49	49	RELATING TO NOTARY OFFICERS; INCREASING THE MAXIMUM FEES A
50	50	NOTARY OFFICER MAY CHARGE FOR SERVICES; AMENDING SECTION
51	51	14-14A-28 NMSA 1978 (BEING LAWS 2021, CHAPTER 21, SECTION 28,
52	52	AS AMENDED).
53	53	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
54	54	SECTION 1. Section 14-14A-28 NMSA 1978 (being Laws 2021,
55	55	Chapter 21, Section 28, as amended) is amended to read:
56	56	"14-14A-28. FEES.--
57	57	A. A notarial officer may charge the maximum fee
58	58	specified in this section, charge less than the maximum fee or
59	59	waive the fee.
60	60	B. An employer shall not establish fees for
61	61	notarial services that are in excess of those specified in this
62	62	section nor on the attributes of the principal as delineated.

90	90	C. The maximum fees that may be charged by a
91	91	notarial officer for notarial acts are:
92	92	(1) for acknowledgments, [five dollars
93	93	($5.00)] twelve dollars ($12.00) per acknowledgment;
94	94	(2) for oaths or affirmations without a
95	95	signature, [five dollars ($5.00) ] twelve dollars ($12.00) per
96	96	person;
97	97	(3) for jurats, [five dollars ($5.00) ] twelve
98	98	dollars ($12.00) per jurat; and
99	99	(4) for copy certifications, [fifty cents
100	100	($.50)] one dollar twenty cents ($1.20) per page with a minimum
101	101	total charge of [five dollars ($5.00) ] twelve dollars ($12.00) .
102	102	D. A notarial officer may charge a travel fee when
103	103	traveling to perform a notarial act if:
104	104	(1) the notarial officer and the person
105	105	requesting the notarial act agree upon the travel fee in
106	106	advance of the travel; and
107	107	(2) the notarial officer explains to the
108	108	person requesting the notarial act that the travel fee is
109	109	separate from the notarial fees and not mandated by law.
110	110	E. In addition to the fees prescribed in
111	111	Subsections C and D of this section, a notarial officer may
112	112	charge a technology fee not to exceed [twenty-five dollars
113	113	($25.00)] sixty dollars ($60.00) or other amount established by
114	114	rule by the secretary of state per notarial act performed with

144	144	SECTION 2. EFFECTIVE DATE.--The effective date of the
145	145	provisions of this act is July 1, 2025.
