4949 RELATING TO NOTARY OFFICERS; INCREASING THE MAXIMUM FEES A
5050 NOTARY OFFICER MAY CHARGE FOR SERVICES; AMENDING SECTION
5151 14-14A-28 NMSA 1978 (BEING LAWS 2021, CHAPTER 21, SECTION 28,

5353 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5454 SECTION 1. Section 14-14A-28 NMSA 1978 (being Laws 2021,
5555 Chapter 21, Section 28, as amended) is amended to read:
5656 "14-14A-28. FEES.--
5757 A. A notarial officer may charge the maximum fee
5858 specified in this section, charge less than the maximum fee or
5959 waive the fee.
6060 B. An employer shall not establish fees for
6161 notarial services that are in excess of those specified in this
6262 section nor on the attributes of the principal as delineated.

9090 C. The maximum fees that may be charged by a
9191 notarial officer for notarial acts are:
9292 (1) for acknowledgments, [five dollars
9393 ($5.00)] twelve dollars ($12.00) per acknowledgment;
9494 (2) for oaths or affirmations without a
9595 signature, [five dollars ($5.00) ] twelve dollars ($12.00) per
9696 person;
9797 (3) for jurats, [five dollars ($5.00) ] twelve
9898 dollars ($12.00) per jurat; and
9999 (4) for copy certifications, [fifty cents
100100 ($.50)] one dollar twenty cents ($1.20) per page with a minimum
101101 total charge of [five dollars ($5.00) ] twelve dollars ($12.00) .
102102 D. A notarial officer may charge a travel fee when
103103 traveling to perform a notarial act if:
104104 (1) the notarial officer and the person
105105 requesting the notarial act agree upon the travel fee in
106106 advance of the travel; and
107107 (2) the notarial officer explains to the
108108 person requesting the notarial act that the travel fee is
109109 separate from the notarial fees and not mandated by law.
110110 E. In addition to the fees prescribed in
111111 Subsections C and D of this section, a notarial officer may
112112 charge a technology fee not to exceed [twenty-five dollars
113113 ($25.00)] sixty dollars ($60.00) or other amount established by
114114 rule by the secretary of state per notarial act performed with

144144 SECTION 2. EFFECTIVE DATE.--The effective date of the
145145 provisions of this act is July 1, 2025.
