49	49	RELATING TO MOTOR VEHICLES; ESTABLISHING A MAXIMUM SPEED LIMIT

51	51	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
52	52	SECTION 1. Section 66-7-301 NMSA 1978 (being Laws 1978,
53	53	Chapter 35, Section 405, as amended) is amended to read:
54	54	"66-7-301. SPEED REGULATION.--
55	55	A. No person shall drive a vehicle on a highway at
56	56	a speed greater than:
57	57	(1) fifteen miles per hour on all highways
58	58	when passing a school while children are going to or leaving
59	59	school and when the school zone is properly posted;
60	60	(2) thirty miles per hour in a business or
61	61	residence district;
62	62	(3) fifty-five miles per hour on a county

93	93	(5) the posted speed limit in construction

96	96	transportation; provided that the posted speed limit shall be
97	97	determined by an engineering study performed by the department
98	98	of transportation.
99	99	B. In every event, speed shall be so controlled by
100	100	the driver as may be necessary:
101	101	(1) to avoid colliding with a person, vehicle
102	102	or other conveyance on or entering the highway;
103	103	(2) to comply with legal requirements as may
104	104	be established by the department of transportation or the New
105	105	Mexico state police division of the department of public safety
106	106	and the duty of all persons to use due care; and
107	107	(3) to protect workers in construction zones
108	108	posted as double fine zones or other safety zones posted as
109	109	double fine zones as designated by the department of
110	110	transportation.
111	111	C. No person shall drive a truck tractor on a
112	112	highway at a speed greater than sixty-five miles per hour.

528	528	for the particular penalty assessment misdemeanor and probation
529	529	imposed upon a suspended or deferred sentence shall not exceed
530	530	ninety days.
531	531	D. The penalty assessment for speeding in violation
532	532	of Paragraph (5) of Subsection A of Section 66-7-301 NMSA 1978
533	533	is twice the penalty assessment established in Subsection A of
534	534	this section for the equivalent miles per hour over the speed
535	535	limit.
536	536	E. Upon a second conviction for operation without a
537	537	permit for excessive size or weight pursuant to Section
538	538	66-7-413 NMSA 1978, the penalty assessment shall be two hundred

577	577	provisions of this act is July 1, 2025.
