5050 RELATING TO STATE GOVERNMENT; CREATING THE OFFICE OF HOUSING
5151 PLANNING AND PRODUCTION; PROVIDING POWERS AND DUTIES; DECLARING
5252 AN EMERGENCY.
5353 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5454 SECTION 1. [NEW MATERIAL] OFFICE OF HOUSING PLANNING AND
5555 PRODUCTION CREATED--ADMINISTRATIVELY ATTACHED--POWERS AND
5656 DUTIES.--
5757 A. As used in this section, "housing" means real
5858 property and infrastructure that is residential housing,
5959 including rental housing, the housing portion of a mixed-use
6060 commercial and housing project and commercial property that is
6161 repurposed for residential housing.
6262 B. The "office of housing planning and production"
6363 is created and is administratively attached to the department

9292 administrative services for the office.
9393 C. The purpose of the office of housing planning
9494 and production is to:
9595 (1) reduce housing costs;
9696 (2) increase statewide housing availability,
9797 including housing for low-income and homeless households;
9898 (3) maximize resources to address statewide
9999 housing needs;
100100 (4) address the underlying factors that are
101101 impacting housing costs and limited supply;
102102 (5) grow local programs and capacity to
103103 address housing needs and further fair housing;
104104 (6) identify state resources for housing; and
105105 (7) track housing progress through goal
106106 setting and data.
107107 D. The director of the office of housing planning
108108 and production shall be appointed by the governor. Subject to
109109 appropriations, the director may employ technical and clerical
110110 assistants as necessary to carry out the powers and duties of
111111 the office.
112112 E. The office of housing planning and production
113113 shall:
114114 (1) develop a statewide strategy to build
115115 collaborative partnerships among state agencies and local

145145 programs and identifying resources;
146146 (2) provide technical assistance to local
147147 governments, Indian nations, tribes and pueblos and regional
148148 entities to improve housing regulation, further fair housing,
149149 increase housing development capacity and housing funding, grow
150150 local and statewide capacity for homelessness services and
151151 prevention and promote public-private housing partnerships;
152152 (3) align resources across state agencies and
153153 the private sector to identify new programs to increase
154154 capacity in housing finance and housing development and to grow
155155 the construction and trades workforces;
156156 (4) address the underlying factors that impact
157157 housing costs and availability, regardless of income, by, at a
158158 minimum:
159159 (a) analyzing regulatory frameworks
160160 surrounding land use and zoning, building codes, permitting and
161161 inspection processes and utility and road connections;
162162 (b) analyzing construction costs
163163 associated with workforce shortages and supply chain
164164 constraints; and
165165 (c) promoting new approaches to housing,
166166 including modular, manufactured and tiny homes and new
167167 construction technologies;
168168 (5) coordinate across state agencies and local

198198 (6) collect and report housing and land use
199199 data and outcomes at least annually to the legislative finance
200200 committee; provided that the data and outcomes shall describe
201201 housing development activities, programs and investments in
202202 regions of the state and statewide to:
203203 (a) evaluate needs and progress toward
204204 housing goals;
205205 (b) identify geographic gaps in housing
206206 availability and services;
207207 (c) assess the relative health of local
208208 and regional housing markets; and
209209 (d) evaluate the impacts of state,
210210 regional and local housing programs;
211211 (7) collect and report data at least annually
212212 to describe and monitor the housing market in regions of the
213213 state and statewide and establish housing production goals
214214 across income levels;
215215 (8) evaluate housing data to identify:
216216 (a) geographic gaps in housing
217217 availability and whether the gaps are the result of increased
218218 or decreased economic activity;
219219 (b) duplications within state agencies
220220 of service and finance efforts; and
221221 (c) adequate progress of local

251251 (9) analyze housing and economic development
252252 investments and initiatives, measure impacts of state, regional
253253 and local housing programs, monitor state and local efforts,
254254 support local efforts to meet defined housing goals, make
255255 necessary policy changes and investments to achieve housing
256256 goals and make findings publicly available;
257257 (10) create a framework for local governments
258258 to set goals for meeting housing needs across income levels;
259259 (11) grow local ability to meet housing needs
260260 by:
261261 (a) working with local governments on
262262 land use and zoning, permit, inspection and building codes;
263263 (b) supporting capacity building at the
264264 local and regional level for new housing programs; and
265265 (c) using goal setting frameworks and
266266 land use outcome data to create accountability to solve
267267 problems locally;
268268 (12) identify ways that existing programs and
269269 capacities can address housing needs;
270270 (13) provide support to state agencies
271271 undertaking housing and housing-adjacent activities; and
272272 (14) perform nonduplicative duties assigned by
273273 the governor or the legislature to ensure that the state meets
274274 or exceeds the state's housing goals.
