage therapist. A copy of the record of
792	792	conviction, certified by the clerk of the court entering the
793	793	conviction, is conclusive evidence of conviction;
794	794	(6) is guilty of unprofessional or unethical
795	795	conduct or a violation of the code of ethics;
796	796	(7) is habitually or excessively using
797	797	controlled substances or alcohol;
798	798	(8) is guilty of false, deceptive or
799	799	misleading advertising;
800	800	(9) is guilty of aiding, assisting or
801	801	advertising the practice of massage therapy in New Mexico
802	802	without a New Mexico license;

833	833	(11) has had a license to practice massage
834	834	therapy revoked, suspended or denied in any jurisdiction,
835	835	territory or possession of the United States or another country
836	836	for acts of the applicant similar to acts described in this
837	837	section. A certified copy of the [record of conviction ] order
838	838	of revocation, suspension or denial shall be conclusive
839	839	evidence of the [conviction; or ] revocation, suspension or
840	840	denial;
841	841	(12) has performed massage therapy at or has
842	842	maintained, managed or operated a massage therapy establishment
843	843	that is not licensed pursuant to the Massage Therapy Practice
844	844	Act; or
845	845	[(12)] (13) is guilty of failing to comply
846	846	with a provision of the Massage Therapy Practice Act or rules
847	847	of the board adopted pursuant to that act and filed in
848	848	accordance with the State Rules Act."
849	849	SECTION 10. Section 61-12C-27 NMSA 1978 (being Laws 1993,
850	850	Chapter 173, Section 20, as amended) is amended to read:
851	851	"61-12C-27. OFFENSES--CRIMINAL PENALTIES.--An individual
852	852	who does any of the following is guilty of a misdemeanor and
853	853	shall be sentenced pursuant to Section 31-19-1 NMSA 1978:
854	854	A. violates a provision of the Massage Therapy
855	855	Practice Act or rules adopted pursuant to that act;
856	856	B. renders or attempts to render massage therapy

888	888	establishment that is not licensed pursuant to the Massage
889	889	Therapy Practice Act; or
890	890	[C.] D. advertises or uses a designation, diploma
891	891	or certificate implying that the individual is a massage
892	892	therapist or massage therapy school unless the individual holds
893	893	a current valid license or registration issued by the board."
894	894	SECTION 11. EFFECTIVE DATE.--The effective date of the
895	895	provisions of this act is July 1, 2025.
